Hello all,
i am first time here,
my query is that my elder brother got expired on 3/4/2014 due to medical problem. He was married to his wife in 2006.
due to some family problem and medical problem of the husband wife leave separate without any settlement since 2010 ie 3 years.
now she is demanding all those things that bright by her at the time of marriage nd all the benefits of his husband.
pls suggest what we have to do in this case whether go to settlement in home without any legal formalities' or go with legalized manner.
pls suggest, i am waiting for ur valuable suggestion..

Hello all,
We have taken pagdi room 32 years ago.
now from 5 years we are living in own flat, and the pagdi room is locked (nobody is living over there)
until now, he charged us rent rupees around 200 per month. which we are giving him till Dec 2013.
we usually pay him on quarterly basis so to pay next bill we went over there on APR 2014 but he refuse to take rent and said that decision of rent rate increase will coming soon and he will charge according to new rates.
yesterday when he called us , we went to pay rent but, he saying that from now onward you need to pay rent 1000 Rs/ month.
He did not repair his building in last 30 years.
Can building owner increase his rates suddenly by 5 times? from 200 to 1000.

I am a social worker and a Vice President of Charitable Organization.
I was out of station on business trip and this was known to everybody in my compound.
After 2 days of my departure from Mumbai, BEST vigilance team of 12 men forcibly entered my house when my wife was alone with a six month baby. They claimed theft of electricity and took signature of my wife threatening if she don't sign she will be arrested.
I believe this was a conspiracy plotted by my enemies against whom I have lodged complaints in BEST and Municipality for illegal building and electricity
I was called by my wife when I was in Ratnagiri and I also spoke to the vigilance team that I do not know about the situation as the meter cabin is 10 meters away from house and cannot be seen if anybody tampers the same. I am on my way to Mumbai and will be in your office immediately for the resolution. They promised not to worry as this is just a common problem and can be taken care of.
When I was in train coming to Mumbai, the Vigilance people started demanding 1.5 lacs in cash or they will take my wife to jail and take the meter away. Again my wife called in Panic state and was crying of getting arrested, she was mentally tortured which has put my baby's life in stake.
As soon as I landed at 2200 hrs at home, I found there is no electricity and the meter is taken away putting my house in dark. And within 3 minutes two policeman came and arrested me and took be to Police Station. The BEST people came after a while, again I told them I am giving you a cheque as I do not have cash now. I will visit to your office and clear the matter. But they did not listen to me and said now the matter is in Police Hands.
My fingerprints and photos from different angle has been taken by the Police. I was very much depressed by this act of Police as they were treating me as a murderer or terrorist. Moreover next day at 1500 hrs. they took me to J.J. Hospital for medical checkup where the doctor just looked at me and signed the medical certificate. After that I was taken to Remand Court even though my lawyer called the Police Station that this case goes to Session court. The Sub-Inspector told my lawyer we know our duties and the most horrible thing they did was, a team of 4 policemen handcuffed me and took me to the Criminal Court defaming my character. The judge of the Criminal Court told the police that she cannot give any verdict on my case as it is under jurisdiction of Session Court. Now the time was 1640 hrs. and the day was Friday. I had to pay 9000 rupees for arranging special transport to session court else I would have to stay in custody for 2 more days. I was bailed out by paying Cash deposit of Rs. 30,000/-.
I was never given a copy of FIR nor the copy of verdict from the judge of session court.
Due to this arrest I went into depression and could not provide service to my client and they stopped my payment of 2 lacs.
How ever my average monthly ( 12 months average) consumption is 70 - 80 units which is Rs. 356/- and I was fined for Rs. 1,32,557 for the loss of 8243 Kwatts which is completely false.
Later I paid 50,000/- to BEST and got my electricity re-connected and the case is still in court
Please let me know, how can I be arrested when I was not there at the time of Crime and also how to fight this case as the hearing is on 19th May 2014

Dear Experts,
This is related to 2 holding no where no passage is shown in the old town survey map.
These two building exists since last 100 years.
It can be seen in year 1914's town survey map that these 2 holding no exists but with out any entry passage. During the course of time people of these 2 holding and other neighours use one common passage to enter the holdings which is shown in respective registration deed. But this common passage is not present in any map of the municipality like survey map.
What steps needs to be taken to update the municipality record.
This is the only passage by which we can enter to our house . can any body close this passage?

I have been married for 12 years. I along with my wife and my 2 kids live with my parents. Suddenly she has pickup a fight with me and started fighting. I have a travelling job and she accuses me of seeing other women with no proof. She belongs to a small town and her exposure to the world is TV. Her mother influences her a lot on a daily basis. Because of her daily fight i called her father to talk to her and pacify her. She even filed a police complaint against me saying that i have threatened to kill her. (sic) Father in law said that his daughter has some mental problem and took her to Mumbai with a promise that i take the kids along and bring her back. Once Ireached her house the whole family fought and i had to run away from their house with my son age 6. My daughter, age 8, insisted that she wants to stay back. My wife has refused to come back. My quesstion to all gentlemen here is my daughter is studying in very good school here and she has missed her school for more than a month. My wife is planning to put her in a low standard school in a small town outskirt of mumbai. Is there a way i can get my daughter back. I do understand that daugther should be with her mother but since her future is going for a toss i wish to bring her back. If my wife comes back i would be happy if she does not then what is the way for me. She can go to any extreme to stay with her parents. She Can even file a physical and mental torture case on me. (The typical cases that indian women do) I have never even raised my voice on her forget raising my hand. If I let her keep my daughter, how can i stop her taking my son away. Please help.

My grand mother has a land in hyderabad which she received from her father and she even has all the original documents of the Nizmas period as to how her father had purchased it from the nizams government in the form of sarkar e asifia stamp papers in which the sale deed was executed in her fathers favour . She also has revenue record,khasara pahani and pahani of the year 55-56 in which the pattedar column features her name along with some tenants in the other column .Those tenants were the khauldars of the said land and annually executed the khaul deed . it was last in 80's that they terminated with us the khaul agreement and and went incommunicado . since my grand father did not used to keep well he very rarely used to visit the land,it was last in 1990's he visited and soon passed away ,my widow grand mother could not visit and check the status of the land due to her old age and responsibilities and i were too young to understand all this. I recently happened to check these papers and visited the site to ascertain whats the real matter and found that the land was fully developed with apartments and villas ,some agent arranged for me a copy of the registered document from the SRO and i realized the signatures of my grand mother were forged to register the property .it seems the descendants of the khauldar have done so ,we even have the original papers of the khaul deed in which their father had acknowledge that he would have no right on the khaul land on the termination of the khaul deed . please guide me .

On 28-01-14 over a little quarrel my wife left my house. On 29-01-14 a compromise was effected in the police Station. I filed a case in Amarat-E-Sharia Punjab for reconciliation. On 5-05-14 Amarat –E-Sharia Punjab tried to reconcile. But no reconcilation was got effected. Due to cruel behavior of my wife I gave him First talaq on 6-05-2014 sent by registered post. Which was still lying in the post office because she in connivance with postal authorities not receiving the talaqnama of first talaq knowingly.
After sending my First talaq on 6-05-14.non delivered, She has filed a complaint of dower & domestic violence & leveled other charges against me and my family. Women cell Patiala called me on 13-05-2014. I submitted all the documents including copy of talaqnama and other documents to Incharge women cell in her presence who deny but say that she has not received any talaq so far. I again submitted the copy of talaqnama to incharge women cell.Incharge women cell who ordered me and my family to record their statements against the complaint filed by my Ex-Wife. I requested copies of complaint filed by my Ex-Wife so that I may prepare my case. Please guide me
1. women cell has not supplied me copy of complaint, whether its refusal justified
2. Whether women cell has jurisdiction to try this case after talaq
3. Whether my wife can file 498/dowry case/domestic violence/ case against me and my family members after first talaq.
4. Whether this First talaq is valid
Also supply me detail of judgement on this topic

I am from Bangalore. I have completed my degree. Few days before i saw my dad's TC and came to know there is a difference in the caste mentioned in my school documents and his. In my school documents it is mentioned as 'nayanaja kshathriya'and in my dad's TC it is 'bajanthri'. Both belong to category 2A in reservation.
Now i would like correct it as per my dad's TC. But i have taken reservation in degree based on 'nayanaja kshathriya'.
Will it be a problem. Please help me regarding this.

please guide me that i issued a legal notice on behalf of my client to a corporate for clearance of outstanding amount.
Now they telling that how can you give legal notice directly.You people have not called us or emailed us. We emailed them but that email was changed so it was not received by company.
Now they saying we will clear outstanding amount but for that you need give withrawal letter asking apology,then only we will give money and clear dues.
Please guide experts,this is blackmail and can we sue them on this?
is really there is need to give withrawl letter asking apology if my client is saying on letter head he will write that you have given outstanding money and matter is closed and settled but they asking apology.
