Regarding upvat case query

Sir,
I am a advocate practising with Agra and today I am facing trouble about my client case that:
My client is having business to supply building material (cement, brick, saint etc.) to various govt. departments and they provide him various yogna and rate, qty to which he will supply to them.
In the particular F.Y. my client supply the above mentioned material to them and they deducted TDS & Trade Tax i.e. 2.25% & 4% on total value of supplied material. Because all rates and quantity provide by the dealer he has billed to them with inc. vat, freight etc rate but now the problem is at the time of case present to the concerned off he was not agree that all goods which supplied to them are inc. vat and he raised a demand notice to stated that the assessee has not charge any vat on all supply and he have calculated all tax on total supply. Here, I am giving you some example which can easily understand by you:
MR. X supply one bag cement @ Rs. 325 (inc. vat) to Mr. Y in this case vat liability comes to Rs. 44 (approx) @ 15.50% vat rate.
But officer comes to note to charge tax on full amt of Rs 325 i.e. Rs.50
So this is my query that at what position what amount of vat is considerable.waiting for your reply.

Original doc misplaced .

• Register with Notary:
OUR property original documents are misplaced . can we make the preparation of undertaking on stamp paper about the loss of documents of particular property along with the text of advertisement which was published in newspaper and police complaint number. Documents will be then attested and registered with the notary, so that our undertaking becomes legal.

is it worth in maharashtra .

what will be stamp duty will be require to pay on it and registration of charges ?

shall i do this procedure ?

Builder's responsibility

I would like to know what is the diffrence between occupation certificate and building completion certificate for building in Mumbai Muni. Corpo. limit.Our society is going for redevelopment. Should we insist in the agrement with the builder to get the BCC or OC is enough?

How to apply for passport

Hi,

My wife wants to make a passport for her mother. Her mother does not have a school leaving nor she has a date of birth certificate. She was born in a village so she does not remember anything about documents and she is now 50 years. She misplaced the Nikah Nama (marriage certificate)as well.

Please let us know how can we go about making the passport. Please give us some tips for hassle free process.

property owner expired

Respected sirs
A property situated in Bangalore. Mr.A gifted this property to his son mr.B thro registered gift deed. B later after expiry of mr.A gave the gift deed documents as colateral security to bank on behalf of Mr.C. Mr. C has defaulted the loan. During all this Mr. B died without any will. Loan was taken eight years ago. Mr. B expired three years ago. Surety of documents were physical not registered as loan. Encumbrance reflects no entry of loan from bank.
Now the bank people are persuading the family to vacate or pay the loan amount. Mr. C is hopeless and pauper now. What rights do the LR' s have with regard to right in this property and any solution on this from this platform will be grateful.

Essential services maintenance act

is a contract is valid if the same was signed under threat of essntial services maintenance act?
is Section 14, 15 and 16 of the Indian contract act will apply in such case?
may any person compel to perform any work in pursuance of essential services maintenance act, which is not possible (in terms of authorities own reports)?
in the above conditions, compulsion of signing an agreement and further compelling to perform the work is not in violation of Article 14, 16 and 19,(1g) of constitution of India.
i realy need advice on such point as soon as earliest along with case laws.
i will be greatful for expert advice.

Property mutation

Dear sir,
My father make shops on a property in 2004 and they were 6 brother sister including him .All other brother sister surrender their rights in favor of my father and one brother and they mention in mutation they don't need anything from this property.According to that mutation there were one big shop which will be given to father brother and rest 4 shops were given to my father with no objection from all brother and sisters .Now for some reason mutation was not registered .My father elder brother son take keys of said shops by cheating and get hold of it now my father died last year and we put case in lower case .Paper on which property is in favor of my father and uncle that paper was purchased by the person father who took keys from us .Now what's the chance that my two aunties can ask for the share.What can be done Please help.=)
