Case pending for a very long time

Sirs
There was a case filed in CAT Mumbai by some DRDO officers against govt of India, regarding teaching allowance. The judgment given in 2001 was in favour of officers. It was challenged by GoI in Mumbai High court but again officers won there (Petition No.7301/02 dated 3.2.2006). It was again challenged in Supreme Court which returned the petition to Bombay High Court in light of some new facts. (CIVIL APPEAL NO.8294 OF 2009). However, by this time most of the officers were transferred or retired and the case was not pursued in the high court. My query is, whether this case can be pursued by someone like me who is not aggrieved. This case has profound bearing on teaching allowance in govt sector. Also can High court decide the case suo motto as the officers are no more available for pursuing it? Can i write to supreme court chief justice to ensure culmination of the case?

My wife behaviour is not tollerable

I got married in the year 2010 and out of the wedlock I have one daughter also. Wedlock was soleminized at bareilly U.P., my main problem is my wife is not behaving well with my mother she usually fight a lot and also she usually insulted me a lot. Nowadays her parents are also supporting her in wrongdoing instead of making her understand that her home is matrimonial home they are saying whenever you feel you come to her father house. My In-laws are very illeterate they insulted me very badly.

Q1)Sir, Can I file divorce case from my hometown bareilly for divorce or I can file from Delhi?
Q2) Also I got some threating call of police and false cases

Q2) can I logged harasment case agaainist them in bareilly u.p.?

I have audio recording of my wife, MIL, FIL bad behaviour they insulted me and my widow mother.
I am in lot of agony and sir
I don't kno w how long this relationship will continue...

I am earning about 70K

how much maintenance, alimony in case of divorce?

Can I have custody of my daughter?
Please help me!!!!

Family dispute

Husband: aged about 65yrs. Retired as managerial personnel from a nationalized company. Not enjoying any Pension. Had a critical heart surgery in the year 2013. Owner of a two storied house situated in Kolkata. Possessed near about Rs. 25 lac in his Bank a/c. Have an extramarital affair with friend’s wife, for which such friend has the knowledge but he used to encourage it as he has another extramarital affair. Always neglect his only son, it is growing day by day. Always remarks in negative languages to the son and to the near & dear ones about the son.
Wife: aged about 59yrs. State govt. Grade A employee. Suffered from heart attack twice. About to retire within 4/5 months. In all of her bank a/c the registered nominee is her husband or the secondary holder of such a/c. always worried about his son’s future. Try to save her son from the negative shade of her husband. Aware about husband’s external affair but ignored the fact as she was fully focused in her career and son’s upbringing.
Son: aged about 28 yrs. Passed M.tech. continuing further study. Working in a central govt. organization on contractual basis. Married. Have a 2yrs aged daughter. Support his mother’s feelings.
Other Facts: wife spent lots of money on husband’s critical heart surgery, invest her money for the construction of such two storied building on the husband’s land and the property was mutate in the name of the husband. son suffering from a critical spondylitis problem but it is curable by expensive treatment. Recently it was noticed that the influence of the extramarital affair of the husband increased and the Husband is willing to sell the two storied building by depriving the wife and son and he also denying the paternity of the son and always prayed for wife’s death.

At this situation:
1. The wife needs divorce but she willing to stay in that house as she has no other option to stay other place else due to insufficient savings and furthermore she also wants to establish her son’s right in that house and want partition of the property in three parts i.e. in between husband, wife and son.
2. Husbands not willing to give divorce as he would be the family pension holder after his wife’s death (remind that wife had suffered from second heart attack in recent past) and he had told this several times to his wife also.

Now my question is how the wife and son establish their right over the residential property in which they used to reside long 14 years and how the wife may deprive the husband from enjoying the family pension and her other savings after her death?

Advice on defamation

Sir/Madam I visit a gym every evening and one female member of the gym tried to assasinate my character by shouting and linking me with another member of the gym. She passed some remarks at large to all the members. What kind of action can I take against that woman and the gym as the gym officials did not stop her . In fact the manager also got involved with her.
Kindly advise on the matter. She has spoilt my reputation.

Tenancy dispute

original tenant and landlord died more than 5 years ago. Partition of such property was not done by the three sons of the deceased landlord. elder son of the landlord issued rent receipt on behalf of the others to the grandson of the deceased tenant. from July,2011 landlords declined to receive the rent. now in the year 2014 landlords directly and indirectly forced tenant to vacate the property. what would be the remedy for the tenant? tenants are from west Bengal.

Order 21 rule 97 and order 21 rule 99

Greetings to All,

If during execution proceedings a property in the EP is delivered to the DHR and no obstruction was made by the JDR and also a third party who is not party to the decree by Order 21 rule 97 or by way of Order 21 rule 99. Further the EP is pending for delivery of the other properties. In this context can a third party who is dispossessed from the property file a fresh suit for declaration of title. Order 21 rule 102 suggest that no fresh suit if the third party is dispossessed? Please enlignten me.

subletting legal or illegal

We have a very old undivided disputed property in old delhi. In that property we have a tenant Mr. X who gives to Mr. Y(owner) but somehow Mr. Y is expired 5 yrs ago. Now the tenant is refusing to pay rent to Mr. Z (son of Mr. Y) as he is saying he will pay the rent only on the receipt containing name of Mr. Y as owner as he is saying he will not change the name on receipt. And in between this Mr. Y has rented the same to another person call Mr. A on terms in there partnership deed that he will provide him only workplace and all the stocks and maintenance will be borne by Mr. A only and he will take share in profit only, no loss will be bear by him or his place. Now Mr. A approaches Mr. Z that if he want then he can make rent receipt in name of Mr. A and he is ready to pay all the previous dues and continue new agreement.
(All previous rent receipts are made in name of Mr. Y & Mr. B ( B as another owner in property. Mr. B has sold his share to another person).

Wife refused to give information in 91 crpc

My SIL has filed the 125 Crpc case against my brother and demande high maintenance from him and concealed her sources of income from court.My brother filed the application under section 91 Crpc to dislcose her assests, sources of income, appointment letter etc..The court issue notice and asked her to file the reply but she filed the reply in which she refused to dislcose her income..
The court did not take action..what is the remedy and future course of action if the wife refused to dislcose of what is asked under section 91 Crpc by the applicant?

False mlr on me and my family

Sir, My SIL was not staying with him.one day in premdiated manner she came to home of husband and stay at one night..and on the pretext of joining along with children..she left home and visted to her parents home located at differnt city.therafter she filed Medico Legal Report that she has been beaten by husband and his family members..The MLR shows no external injury there..The MLR was done at Govt hsopital on Pvt request of her with token fees of Rs 500/- the factum of this MLR was concealed from husband and relatives but come across through chargesheet filed by Police..the Magistrate has charged me and family under 323 & 498-A/506 sections..I am now planning to file RTI in Govt hsopital so that it can be counter at the time of trail..kindly provide some tips so that it can be useful in revealing information under RTI and same can be useful in Criminal trial?

Query on the way financial institutions using cibil score

Hi,

I have experienced and heard from some others. The financial institutions are using CIBIL score is the only reason reject loan. I strongly disagree with this. There lot of discrepancies and few are:
>> CIBIL does not verify the updates
>> Lot of times financial institutions does not update CIBIL correct information. Like if the overdue of the EMI is due to bank employee fault - CIBIL is not aware of.

For all these customers are suffering.

My query is can this be filed in SC under PIL? Help me bring this to public notice and get it resolved.
