Appeal against the orders of state information commissioner

2nd appeal was filed with state information commissioner. As the applicant is not satisfied can appeal be filed before Chief State Information Commissioners. Please advice

Husband file false allegation to his wife as crulety & desertion

If the husband has file petition for divorce in court & in that petition he has making lots of false allegation to his wife under cruelty & desertion. But wife doesn't want to divorce from his husband. She had filed RCR in her court. After that how to husband had prove the cruelty & desertion in court?

can any one suggest me sitetion?

Wife refusing to accept the signed settlemt

Dear all,

My wife and me are not living together for last 4 years now. I am trying to get the divorce but facing following problems:

1. 1st we filed petition for mutual consent according to which i was to pay her Rs. 525,000/- to be paid @35,000 for 15 months. she came for the 1st motion but due to strike in court 1st motion could not happen. after that she did not turned up to the court for next 3-4 hearing. by that time she already got 12 installments of Rs. 35,000/-. In the month of Dec-12 she filed 2 separate case in other court a)restoration of marriage u/s 9 and b)domestic violence.

2. In the 2nd hearing of section 9 case she asked for mediation. after counselling i agreed to pay her Rs. 15,000 per month for 3 years (Rs. 420,000 already paid under mutual consent case). the petition of mutual consent was not withdrawn till now. in the settlement deed signed on plain paper and witnessed by both the lawyers of both the parties, her father, my father and the counsellor was filed with the court. As per the settlement deed she was to withdraw both the cases and will appear in the case of Section 13 (DMC) and will get his consent for divorce recorded. the case of section 9 was withdrawn on the same hearing.

3) later on, she did not turned up for section 13 case after 2-3 hearing she came to the court once and refused to give her consent and the case was dismissed.

4) after that in the month of Sep-14 i filed the case of contested divorce in which she is contesting that her lawyer and councillor cheated on her and settled her case by force and she want more money for divorce.

5) I never appeared in the case of DV, it was to be withdrawn by her as per the settlement. but she never withdrew that case and now i have been served with a notice of court to appear in that case.

My questions:

1) what is the remedy for me in DV case as it was to be withdrawn as per settlement.

2) Can she succeed in getting higher maintenance than what was agreed in settlement letter. i have already paid all the monthly installment which has fallen due since the time of settlement (15,000@18= 2,70,000)

Please advise a way forward!!!

Agricultural land & non-agricultural land procudure for partition suit

Respected Experts & professionals...
A deceased person having his share agricultural land and non-agricultural land for partition. This he got by way of registered partition deed of 1958.
The legal heirs of this person, if prefers to file a partition suit for the partition of the above mentioned both properties, whether they can file a single partition suit or will they have to file separate partition suit for agricultural and non-Agricultural land ?

Builder not completed the house in time

Hello,
I bought a flat in 2010 and registered in 2010. It was under construction. The builder till date has not completed the project in all respects. That is water, electricity , lift, power back up is pending. However to his credit, he has allowed few buyers and land owners to live and is paying for the electricity bill, now that is also cut. What can the buyers and land owners do?
In the sale agreement, he had mentioned that he will finish the project in early 2011, however the same is not mentioned in sale deed. This is true for all buyers. Please suggest what should be done

Unpaid dividend

There is some dispute with regard to registration of transfer and the court has issued an ad-interim injunction order in terms of prayers (a) to (e) of the petition. In prayer (c) the Plaintiff has prayed for perpetual injunction restraining the defendent from issuing any dividend, right shares etc pertaining to the disputed shares in favour of any party.Since more than 7 years have passed,Bank with which Unpaid Dividend Account was opened is insisting for closing the account by way of transfer to IEPF A/c.

Proceeding for compromise...

Dear All,

My wife file a case on me with 498 , 125 ,dv at another place , i chalenged to 125 in high court , i also filed a divorce case with 13 A at another place...Now they want compromise.....So my question to u all that how cane i proceed with my cases...so that all the cases ended in well manner.............bc'z i m not believe on my wife /their relatives....

Validity of gpa after the death of executor

Sir
"A" executed GPA in favour of "B" for developing and selling his properties on 17-01-20013. "A" died intestate leaving behind his son on 20-5-2014 . Now the son of "A" is claiming that the GPA is not valid after the death of "A" but "B" is trying to sell the property.

Whether the GPA is valid one and does "B" has the right as per GPA even after the death of "A".

Kindly explain the legal position GPA and its holder?

Back dated rent agreement as address proof for passport

Hello Respected Lawyers of the community,

I have a very confusing situation. I have lived in New Delhi for most part of my life and as a result all my documents (PAN Card, Voter ID) are from my previous address. Unfortunately, I never focused on getting a passport back then.

However, a year and a half ago my family moved to Kolkata and we have owned this house for over a year now. The house agreement is under my mother's name and we live with her. Due to lack of any proof as yet, I have not been able to update any ID proof with the new details.

And, now I am in need of applying for a passport as soon as possible.

The only thing keeping me from it is the address proof.

Is it possible to get a back dated rent agreement to work as an address proof for passport? What are some other options?

I do not have a bank account with any nationalized bank and opening one right now would need me to wait for 6 months before i can use that account statement as address proof.

Please help as soon as possible.
