Marriage with a foreinger

Hi I am Indian and i want to get married to a foreigner ( from a Muslim Country) who had come to study to India. I understand that once we get married we have to get our marriage registered with the Registrar Of Marriages and then she has to give a Form 3 to renunciate her present citizenship.
I want to ask you what happens BETWEEN when she gives up her present citizenship ( that is when she POSTS the Form 3 to Ministry of external Affairs) and when she gets her Indian citizenship. What will be her status during that period of time.

I am sure i have missed out a lot of legal points as i am not a lawyer, please highlight them and oblige and help with a revert.

Regards
StalkVik

SUCCESSION CERTIFICATE

What are the procedure to get a sucession certificate ? From where can I get the said certificate ? And how much does it cost to get a SUCCESSION CERTIFICATE ?

Succession certificate

Hello Sir(S),
Please help me the query below -
My mother has an SB account and a locker with SBI. Both of them were not having nominations. Not sure as nomination should be made mandatory, but thats not the case in SBI (personal experience). Unfortunately, my mother expired 8 months back.
Now when we try for the SB account, bank is having the process ready and we can get the money etc in that (not taken yet). But at the same time, the locker is linked to the bank account and no-one from bank(including Branch Manager), the SBI customer care, the bank linked lawyer is able to give me the procedure or documents required to get the contents withdrawn from the locker.
Sometimes, I am advised to get succession certificate, sometimes they say letter of administration. Currently, the new lawyer whom we contacted, informed us that Letter of succession will do, but I am confused now after reading the query at -

http://www.lawyersclubindia.com/experts/Section-372-of-indian-succession-act--480756.asp#.VCwlGB0ybfs

So please advise me if succession certificate is enough to get the contents from the locker or if not, what is the procedure and what all documents are required so that I can get the contents of my account. Here, "I" refers to my father who is alive and is the applicant.

I cannot update the above link as I am not an expert. Hence opened a new thread. Please forgive me for that.

Suit withdrawn by petitioner can be refiled again

Hi

I want to ask the following query

1) An Eviction suit was filed by the Landlord against the Tenant in Pagdi System.

2) Now the Landlord has withdrawn the Case against the Tenant

Can the Landlord once again file the case against the same Tenant for Eviction on the same grounds which he had filed earlier

What is the minimum cooling period under which a Landlord can again file suit of the same nature on the same Landlord

Can a fir be lodged if the both parites are of a canadian nationality??

Hi I was told that a Police can't lodged an FIR if both the parties are of a Foreign Nationality. Me and my wife both are Canadian. She paid money to local Police and got an FIR registered under 498A and other IPC acts. Once I got the permanent bail she went to the same Police station and got another FIR registered.

I was also told that the local SHO has no legal right to registered an FIR in our case. The law is that if the both parties are not an Indian citizen then an officer who is of an ACP rank or higher has to take the complaint and then within two weeks he has to investigate the complain and if he finds good reason then he can file the FIR or direct an SHO to lodged an FIR.

In my case this was NOT DONE, an FIR was lodged in March of 2013 and I was notified in November of 2013 that this has happened and I have to surrender and apply for bail. I had to rush to Allahabad High Court and I got "stay" on my arrest and then I surrendered in the local court and first got temporary bail and after 3 months later I got permanent bail. Now the local courts have taken my passport as they have said that I can't leave India till my case is resolved. In last 8 months I have attended 38 court dates and my wife who has gone back to Canada hasn't attended even one court date.

My question is that the person who told me about ACP thingy.......is this correct?? and if he is correct under what law this law is mentioned so I can tell my local lawyers who doesn't know this law.

If this is the case then I can go to the Allahabad High Court and get this FIR quashed. I am stuck in India for last 8 months and fighting these fake cases.

PLEASE HELP!
