Urgent: regarding mother's ancestral property law

Respected Lawyers,

My maternal grandfather and grandmother have passed away long time back and my grandfather's property was not divided to any childrens which is a ancestral property. My mother had 2 brothers and both have passed away 10 yrs back. My mother's elder brother was married and have no kids and younger brother was not married. The entire property is now in elder brothers widow name aged around 60 yrs and has been enjoying this till date.

It has come to our notice recently that she is planning to sell the property and also have taken loans against this property and has kept my mother in dark.

My mother, aged 55 yrs has 2 sons(myself and my brother). My Mother is unhappy with what his brother's widow is doing and want this assets to legally pass to grandchildrens thru her. We want to know how much of rights we have and how much share in the property she can claim as we are the only 2 grandchildrens in this family.

Please address this issue as a matter of urgency as this is passing out of out hands and want to retain this by applying to court.

Thanks,
Vikram

Married daughters' just right in father's property

Dear Sir,

I am from Andhra Pradesh. The query is regarding my mother and her sisters rightful share in the property. My mom has 2 sisters and a brother. My grand dad(doctor)from his own earnings constructed a Hospital( 1960s), a house(1972) and purchased a piece of land. My grand father wants to give an equal split to all 4. My uncle is not fine with this and he feels the property should pass on only to sons. He doesn't event look after well being of my grand dad. Please let me know if the daughters have equal right in their father's property. If yes, then please also let me know the act or amendment which enforces this. If no then, also mention the reasons. As of now will or registration has been done.

Forfeiture of booking amount of flat by developer

Dear Friends,

Is it legal for a Developer to forfeit the Booking Amount taken by the Developer in the event of the intending Buyer fails to honor future payments?

In our case, we as developers had taken Rs.500000/- as booking amount. The buyer subsequently on account of his personal health problems could not make future payments on the demand made by the developer.

Our Booking Form provided for the forfeiture of the entire booking amount. However, we forfeited only Rs. 300000/- and returned Rs. 200000/- on humanitarian grounds.

Now the buyer has send Notice through his Advocate seeking refund of the forfeited amount.

Kindly advise.

Regards,

Sachin

False accusations in counter affidavit

Hi,

To my annulment case, as counter, my wife laid following false accusations.

(1) That I took vulgar pictures of her and posted it on internet

(2) That my father took her signatures on passport form and applied for her passport with false documents.

Obviously (2) is false since to apply passport, one has to present personally to the Passport office. Moreover police verification would be done etc.
(1) is also false.

My Qs are:
(1) Can me and my father file defamation case based on these accusations?
(2) Can my father complain to passport office regd her passport (obtained by herself using wrong documents)?
(3) Is there any time limit to do the above?
(4) What other action can be taken in this regard?

Thanks

Ascess to Abusive, Violent Mother

Learned Experts,
Wife was caught in hotel with paramour & hotel manager gave statement that both stayed together 3 nights, so I filed divorce case on basis of adultery. Now after not meeting children for 9 months she has moved assess application. All 3 children are doing very well in father & grandmother's custody ( boys aged 10, 7 & 4 yrs) Her violent & abusive conduct towards children can easily be verifide from the court record which children can also identify.Children are totally against to meet her which they have told the judge. Earlier court had also restrained her to meet children in school as she had misbehaved in classroom. Plz advice if still court can order monthly 2 hr assess within court room to this characterless mother who is a threat to her own children as the honorable judge is known to be little biased towards women. Plz advice what can be done to convince judge to disallow assess application as we have many more proofs on record for her negligent & harmful behaviour with children.
Best regards
