Sir,
We are allottes from the Bangalore development authority 114 appartments under the self financing housing scheme. That is in the BDA property land 114 appartments were constructed as per BDA plan, but totally financed by the allottes in stages.
A lease cum sale agreeent was signed by us with BDA, that after 10 years of the Lease cum sale agreement an absolute sale agreemnt has to be signed with BDA.
95% of the allottes have signed absolute sale deed. The toal 4 acres of land is held by 144 as UNDIVIDED SHARE.
NOW WE WANT TO REDEVELOP THIS PROPERTY. BUT FEW non registered allottes are opposing redevelopment as their transcations eveb after 25 years of allotment has not been duly registered.
Questions:
Can the majority owners go ahead for redevelopment with a builder.
Or, can we divide the undivided share into the group who are for redevelopment and the ones who are against it legally.
Any other suggestions?
We did our level best to convince them for last 2 years. But they are adamant.
Thanks.regards

Respected Experts,
A shop keeper supplied goods worth Rs 10000/- and received a cheque of the same amount from buyer. On the invoice it was mentioned that dishonor of cheque would attract penalty of Rs 200/-.
Cheque got dishonoured on presentation due to insufficient funds. Buyer issued a fresh cheque of Rs 10000 + 200 (penalty as per invoice) = 10200/-.
The cheque of Rs 10200/- also gets dishonoured.
Please advise that can a complaint, after notice, be made of the cheque amount of Rs 10200/- which as per terms and conditions of the invoice the buyer was under legal liability to pay. The doubt is just because of amount of Rs 200/- included as penalty for dishonour of previous cheque.
Sirs
A case in which an agreement holder being as defendant is protected under sec53A of TP act by both the civil court and high court.
The defendant has been in possession presently but do not hold sale deed cos of the case.
Now how to help the defendant get a sale deed or it is not necessary as the court had ruled that he is in possession and doesn't need sale deed

In civil case I have to file documents in evidence but intentionally opp. counsel is absenting from court now how to give a copy to the opp. party or to proceed with case.
My father filed a suit for vacating the tenant. During the course of trial my father was cross examined. On cross examine day I joined him to court since he had undergone heart surgery.
At the time of cross the opp Advocate objected my presence and judge asked me to leave the court hall.
My query to respected experts is even though I was not a party to the suit is there any stipulation that son should not be present or rather how will my presence effect the cross examination.

The Flat was in name of my Mother in Law who passed away in 1996 and My father in Law was the nominee who passed away in 2006. The share certificate had my Brother in Laws name and hence the society transferred it to his name without the knowledge or approval of my Husband.
The building has now gone for redevelopment and the new building will be ready in 2014 September.
Can my Husband still claim to be heir to the property.
Can his brother transfer it to my husband.
Do we need to take NOC from his two sisters.
What steps shall be taken to ensure all rights are honoured without getting in to legal wrangles.
