I am staying at Matunga road mumbai. I am staying in pagadi system flat. My grand father has taken this flat around 1950. Since the death of my grandfather the landlord started giving (Since 1974)rent receipts in the name of my father. My father got expired in 1993 (Still rent receipt is in favor of my father)left me and my 2 elder sisters (Married before 1994). now my building is under redevelopment. and developer is asking from N.O.C. from my sisters. Is it necessary to get N.O.C. from my sisters?

1. i am a Indian wife and have a 7 years old son and currently employed.
2. I had got married in 2006 and ever since faced physical and mental harassment from my husband and inlaws for more dowry and my father's property.
3. I had lodged a 498A case on the above grounds and after fighting the case for 6 years finally my husband has been convicted under 498a case and the I Additional Chief Metropolitan Magistrate at Visakhapatnam in CC 1180/2009 convicted him giving a sentence of one year imprisonment and to pay a fine of Rs. 2000/- vide judgement dated 27-03-2014.
4. My husband has now filed a Criminal Appeal 42/2014 is filed before the I Additional Metropolitan Sessions Judge at Visakhapatnam against judgement of the lower court. The sentence is pending disposal of the criminal appeal.
5. I'd like to bring to your notice that he had deserted me 6 years back when my son was just days old and since then i have lived separately from him.
6. My question is - can i now apply for divorce while his appeal to the conviction for the 489a case is pending in the court. Can i continue to fight the 498A case after getting my divorce.
7. i wish to take the divorce on the grounds of cruelty that has already been established in the 498a conviction and the fact that we have been living separately for more that 6 years now and the marriage has broken beyond repair. I also wish to continue to fight the 498A case till he is put behind bars for the injustice he has done to me.
Kindly Advise.

There are many plots in the Thane, Dombivali, Ambernath area that are owned by collector. Owners staying in these plots have entered into development agreement with developers. Developers have started constructing the flats however, collectors approval has not yet received. Is there any risk for buyer to buy flat in these building? Can builder get completion certificate without collector approval? Is there any risk of not getting possession on time? Do buyer need to pay any penalty/ tax after taking possession to regularize the construction/ flat? Kindly advise. Thanks- MWR dombivali

A father died intestate in the year 2013 leaving his widow, three sons and one married daughter.
During his lifetime, he purchased an agricultural land from his own sources in Dehradun UP (now part of Uttaranchal)
After the amendment of HSA in 2005 and effective 09.09.2005 daughters(married or unmarried) are to be treated at par with son and also have coparcenary rights in Father's property. There has been judgements in Delhi High Court and Supreme Court where it is specifically mentioned that after 09.09.2005 the HSA prevails over the State Land Reforms Act after deletion of Section 23 of the act.
Refer : THE HIGH COURT OF DELHI AT NEW DELHI. % Judgment delivered on: 04.06.2010 + WP (C) 6435/2007. NIRMALA & OTHERS
Refer : GANDURI KOTESHWARAMMA & ANR. Vs. CHAKIRI YANADI & ANR. R.M. LODHA, JAGDISH SINGH KHEHAR 12/10/2011
In view of the above, please guide if Married Daughter are entitled for share in
agricultural property in Uttranchal father dying intestate

Getting stay order for redevelopment
Our building is getting redeveloped under DCR 33(7). There is dispute going on between me and the owner. for which i have written many letters to MHADA, developer and Owner of the premises. i haven't got any reply neither from MHADA nor from developer nor from owner of the premises. MHADA has issued N.O.C. for redevelopment. and developer has got I.O.D. from M.C.G.M.
I want to get stay order for the same. How I can get it on my own. I dont want to go with any lawyer at this moment due to financial issues. How i can obtain stay order for same? Pls revert as soon as possible....
