Possession

A developer hands over 90% of units to buyers. He asks them to sign an agreement between him that he has handed over possession. The subject line of the said agreement says possession to carry out interiors. He specifically prohibits anyone from occupying the said unit till OC is obtained. Now he is demanding maintenance from his customers. As a matter of fact possession of the unit under MOFA can only be given after OC .

Now many buyers were not aware of this stipulation in the agreement and have been residing in their units since 3 years. Should we pay maintenance in the absence of actual possession and OC?

Cst on subsequent sale as per ap vat

M/s A Dealer in Hyderabad ( Telengana AP) purchased goods from M/s B of Mumbai ( Maharashtra) for Rs 24378/- (includes of CST tax of Rs 478/-) against C Form (inter state transaction)
Than M/s A Dealer in Hyderabad ( Telengana AP) sale the same goods to M/s C of Kolkata (West Bengal) for Rs 33558/- (includes of CST tax of Rs 658/-) while movement fo goods from Maharashtra against the C Form (inter state transaction)
What will be the correct option for them for filling of CST returns and payment of CST tax
1) Can claim exemption under section 6(2) of CST Act as M/s A(second sale) sold the goods to M/s C of Kolkata (West Bengal) while movement of goods from Mumbai and can file the returns by mentioning it in exempted sales u/s 6(2) for CST returns.

2) Are has to pay difference CST tax of Rs 180/- (658-478)
Purchase input CST tax Sale output CST tax difference
23900 478 32900 658 180
How to fill the CST returns because the option for input tax deduction is not available for CST returns in online filling. If we see the VAT online filling options it mentioned separately and clearly for purchase and sales details for filling and for claiming of input exemptions which are similarly not available for CST returns

3) Are has to pay total CST on sale of Rs 658/- and fill the returns as turnover of Rs 32900/- as CST paid on purchases cannot be claimed as input tax
Please suggest and guide us in this regards
Thanks

Property issues after divorce

Hello;

This is something i am asking just for my own safety.

I am married to an australian citizen in australia. Our marriage is registered in Australia.
This is my second marriage.

I am not an australian citizen.

I happen to have ample of my own property and money received from my previous alimony saved up for my daughter and our future.

What i want to know is that tmrw in event of my marriage breaking down.

1. Can he claim my premarital property?
2. Is australian family law or any ajudication valid in india.?
3. Is australian marriage even valid in india?
4. Is a statutory declaration signed by both of us to not claim any part of each other's property before marriage legal in court and will that be sufficient in case the need arises?

5. Since i am not earning right now and will be earning less than him later too. as its not easy to gain any ground in a foreign country. Will i be able to claim compensation for my daughter and me. (she is his step daughter).

6. Plus whose liability here is more . mine or his. As i wonder why is he not bothered about protecting his house and property he has earned here.

Fraud and misleading of court

Plaintiff filed suit for recovery of two property out which he already sold one property even before filing the suit which is proved on the file but the counsel at the time of arguments state that he withdraw the claim over that property and want the decree of the remaining portion.he played a fraud and intentionally added the sold property . As per recent judgement of SC party not entitled to any relief if played a fraud. My query is
1. Whether the suit should be dismissed in toto if yes, with law point and reasoning.
