Making lower court presiding officer as party iby name.

In a civil suit the munsiff of the court did not admit my suit on the point of resjudicata at the initial stage and on this point hearing was done on several dates and even on conclusion of the argument on this point even after several dates the munsiff did not passed any order. Subsequently, an application was made stating that the argument on the point of resjudicate was concluded long back and thereafter around two years has passed so order to that effect may be passed. Even thereafter there was not order. The petitioner made a complaint before the CJM stating the fact and praying for necessary directions. Thereafter the munsiff passed the order admitting my suit. The CJM rejected my complaint stating that at this stage the complaint by the petitioner cannot be entertained since order has been passed in the suit.
I want to file a application before the High court for such willfull delay in passing orders by the munsiff court. I am not the only person who has faced such harassmet. It is also seen that when judgemnet are reserved, those are not delevered for long more than six months and thereafter when they are transferred they name an order for release of the case and in the case the petitioner has to bear the burnt.

My question is I want to approach the High court making the munsiff as party by name. Whether it will be advisable to make him as named party. If not why.

Acquisition of premises on lease

Respected Sir/ Madam,
I have received offer for premises on lease for the purpose of business. The offer premises is having three separate shops in the name of three different owners which are not related each other. These shops are separate by common wall. They would be giving their premises after dismantling the internal walls.

I would like to know whether I can technically consider it as suitable in view of the different ownership.

What will be the legal complications will ariseing in future? As far as
1) execution of lease deed with them jointly or indepenandantly?

2) about obtaining of three phase connections from each one of them.

3) payment of rent in proportionate with their share in the premises.

Please convey your valuable advice in detail about this matter.

Icici lombard property linked insurance policy --- not covered disease--reg

Dear Sir,

Very respectfully bring the following facts of the case for your valuable and breathing suggestion for over coming the hurdle.

Sir,

My uncle purchased the Residential flat at Visakhapatnam on 30.10.2007 from Dharani Constructions by way of home loan from ICICI Bank, visahpatnam for an amount of Rs.6.00Lakhs and same was registered in mu uncles name.

I further humbly bring to you that, at the time of sanction of house loan by the ICICI banker insisted us for taking property linked term insurance policy ( in case of death of insured the debt amount of Rs.6.00Lakhs waived) from ICICI Lombard for an amount of Rs.30,000/- for a period of 5 years, at the instructions of the bank we bought the policy which was ended on 31.10.2012.

unfortunately on 02.12.2012 my uncle demised with leaver disease leaving behind my aunty and four daughters. later we filed claim form which was sent by ICICI bank and same was submitted along medical bills.

after prolonged time the Insurer returned the our claim with a letter that your disease not covered under policy, whereas the claim for consists of liver disease.

immediately we sent a letter to insurer about his indiscriminate action, but no replay and no action, finally we lodged a complaint before district consumer redressal forum same was numbered and sent notices to insurer.

NOW THEY RAISED THAT YOUR POLICY EXPIRED and we are not responsible.

so kindly help us for how to over com this.

your most respectfully

sasikiran

Encroachment of approached road to constructed house

Dear All,

I have purchased a piece of land from 3rd party with proper road mentioned in the registered sale seed along with sketch map of the road registered. The same sketch map showing the road is also registered by the 1st party owner of the land who sold the big portion of the land to 2nd party. The 1st party also mentioned 15 feet road provided to 2nd party in the south side of the plot in the registered sale deed of A0.200 dec land. Subsequently the 1st party also sold another A0.100 dec of the land to the same 2nd party showing the continuity of the said approach road of 15 feet in the south and also registered the sketch map of the road. All the transactions made by the 1st party to 2nd party was done in 1996 to 1999. Subsequently the 2nd party has sold part of both the plots (A0.200 dec and A0.100 dec) to 3rd party, 4th party and 5th party during 2002 to 2007. The same road is also shown in the sketch map and mentioned in the registered sale deed. I have purchased a piece of land of A.033 dec from out of the first A.200 dec during 2011 and same road is also mentioned in my registered sale deed and sketch map is also registered. The party no. 4 and 5 have constructed house during 2003 and staying there and using the road. My house construction is complete. Now party no 1 has made a gift deed in the name of his son for the remaining part of the land he has along with the road provided earlier to the 2nd party and using the gift deed the son of party no. 1 has made a boundary wall on the approached road and blocked the approached road to our house (party no.4,5, and me.). We are help less. The party no.1 is demanding huge money for the road. Kindly advise us. With great regards,
