Maintainability of petition

Out of three beneficiaries of a private unregistered trust one beneficiary filed a petition in High Court under Indian Trust Act, 1988. Whether such petition is not maintainable on the ground that the Trust is not registered?
Please send single member or preferable full bench judgement.

Transfer of membership

Hi I have purchased a CGHS flat in Dwarka on loan. All my original docs are with bank. Now i wish to transfer the membership in my name however the Society is asking for INR 1 lakh for the same. I cannot afford to pay such huge amount. Following are my queries:

1. Is it legal?
2. How can I get the membership transfer in my name?
3. Is it mandatory to transfer the membership?
4. What could be the repercussions if membership not transferred in my name?

FIR lodged & IO calling me at PS

Dear Experts....Plz suggest.....Brief Facts - Marriage in Sep13.....No child even no consummation.....Wife cruel behavior from 1st day of marriage....I filed for divorce in March14...Wife filed CAW complaint in April14......CAW & court mediation failed as huge money asked by my wife & in laws (impossible for me to arrange) .....She Also filed FIR u/s 498,406 �and DV.....In DV petition & accompanying afidavit she claiming not working......Notice Bail already taken....IO called me today to appear in PS next week....

1. What to b expected during this meet & what stand I need to take at PS?
2. Can I ask IO to supply me copies of false marriage bills, jewllry bills as submiitted by my Fatherinlaw...as he doesnt even file ITR.
3. In DV, judge ordered me to file written reply. So shall I file DV reply & Perjury application together as i have her PF records.

Apartment office bearer creating problem

I live in a apartment as a owner. When i bought a flat i asked the builder if there is place for growing plants. He said yes. But while paving tiles he forgot. Then after few months when i came for living in the flat i insisted the builder to fulfill his words about allocating little place for plants. He sent persons to remove few tiles and dug the ground and provided a pipe from STP with the consent of then president of our association. I too started growing few plants like hibiscus, parijatham...small shrubs. Later one of the office bearer did not like my victory about fulfilling my wish unto the builder. He taking help from other bearers removed all plants which i raised for nearly one year overnight. this really hurt me a lot. Being a lady and having my husband abroad I could not stop this violence.

To show my opposition I denied to give corpus fund 25000.

To revenge me that office bearer troubles me in many ways. he takes away all postal letters. he keeps the terrace key under his custody. he does not inform me about meetings. he instructs the watchmen not to talk with me. he propagated i am the blunder of the apartment unto my neighbours. he threatens he will disconnect water and electricity. he threatens even i will face severe problems in future.

from my side i dont even know who he was when i came here, and i wonder why he has to create problems like this.

what shall i do to prevent him disturbing my peace like this?

Criminal case in civil case

One of the property related civil case is pending in karnataka high court. The case is running from past 25 years. Our opponent has forged the will document & get it registered in his name. Can we file the criminal case against him now after 25 years still the pendency of the case. If yes, please let me know in detail how I can file a criminal case against him. Please help me. My family is completely lost hope of getting back the property.

Trial proceedings

Sir, in a case under the PC Act, where Trial has been in progress for 3-4 years. At this stage prosecution has moved an application to take a voice sample of the complainant, who had turned hostile during his examination. The court had remarked that the sample should have been taken during investigation. Now complainant has given his consent to giving his voice sample. Can the trial court order recording sample voice at this stage ? Does the law permit this procedure. What would be its evidentiary value.I tried to read the best bakery case judgement, but nothing is clear yet.

Psu query


Dear Sir,
I am working in PSU organization and applied for another PSU through proper channel for which minimum seven years experience was asked in executive cadre in central/state/psu/private organization.
I have worked two years in Indian railways as section engineer and five and half years for PSU organization where still I am working. I was called for written exam and interview and finally I was selected. After that I was called for medical exam where I was found medically fit.
During final certificate verification I was told that my railway experience as section engineer will not be counted as it is not an executive post according to that PSU. They are considering only gazetted post in central govt. equivalent to executive post. In railways those officers who are appointed directly through UPSE (IES, IAS, and IRS) are gazette officer. Section engineer in Indian railways in non gazetted post where min. qualification required is degree in engineering same as that for entry level in PSU . In PSU even CMD is non gazetted officer.
My queries are;
1. Whether the post of Section engineer in Indian railways is equivalent to to executive post in PSU? . 2.How will we compare the equivalency (in designation or pay scale) between central govt. and PSU Employee?
2. In public sector even the CMD is non gazatted officer, so whether the eligibility criteria asked by PSU is correct? (only gazatted officer in central govt. is equivalent to executive post in PSU ) which means IES/IAS/IRS officers are equivalent to entry levels engineers in PSUs who r considered as Executive.
3. In PSU even a diploma holder is consider as executive after few year of experience. In some PSUs diploma holders are are directly given the post of executive at the time of joining only .
4. On basis of this can I claim for the post which I am denied .

Dv case

Hello sir,


I have file a DV case. When my chief was submitted i have simply submitted my statement alone havn't submitted any kind of evidence along with it. As if i am having all sort of evidence and my cross has been taken all over. So is there any chance for me to submit my evidence and whats is the procedure.

Indian divorce act 1869

Sir,
Can any hindu file divorce under Indian Divorce Act 1869 inspite of Hindu Marriage Act 1955 ?
If not please specify reasons.
