Delay in getting notice in rcr case from court

Dear Experts,
I submitted all details and a sum of money to an advocate for filing restitution of conjugal rights case in Poonthamalle court of Tiruvallur dist. near Chennai. Even after four months there is no notice from court. When asked he is not responding properly, not giving the case number, he says it is getting delayed because the court is busy.
When I inquired, people say it will be 10 to 15 days after the case get numbered.
Which one is true? Is it really takes more than four months for the court to send notice?

How to seeze property when only one partner alone enjoing rights of joint property

we have certain properties at khammam obtained from my grand father after his dismissal.my father also passed away recently. we are left with my mother my elder sister and younger brother. as per todays women equal property rights all of us have equal share on all properties and on their income.but my brother alone enjoing all benifits like rents etc.he is claiming the whole property belongs to only grandson not to grand daughters.hence no share on income or any property. how to stop him .how can i seize this property and other income until i win a case againest him in court.please guide me.

Property case

Sir I am female 42 yrs old. Staying in chennai. We have a home. Thats my father proprty its come around slum borad clearence. My father expierd on 1995. Now my mother(70) yrs my brother (52) yrs and me. We are the legalheir. Both we alive. We dont have sale deal for the proprty. I am also doing business in the home I took one potion. And my mom doing (business) and staying the sane house. My father also staying in the samr home. But I have a own house I am staying with my family in my home. In my father home I am just doing the business for last 10 yrs.


My question is
1.I asked 50% share in my father property
2. For that we sent ( my mom and my self)
Lawyer notice to my brother. In that we mentioned. 50% share is mine I took that. You have accept this. (Like that I send)
3. But my brother is not accept

4.in this situtation.wat I want to do
5.if I file case against my father property.how many years it will take to finish.( my mom is full support for me.she is against for my brother.)
6. Pls guide.

Taxation of nri income

Sir,
My friend is residing at Dubai since 5 years. His status is NRI as per Income-tax Act. He has salary income of Rs. 30,00,000/- yearly there. He is regularly filing his Income-tax return regularly in India showing his interest etc. earned in India.
1) Whether his income is taxable in India? If taxable, than under which section. If exempted under which section of Income-tax.
2) Rate if Income-tax if any and the rebate allowable to him as NRI.

Whether to wait for filing counter claim reply to writ petition

Dear Sirs,

This is repetition of my unanswered query.

As suggested by all of you to multiply my cost but as told I am not in a very sound financial position that is why I requested court thru my application us 17B for subsistence allowance to survive as well for equitable legal proceedings.

On this Hon'ble HIgh Court in its last order noted that WP of management and my 17B application will be taken on next date and no instruction was given in this order to file my reply as well till date any stay is given on order of the lower court.

Is it neccessary at this junction to file my counter claim before next date of hearing in reply to their petition before disposal of my 17B application since I came to know that interim relief applications under article 226 or under 17B applications are disposed expeditiously without going into merits of writs of parties as per principles defined by High Court himself in its popular judgment in case law 'Food Craft Instt. vs Rameshwar Sharma And Anr. on 28 April, 2006'.

Can i ask for some proof to merit the case in rejoinder appeal

Plaintiff filed a suit in the High Court for Specific Performance stating that the suit premisis was sol;d to him by the seller before he sold it to me.

He had an unnotorised, unregistered Agerrment with all payments made in Cash only.

He had a motion to get a stay on the suit premisis which was granted.

The case was then transfered to the City Civil Court where he did not attend any hearing. hte case was dismissed for want of Procecution.

He has now filed a Motion for Rejoinder stating he was unwell.

Can I ask the court to check the merits of the case before allowing the rejoinder as he is a habitual Fraudster and is wasting the courts time.

I want the court to ask him to produce his bank statment and income tax returns before allowing him the rejoinder.

I have a query about TDS Not deducted FY (13-14) by a educational Institution for the FY they want to proper procedure of TDS

Is it possible what is the requirement , how much penalties will be charged.

Duties and liabilities of enquiry officer in departmental enquiry

The Enquiry Officer violates the principles of Natural Justice and does not give reasonable opportunity to the Chargesheeted Officer to defend himself in the departmental Enquiry. He openly gives out threat and records such threat in the proceedings. The Enquiry Report was biased and has culminated in punishment. On appeal, the Chargesheeted Officer was absolved of all the charges.
In such circumstances, can the Chargesheeted Officer initiate proceedings against the Enquiry Officer ? And what are the liabilities of the Enquiry Officer - under civil laws and criminal laws ?
