Society issue

Dear Sir,

Ousr Society was Governed by some Members who Committed a Fraud - Didnot Clear Property Tax etc.

They Sold thier Flats and Moved Out.

The same was Brought to the Notice of the Administrator.

The Administrator istead of filing any Complaints against the Previous Chairman, Secretary, etc - is asking us to pay an Amount of Rs.70000/- Over and Above the Normal Maintainence Charges.

The Same has been Done with the Approval of 39 Members of the 42 Flats in the Building.

Only 3 Members are Refusing to Pay.

Can the Society Force Us to Pay.

Are the Charges Legal.

Inhering property

My father expired in april 2014.I have an elder sister(married) and Mother. Father had done a will in 2012. According to the will the property(house and car) will be inherited by my Mother during her life time and then shall be solely owned by son(me). The will was done on stamp paper with consultation with a lawyer and attested by 2 witness.
Since the beginning of my sisters marriage(2010), there has been a rift between my parents and my sisters family, i.e reason for the will to be done immediately after her marriage to ensure that all the hard earned property stays within the family.
Is it necessary for us to execute the will As soon as possible?, Is there any legal way for my sister to insist on share in property despite the will?

Disturbed married life

I am brother to a bride whose four years of marriage has been marred with unhealthy relationship of ill-treatment and isolation from family members.
Father passed away in april 2014.Sister is staying with us for now along with my mother. For reasons not known sister has soft corner for her husband, She wants to go back to her husbands,Husband says he is not economically strong to take care of my sister, he has asked for financial help from parents several times but dad and mom decided not to help him as he is not a good person and married my sister only for money, At the time of marriage BIL was working in NAL and has subsequently quit the job and decided to stay jobless till we give him dowry. we don't mind taking care of sister for the rest of her life, but want to ensure he doesn't disturb my sister again.

My question is can we file a case against him for not taking care of wife and abandoning her?, My sister says she will not support us if we take a legal route as she still thinks that her husband will turn out to be a good person eventually.

kindly suggest.

498a & 406

Sir,
In 498A & 406 Case filed by my ex-wife, 8 PW have been examined out of 8 PW 4 PW supported the prosecution & other 4 PW didnot , on 27-06-2014 one of PW was examined who happened to be witness of my divorce, while he deposed his statement in court he didnot supported Prosecution as he has said same in his 161 also, but Presiding Officer ( Judge) attitude was total different he started cross examining the PW on his own & than asked the Prosecuting officer not to call the rest of PW as they are all my neighbors.
And later issued direction to the father of complainant to get his counsel on next date of hearing even though the case is state V me.
I sense the Judge has inclination towards the Complainant.
His approach has been some what similiar to other PW also who didnot support the Prosecution.
Please advise what should i do now.
& what credibility the Judge will keep to the statement of PW who donot supported Prosecution.

Can live in wife sue under 498a etc.?

My elder brother was divorced in 2010. At that time, nobody was ready to give their daughter to him in our caste. My mother somehow found a girl who was married, she didn't like the village home where she was married, so she ran away from there on day 1, till date she is not legally separated from that groom. But the girl is HYPER ADAMANT, lazy and disrespectful. We thought that she is just childish, and will improve with time. She lived with my brother for around 5 months, but didn't make any physical/emotional relations with him!

My brother didn't marry her, no customs were followed. The girl's mother was in a hurry to get rid of her, I and my mother went there and brought her here as a bahu! In the evening, the couple did exchange maala in a temple, but that a casual gesture, not a common custom. There are no photos or videos to prove that she was residing in our home.

Now we have decided to get rid of that psycho, so her mother came and took her daughter back peacefully. Please don't bash me for being judgmental etc, she didn't even care for her own health, hygiene, food, work etc. And she started arguing disrespectfully with my mother since day 1! There is not a single quality in her to make her a normal bahu, forget decent one.

Although i don't think she has got any reason to do so, still i would like to know in advance that is there anything in law to support her case in a court, in case they do that?
Will the court look at it as a LIVE IN? How will they prove it? if 10 people say under oath that they have seen her as a daughter in law in our house, is it valid in court?
