Hello Learned Members,
Here is a brief background of the case, wife deserted the husband in December 2012. After repeated calling, societal panchayath wife didn't returned home.
Case of HMA 9 was filled in August resulting in Mediation, in mediation she told she need divorce and we filled 13 B in January and case is up for hearing next week.
In the meantime my lawyer told me not to withdraw the RCR petition as he knew the girl is mentally not stable for any decisions. So I am attending all the dates and have requested the Judge to give the shorter dates Probably by July 21-22 ish to update him on the status.
Now My questions:
1.If wife turns up and says that she wants to withdraw the 13B petition is this amounts to mental cruelty as she was the one who told who wanted divorce and she is the one who might withdraw the petition. She is not attending the RCR case also.
2. Is it good to continue the RCR case or withdraw and file contested divorce. Which is the best option?

one of my friend was law graduate but he working as assistant professor in private self financing institute.they give him appointment letter in that they mention their appointment is temporary & adhoc so can he enroll for advocate.

Dear Sir,
Myself is working in a public limited company since March 2008.
Salary is unpaid since January 2014 to till date. Company states that, due to unavailability of FUNDS we are not able to disburse salary.
Request you to guide me regarding what legal actions/procedures can be taken for our unpaid salary.

how can we take disciplinary action against a retired government servant who included in a crime while he was in service. all his retirement benefits are allowed. now he get pension. Rule 59(b) KSR part III can not apply to him. A case against him is pending under CBI. Pls advice me

My mothers elder brother was living in our home & died 2 years ago.He has no children. his wife was also died 4 years back. In the family my mother a younger brother are alive. The ancestral property was divided between two brothers only during 1970. No share was given to my mother. The younger brother has already sold his property. Now the property of my mothers elder brother is only remaining. The younger brother also no children. He is adopting a 14 year old boy.
1. My question is that my mother has got
any right to claim his elder brothers
property as she looked after his elder
brother.
2. If her younger brother adopts a male
child the all the property of her elder
brother goes to him only.
3. If she gets share in property how much
extent she will get

Dear Sir,
I wish to clarify a doubt regarding the donations received from abroad without the registration/approval under FCRA .
i.e. M/s. AF Trust has received the donation from Singapore through bank .Actually the trust has not get the 80G Exemption as well as FCRA registration.
Is it legally allowable?
If yes whether it will be taxable ?

With due regards,
I am to seek your valuable opinion with respect to the Importance of "Through Proper Channel" procedure generally followed in the office of Govt. of India.
I am a central government employee working in a subordinate office under Min./Commerce & Industry and wish to apply for an Inter-departmental transfer in the same post, in the other department under Min/Finance. I had in my parent office applied to issue an "ALL Ministries Circular(Or NO OBJECTION CERTIFICATE)" and was issued with the same (NO OBJECTION CERTIFICATE for Inter-Ministerial Transfer) and on the basis of the same NOC I directly applied in the desired department and overlooked (unwittingly and out of sheer ignorance or lack of knowledge of office procedures)to follow the process of applying "Through Proper Channel". Now when I received the letter of action being initiated at the (desired)concerned department,and my bringing the same to the notice of the parent department, I am being harassed on the plea that as I chose not to apply Through Proper Channel your case irrespective of the fact if any positive action from the desired department is taken we shall not relieve you to proceed further to join the new department. Please enlighten me at the earliest possible, also as to what should I do or what should be my next course of action. Thanks.
