Co borrower in title deed

Hi
I'm planning to buy a property on loan in Mumbai. For the loan application I have made by dad as the co borrower. Is it necessary to have my dads name as a co owner on the title deed or I alone can be the owner of the property? Also in case of my demise to whom will the ownership gets transferred before and after my marriage?

Need advice-issue of warrant in complaint case

As per my earlier post, my aunt has filed a complaint case of cheating and cheque bounce in the court after issuing of demand notice to her DIL. The case details in short-

My aunt bought a jewelry set from Tanisq for Rs 4 lakhs (Aprox.). After the purchase her daughter in law liked the set and requested her to give the set. My aunt's daughter in law gave a 6 months post dated cheque for the entire amount. The post dated cheque was given because she had her funds locked in FD's & she did not want to break it in the middle. Now when the cheque date neared her daughter in law ignored her call. The cheque has retuned saying 'Payment stopped'.

The case has been filed and the complainant has disposed as witness. According to my lawyer the cognizance will be taken by magistrate after two more witness statements and argument by my lawyer.

My question is if everything goes by plan, how long will it take in normal course to get the warrant issued by the court. As per my understanding she will refuse to receive court summon as she did with the demand notice.Unless a warrant/NBW is issued against her she will not appear in the court.

It is said that cheque bounce cases run fast but my lawyer says that it is difficult to get dates before 1 month. But somehow we have managed to take dates every week till now.

We are very anxious and want to know about the average time line to get the warrant issued from court. We also want to know the step by step process after the court takes cognizance about issuing of summon till issue of NBW.

Rti act 2005

Dear Experts,
Greetings of the Day!

1. I've given request for an information under RTI Act 2005 to the Circle Officer.

2. No response was received within the mandate period.

3. I've appealed to the 1st appellate authority/DDC. Unfortunately DDC was not the 1st appellate authority and it was informed over the phone to me from the DDC office.

4. I've appealed again to the 1st appellate authority/SDO describing the reason of late appealing.

5. No response was received within the mandate period again.

Now my quarry is :

A. Weather my application to the SDO was as per the law?

B. Shall I appeal to the State Information Commissioner for the information.

C. What if no response received from the SIC Office also?

D. Which is the higher authorities after the SIC?

E. Any case in the court of law can be filed against these authorities?

Regards,
Manish Kumar

Wrong khata no. in 2 consecutive sale deeds

Dear Experts,
Greetings of the Day!

This is the matter of my 15 years of savings, so kindly help me out to get fair justice!

I've purchased a Plot in Ramgarh (Jharkhand) in Aug '2012 from Mr. A. The same plot was purchased by Mr. A eight months ago i.e. Jan '2012 from Mr. B. Motation (Correction Slip) was issued and accordingly rent tax was paid for the year 2012-13 in both cases.

I've taken Housing Loan from the Nationalized Bank and the construction work is completed and i'm using the premises.

Now problem is that Khata No. of the said plot No. was recorded incorrect in both the sell deed and accordingly in the Motation (Correction Slip).

Now I've approached Mr. A who is not responding properly and Mr. B. is asking for a huge amount instead of the correction. Also the registrar office is asking for the full revenue twice (one for Mr. A as the correction in my sale deed couldn't happen without correction in his sale deed and one for my sale deed.

Meanwhile I've given an RTI Application to the Circle Officer for the details of land and process of rectification, but sadly no response received from their end accordingly i appealed to the SDO but again the story was same and no response came.

Finally i've decided to appeal to the SIC. May be in a day or 2 i'll do that.

But i'm not sure that weather my struggle will give me a result!

Hence i request you experts to kindly suggest me the process to get the fair judgement.

Hi,M working with XY company for more that 1.5 years. On 30th May2014 I have put a resignation and shared my willingness to get relieving by 10 June 2014 as I have to immediate join a new company. The notice period is 60 days and I am ready to buy back the notice by paying, however while having my exit interviews my manager refusse to relieve me, they want me to serve atleast 30 days notice. I have gone through my agreement letter however did not found any clause by which they can compel me to serve the notice for 30days if I am ready to pay,

The terms and conditions states that-
"After completing the Probationary period, the employee can terminate this employment agreement within the company by giving prior notice as per policy (60days). In addition, prior such terminations the company has reimbursed cost at the time of joining, or training, or overseas travel etc. If the employee fails, to company as so required, the employee acknowledged and agrees that loss or damage is likely to be caused to the company. In the event , the employee, undertakes to and shall pay to the company, for the losses nad trainings etc ,plus salary equivalent to any shortfall in notice period require to be given by the employee to the company.
Please let me knw if I can challenge them back to relieve me by 10th June in lieu of salary."

Also please given an insight on Labour laws to know more about the Employee rights so that I can further approach them in prompt way with all the information in hand.

Ready and willing to purchase suit under specific performance

Dear sir,
I have made an agreement for purchase of land during Oct.2004. On the Stamp paper sellers party, Husband wife and son all three signatures are on the stamp paper including one of witness and the purchasers signature. Seller agreed and a token of acceptance we paid Rs.10000/- as advance to complete the procedure. I have sent a notice through advocate during 2008 but no reply. Again we have sent legal notice through advocate and the seller approached to Lawer for refunding the money which advance was taken by them. But I as purchaser did not agree since I want to purchase the land and use for house purpose as shelter. Again I have sent legal notice in January, 2010 but so far there is no reply. The seller wants increase in the amount for which I am ready since rates are gone up.
I want to know that under Specific Performance can I file a suit against Seller? What is the remedy?
I am ready for settlement for increasing the amount for purchase but I have loss and the seller is gaining? What should I do? Please encourage
Thankingyou

Registration agreement

I registered a property on 26/05 taking loan from housing finance company .I gave DD's of 2.4 lacs to the builder for UDS and agreement registration . On the day of registration the builder got 1 copy of registration and sale deed and i carried the MOD . The housing finance company representative did not get any documents for registration . The builder asked finance company's copy of registration agreement . When checked with the staff of the housing finance ,it was confirmed no document is required .Registration with builders copy is sufficient. I proceeded with the registration as I was told . After the completion of registration a fight ensued between the builder and fin. company ,builder refusing to give the registered agreement and finance company refusing to release 5% of blasnce payment . As a purchaser I am taken aback by this blame game as i am stuck now . I don't have any copies of the registered documents till date . What do I now ? what are the legal options available ?
