i need a query,
one of my friend is in great trouble, his father have 2 brothers and they are having a joint family property which is in the name of their mother and suddenly he came to know that one of his uncle (fathers brother) with his sons have forged that sale deed and mortgaged that property.
grand mother expired long back and now when his father came to know about such mortgage he was searching the original deed but he found the xerox of original deed and he lost the original deed.
and when he compared both the deeds he found that original document has been forged and now his father wants to safe his share as a matter is being file for recovery of money .
one more query sir can my friends father with the help of xerox of original document prove that the document through which mortgage has been done is a forged document,
if yes. suggest me how.

Sir my husband file divorce case on the ground of cruelty..i file dv case in this case 2500 has been decided as my monthly maintence..iam living in matrimonial house in one room.. nd my mother in law living in separate room in same house bt my husband living some other area in rent..
It has been two nd half year my husband has given me only 7500 ..my parent give me money from which i earn my livehood..on the other hand my mother in law enjoy life she goes to kitty party wear branded suit eat gud food..now my question is that if i take some necessary item like vegetable rice soap deterngent sari of motherinlaw from which i made suit for myself some item which required by me from their room in presence of my mother in law..
IS THIS IS CRIME..OR IT WILL GO AGAINST ME?????
My husband is nt giving me anything..i know he has to give me the maintence one day..bt i dnt know when dis day cum..tabtak mai kya karu..PlS HELP ME..mere parent itna earn nahi karte ki wo mere karch utha sake..other side my husband nd my motherinlaw living luxious life...

In my 498A & 406 case filed by my ex-wife had two IO both examined.
IO 1 who initially handled the case, said that the complainant submitted the list articles/ ornaments after almost 1 month of FIR & didnot submitted the vouchers even though she was asked to submit.Neither she was available to accompany at the house accused to identify her belongs .
So, what is crediblity of such RPC 406 case
IO 2 the accused made complain to IGP against me & said "I have divorced the lady 1 year back so 498A doenot hold for me"
Then I examined the witness of divorce deed & recorded their statement also.
When my counsel asked than why You filed 498A , the IO 2 replied sending Talaq to a lady is also cruelty & belongs of the lady are still with accused.
IO 2 also said the lady was asked to give the vouchers of her articles/ ornaments for which she has given the list, but she didnot gave the vouchers.
So, what is credibility of IO 2 Statement & what Impact it will have on 498A & 406

Hi,
We are situated at Mumbai. In our society we bought a flat in the year 2003. We paid transfer Fee and completed required documentation.However Secretary did not transfer the flat for his personal grudge.He denied all membership rights and issued bills in the name of previous owner up to year 2011.WE stopped payment of maintenance in protest of his injustice.
We did court case in the year Sep 2009 under Consumer Act. WE won the case in the year 2011. court ordered Managing Committee to transfer the flat and penalized them with Rs.1000.
1. Managing Committee did not follow courts order and we have not received penalty of Rs.1000 till date.
2.They forced us to pay interest on dues from the year 2003 up to 2011.
3. they gave payment acknowledgment in the year 2011 with the name of previous owner.
4. In spit of doing request for bill details and explanation for amount of dues they charged interest @18% up to 2011 . Till date Secretary has not given any details.
I have following query:
a)Is Violation of courts order punishable offence? if yes under which Act?
c)Secretaries decision of denying membership rights and recognition as a member and then imposing penalty on dues is a lawful decision? if not under which act we can seek justice and with whom?
d) Is their any fast track court or any authority who can help us?

can you file a complaint through facilitation council of msmed, for payment that has not been recieved for services rendered bfre geting registered with msmed act 2006.

Hi Experts,
My ancestral house is partitioned in between my father and uncles. Construction isn’t change. I am only son in my family however I have cousins. Partition is registered and also mutation is completed. Now if I go for mortgage loan , will it considered by bank?

suit property’s boundary measurements are wrongly stated in the Release deed dated 30.11.2011 and sale deed dated infavour of A dated 13.12.1958.Originally boundaries of the property is as follows;
East-west bothside 49 feet and north-south bothside 22 feet ,
but same was mistakenly states that
East –west both side 22 feet and north-south both side 49 feet. `
My doubt is following prayer is maintainable or not? civil court is have power to pass decree in following prayer? it any alternate?
