I would like to know weather court can pass a decree if both,have filed a mutual consent divorce and one petitinor is not ready to attend the court hearings nor he/she is responding to any of the communication media. if yes under which act ?

Hi respected sir/madam,
Please help me with my query,
My aunty aged about 65 years, Hindu, Widow, has two children, (1) daughter who was married about 30 years back and in husbands house with 2 sons and (2) deceased son who expired in 2008 leaving his wife and 2 minor children.
My aunt has inherited about 4 acres of land from her dead husband and some 4 acres from her father.
My aunt her son and daughter entered into a registered relinquishment deed cum single partition deed in the year 2005 and as per the deed, my aunt's daughter was alloted a share in her father's property and she relinquished her rights in any other property belonging to or to be owned by her mother or brother.(at this time my aunt had still not got her father's property thought her parents had expired)
Subsequently My aunt and her sister ( only children of thier parents) entered into a partition deed in 2007 in respect of the property they inherited from thier parents.
My aunt has executed a registered will in favour of the minor grand children.
Now my aunt's daughter is threathing that she will approach the court for re-partition and that she should get equal share in all the property. Can she ask for re partition?? does she have a right even on the property inherited by my aunt from her parternal side??
Should my aunt approach the court ??? she is old and her daughter in law is uneducated and they depend on this land for a living. Kindly suggest what should be done.

we are pvt ltd company .. our business place is being let out to us by our director's Sir's father for business use..the place is leased to Sir,s Father and their brother for business by MIDC, in which Sirs father and Fathers brothers are partners in a business . but sir,s uncle never concern about the business and legal dues .. later on sir's father given consent to use the premises for business to our sir i.e.his son.. Fathers brother was causing nuisance in the premises for possession . so a suit is filed in which our director's father and our director are joint plaintiffs against fathers brother, suit is for , not to disturb the possession of property and to declare that the premises is being use by our company . now Directors father is telling us to vacate the premises due to family issue .. since 10 years we are paying legal dues .. and even today the business in carry on there .. how daily director;s father comes and threaten to vacate the premises .. pl suggest what to do to protect our possession... can we file a police complaint .... plz suggest how we can secure our possession..

My brother is married in India(Indian spouse)in 1999 and now settled in USA(H1B visa), he is going through personal life crisis.
My Sister-in-law wants divorce, custody of both kids and property. She has been threatening of 498A case against my family if demand not met.
My brother needs a lawyer in India-Mumbai, who know law of both country (USA + India). To fight his case.
He has 2 kids(both USA citizen) and property in USA as well as in India-Mumbai.
Your help would be appreciated.

Dear Sir,
I have purchased a flat recently. Just before registration my law yer had corrected Dag no & Khatian No in the floor plan with pen and signed by me and seller. Now after registration I checked that in the floor plan of mother deed the direction was mentioned as "North- East" while in the text of mother deed it was althrough written as "North-West". In the floor plan attached in my new deed the direction is not mentioned by my lawyer. For this flat North-East-West all three are present although there are other blocks in East and west side. My lawyer is telling that there will be no issue if I want to sell my flat in future. My question is that as the direction of floor plan in chain deed is not matching with its deed and in my new deed the floor plan direction has not been mentioned--I am very much confused if it is serious mistake. Please suggest how to come out with this situation and what should be my next course of action.

can anyone tell me procedure of disowned by parents to his deceased so from his property. What is the court fee, and professional fee for such procedure. Can disowned by parents have legal effect.

Dear sirs, Recently Our society filed a case on developer under MOFA. After this, we recd letter from one of the partner of developer which states that he de-registered himself from partnership in 2010 & our complaint pertains to period after 2010 so he should not be held responsible for any grievances of members. He was partner from start of redevelopment 2007 to possession of members in redeveloped building in 2010. Our redevelopment agreement is silent on Defect Liability Period. Our query is, Is there any law which can help us in this matter?
