Citizenship

Hi, i am Indian citizen and my husband has acquired australian citizenship (before he was also indian). My baby was born in Australia and that's why she is also Australian. But we've been living in India for more than a year now.
Here, i want to know if we go for divorce,can i contest for child custody. What are the chances for me. She is just under 4 yrs.
Secondly, if her nationality is a problem to get me my baby, what is the process of making her citizen of india like me, of course, without my husband's consent.
please advice.

Application of motor transport worker act

Hi,

I have many forklifts and heavy handling equipment to load and discharge cargo and container, as well as stack them in the warehouse all of which are within my premises. these equipment do not ever perform any function outside my premises and are not moving on the public roads.

My licence is under the shops and commercial establishment act.

My query is whether I will need to comply with minimum wages under the shops and establishments act or under the motor vehicles act.

any clarity with suitable case law would be much appreciated.

False assurance and extortion of fee by the advocates

Sirs,
As advised by experts, i went ahead to try luck for getting the false complaint of alleged assault by the father in law and step mother in law of my daughter in Bangalore. I contacted one lady advocate who assured me that her senior and the 482 court hon judge have been good friends and any case taken up by her senior would be signed off by the 482 court hon judge. I paid good amount as token despite her demand to pay full amount, even before the case was filed. I was assured that on 15th April 2014, i will have to meet her to collect the QUASH order. But the case was finally filed during the holidays, and the holiday bench granted STAY for 45 days. The lady advocate demanded full amount screaming at me, but i had politely escaped to pay balance upon receipt of QUASH order.
On the Admission Day, the so called Senior could not utter even a word in defence whereas a young advocate brought so many points, for which the senior had no counter. The senior despite my explanation and materials provided to him totally of the case had not even prepared himself to speak even basics and we were asked to go to lower court for discharge.
Can i file a complaint with any legal body against these two advocates for claiming to have intimate relation with a judge based on which false assurances were given?

MUTUAL SEPARATION OF PROPERTY

Hon'ble experts,
I had posted in my previous query,namely 'PATERNAL AUNT INTERFERING DESTRUCTIVELY'.....in continuation with that;i would like to inform that now my granny and aunt are ready to go for a partition.And there lies my question. The property of 10 kottah of land has to be divided among 6 holders. We want to do the partition mutually,as in, without moving the court. At the same time,we want this to be concrete and valid. Hence please tell me what are the procedures we must go through? How should we have the partition done? Please help asap.

Regarding divorce

Dear experts I have been married on 16.02.2009 and registered before marriage officer on 8.06.2009.I got to know she divorced on 9.2.2009.And on 18.02.2009 , her 498a case against her previous husband was pronounced .After knowing all facts I requested to stay with me she denied and till date she never stayed with me not a single day.After all lastly I filed a divorce petition on 16.01.2013.She in her objection/written statement states as after marriage she was staying with me and falsely states due to nonfulfillment of dowry I kickout her.Before her objection statement she filed a petition for dowry torture & desertion in Mahila commission .After that she again filed maintainability petition on Jurisdiction. After all family court judge dissmissed her maintainability petition on the POINT OFJURISDICTION SSTATING BOTH LED THEIR CONJUGAL RIGHTS IN THAT JURISDICTION FROM MARRIAGE CERTIFICATES AND MAHILA COMMISSIONSORDER SHEET. AAfter that she filed RCR in another family court and Maintenance u/s 24 in that family court. Now I am not working. She in her maintenance petition filed that my gross income is 79000rs ang she needs 10000rs monthly .My objection on her maintenance petition is 28.07.2014. And RCR U/S 9 date is 6.08.2014.

Tenant eviction

Hello Sir,
I have a flat in Mira Road and have rent it out on leave and license agreement for 11 months. the tenent has not paid rent since past 3 months and the rent agreement period is over since past 10 days. We have given a hand written notice to vacate 1 month back, but tenant is daily delaying saying that they need more time and they are not getting a proper place.
What do i do to vacate them immediately.
In the agreement, there is clause that we can terminate contract for for non payment of rent.

Service tax exemption for a sez unit

Dear Members,

Here I would like to share one of my doubt regarding exemption and input credit of services tax for a manufacturing company which is in SEZ and at its Real Estate business in DTA zone where it is engaged in providing lease rental services.

Lease rental services

The Company providing lease rental services to tenants and charging services tax @12.36% on rent of immovable property, furniture and maintenance services there it is taking input credit adjustment of services relating to lease rental services i.e, repair and maintenance services of building, security services and upkeep services.

Input Services for manufacturing in SEZ

All taxes are fully exempt that are brought in SEZ area even we have to pay service tax on input services after obtaining certificate of exemption from development commissioner of SEZ as the final exemption can be issued by dept. of excise and customs but the authority have denied to issue us Form A 2 (Exemption Certificate of Service Tax) as they have verbally said that we cannot get the exemption at their end because we are already taking input service benefit relating to real estate lease rental and charging service tax.

So, please suggest me whether we should claim refund of input services that we are paying or we should go through another option with reference……
