can i run my office in my home as i provide taxation services and i need not to open office in commercial areas. if yes then is there any law under which municipality/building laws & electricity board laws allow to run this profession from home. i means i want to know about house tax law & electricity consumption charges applicable on this. kindly provide solution.

I own a three bedroom DDA flat. I propose to bequeath it to my wife and two sons in ratio of 40/30/30%. Is it possible legally for the purpose of registration?

Dear Sir,
My father is a respondent in a PIL bearing no: 234/2013 on the records of Honourable APHC & the Case was disposed off. In order to get the Case Honoured in the APHC he submitted a false statement stating that he does not have any relationship with the respondent i.e my father. Whereas the petitioner of the PIL is none other than Son -In-law to my father and he is brother in law to me.
Further the matter in the Case is pertaining to my father practicing as Rural Medical Practitioner who is an Ex-service man worked in Indian Navy with Medical Branch . As such there are so many practitioners practicing without any qualification and without any registration with concerned authority‘s registration. We have no grievance for the orders pronounced while disposing the case. The point is that he misleads the Court by stating false statement in the affidavit that there is no relation with the respondent which is false. So I would like to bring this fact before the Court and initiate appropriate measures against him in the interest of justice.
In my opinion, furnishing false information to Honourable APHC, to get the case Honoured as PIL is a Criminal intention. Therefore request your good self to reply my query. & eagerly looking forward for your valuable legal support& advice.

Hello, the incident took place in december 2011 ,my neighbour boy and their family complaint a false fir against me for petty quarel ,when I reach police station they arrest me for 2 hours ,they din't write a complaint from my side after paying some fine they leave me.
I don't know what sec of law they frame against me,
I was out of town after few day my family receive summon fro sdm court ,order to pay bond for keeping peace I am not sure about sec but it was for parishanti bhang huyi hain,
One of my relative paid a bond of 500 rs. Bond for keep peace he advised to be away from complainant for six months the case will be dismissed.
One of my neighbour told me that complainat has also paid a bond for peace.
As I was out of town ,and I know I am innocent why there is no trial? No question from sdm court , they just send summon and order me to pay bond without knowing who is guilty or it could be a fake case.
after paying bond nothing happen between me and my neighbour the six month expired ,and then the police station send me notice that for parishanti bhang ki ja sakti hain ,and pay the bond I told him there is nothing I have done wrong why do I pay for something I have not done.he said ok and move from my house.

Last year, the constable of police station said you have a crpc 107/116 against you 2011 case. he also said its not come under criminal category but its a kind of record but you don't need to worry its expire now not active never open against you.he said I will attach this in your passport application it non criminal but a kind of record.
First I want to know what is crpc 107/116?
Is it mean conviction if you pay a interim peace bond with complainant ?
No one broke peace bond the six month period expired does it still means conviction or any procceding pending against me as no fight happen in this 2 year.
I can understand as the bond expired the case should be disposed , but the police try to open it after six month sending me notice but I stand for my point and police dint come again from last 2 years.why they send notice for parishanti bhang chances as nothing happen what was that?
I don't.think so police take any action against me after six months because they got no reason to do it so,but I want to know paying peace bond in indian leagel sysytem is admitting guilt or conviction?
The peace bond expires no one broke any peace ,what does that mean' any case of crpc 107/116 pending against me.or its.disposed?
What kind of problem this could create in my passport, visa and govt.job?
how to take this case as no trail happen?

Dear sir,
I am married for last 11 years with a girl from very poor family without any dowry. After marriage, I have come to know that she is very dubious nature and very jealous. There is no limit of her doubt. She even doubts me with my mother. It was started in the year 2004 and still continuing. After, she doubted me with my mother, I felt very disappointed and decided to file divorce petition. My mother is very sensitive and she has realized the matter. Due to this nature, my mother and father hate my wife tremendously. Their relationship becomes bitter and persisting till date. We have a daughter of 9 years old and my thinking for divorce cannot be materialized for my daughter. But matter is going worsen day by day. Now she started doubting with every female person whom I have very cordial relation alongwith her family and all of us are migrant from West Bengal. All of their family members love me because of my disability. I have separated from my parents and started leaving first floor of my house but I always take care of my parents as it is my duty not to isolate then. My wife is jealous why I take care of my parents. She uses to threaten me to spoil my social status by making complaint under Domestic Violence Act 2005 and will convict me and my parents. Even she demands huge amount as alimony like Rs. 20 lacs for seeking divorce. I have a small house with market value of Rs.20 lacs and a TATA Indigo car and against which I have lone worth Rs.10 lacs.
I was staying with a family and have very loving relationship with brother, sister-in-law (Bhabhi) and their little daughter. We had no blood relation but have very cordial relationship. She was my sister-in-law who matched my wife with me to help a very poor family. But that help turned a big blow for all of us when my wife doubts my relationship with Bhabhi immediately after our marriage.
I am B.Com from Calcutta University and have been leaving in Ludhiana for about 20 years and took extreme pain to be established my due to physical disability. I have an elder sister who is happily married and stay with her husband in Kolkata. I am physically disabled person with right hand amputation through wrist and have very limited income of Rs.30K per month and my EMI stands at Rs.13.5K against aforesaid loan. My father is running a little karyana shop at my home to run the maintenance of himself and my mother. My wife is not looking after my parents and she also does not take care of daughter who is studying in class V. I am now again studying MBA to enhance my career.
Her family is not having any social status as they are three sisters and one brother. Her mother left her father after having an illicit relationship with an outsider. Her father saw her mother in a compromising position with her paramour in the year 2003 at home and till that date she is staying with her paramour illegally. My wife is younger of all sisters and she is educated upto 7th standard. Her middle sister also had an extra-marital affair with another person after 17 years of her love marriage and became pregnant caused by her paramour. After knowing the fact, her husband expelled her from home and now she is staying with her paramour without having divorce from her husband. Her father is rickshaw-puller and her brother is a daily labour. Only her elder sister is good in nature. Now her characterless mother and sister are insisting my wife to file false complaint against me and my family under Domestic Violence Act 2005. Her sister is also insisting her to demand alimony of huge amount of Rs. 20 lacs and more else me to face conviction. I stopped talking with her after the incident when she suspected the beautiful mother-son relationship. Now, we have no physical relationship as she sleeps separately and even she laughs at my disability regularly. She quarrels with me and my parents almost every day and beats our daughter mercilessly for talking my parents. She regularly insists me to transfer my house property on her name and also asks me to bring her characterless mother with stay with her. She also asks m e to drive my parents out of my home. Even, our daughter does not love her mother and wants her mother to leave our home. Due to her such nature, I restrict myself from accompanying her at any event and any outings.
In such circumstances, I seek your professional advice as this may be a unique case of marital relationship which has never been concrete. Kindly note that I have not got registered my marriage as per law after realizing that she has dubious and jealous nature.

About a flat..
I am from Ahmedabad Gujarat
My father had died in 2008. He had purchased flat in 2005. Builder had given only on deed to him at that time. No share certi or else was on my fathers name.
We are two brother and one sister.
I leave abroad and I come here once a year.
I have a cousin, when my father was alive in 2005 we all decided to give this flat to my cousin.
All of us two brother and sister had given NOC to him on 100 Rupees stamp paper saying that my cousin he can put all his name in all type of property documents.
But with this papers the builder did not agreed to put flat in his name till now.
But in 2007 the flat was of 6lakhs and now this flat is 30lakhs above.
I have recollect all the document including that NOC documents
SO i gave 2 laks rupees to builder and put the flat in my name.
Share certificate and dastavage is done in my name now.
But few days ago when i came to india, i came to know that my cousin has put name in that flats light bill and have stick his name plate in front of that flat.
I do i get rid of him now.
I am also thinking to take morgage loan on that flat.
Please help me what to Sir PLEASE HELP

Our grand paa left agri land of 10 acres with 2 sons and 2 daughters. But unfortunately after his death as on 27.09.2011 we come to know 06 acres property has been transferred to one son and rest of property was transferred as per law among all legal heirs. Now rest of legal heirs file suit against this HIBA and civil proceeding are carry on. Now witnesses has Heared in court and arguments are left ..Please guide what are the chances of breaking of this HIBA.

I am a member of a "group" of 80 members.We collect a fix amount monthly and we distribute the profit from interest etc. as dividend among members after two years. We have opened an account in a bank in the name of "SNG welfare society" to deposit the money. It is not registered under the society registration act. Now the banks are insisting for a Deed. Sir, which type of deed are they asking for. I had gone through some of the formats of Deeds especially the trust deed. But it is between the settlor and the trustees. But in our case there is no settler. So what type of deed shall I make. Please advice me.

In the year 2007,The days when I am in college one if My classmate beat Me and I got a Depressed Fracture on My Forehead(SERIOUS INJURY).I gave a complaint in the Police Station and the case was booked [UNDER SEC.324] .
After a long period .i.e.; in the year 2012 (MARCH) I got a summons from the District court to attend the case and to give My witness. I gave My witness and there is no judgement on that day and I returned back to Home.
After 1 year, I came to know that the case is Closed and judgement is that the [IPC Sec.324] on which the accused is booked is changed to [IPC sec.322A] in this case and Culprit was Fined of only Rupees 1000/-.
Even though I Won the Case I am not Satisfied because,the expenditure for the treatment for the fracture which I got on My forehead is already Rs.20,000 and above.
For the operation to that fracture is expected to be atleast 60,000 Rupees which is not done till now.
But the Culprit was fined Only Rs. 1000/- .
So I asked few people whether it is possible to RE-OPEN the case after 2 years from the day of Judgement (MARCH 2012) as I already Won but not satisfied.
But I am not getting a proper Answer.

Obtaining FIR Copy
Dear Experts,
I have come to learn that around 5-6 years back, a cousin (Girl) of my wife had also filed 498A/406/34/DV/DP Act on the innocent person whom she got married with...Now, I have also become the victim to the same gang & they are following the same steps...
Can anyone guide on how to obtain the�copy of FIR lodged (during 2008-09)�by that cousin of my wife as I am have got that FIR no. & wants to produce the certified copy of the same in front of courts during my trial & wants to convey that this is a "498A family Gang".
Is there any way that the same may be procured through the RTI ?
