Hi,
We married in May 2013 and saperated since a year from now immediately after marriage. I, along with my relatives made enough efforts to convince my wife to come back but she and her mother refused to do so. During this convincing period, my father suffered a heart stroke and still is under mental stress. During which we had a brief talk with my inlaws, and they agreed for Rs. 1L as permanant ailmony and all the jwelarry that she received in marriage to settle for mutual divorce. However, I refused to give them a neckless worth Rs. 50000, as my mother had sentimental values associated with it. Here things brokes. Later they demanded minimum Rs. 5L for mutual divorce, to which I opposed. Recently I received a Notice from Protection Officer to appear in the court and it's mentioned that 'sec 12/DV' in the notice. My hearing is on 8th Nov and I'm absolutely clueless about what to do. I'm frightened, helpless and very much worried. Below to be noted:
1. My gross salary is 26000 as per offer letter, and net 16000 as per salary slip.
2. I do not own any of the properties, rather since my father is still alive, everything is on his name. He's retired.
3. No FIR has been filed in last one year.
4. Earlier, in one of the notices my wife sent to me, it mentiones that I used to beat her and did not provide proper food. which is false claim, as I have a video recording in which she has admitted that I never beat her, never ignored her, but always helped her be it cooking or anything else.
5. They also accused that I have an extra marital relationship, but did not mentioned in any of the notices they sent to us.
6. I also have a audio recording in which one of her relative asked to give divorce and all the marriage expenses.
7. My wife used to work before marriage and now she's not.
Questions:
1. Will this be the 498A case?
2. Will there be a police case?
3. I learnt that maintainance needs to be given, but if I share the audio recording (Pt. 6), then can I avoid it?
4. Can they accuse me for any other crime during the case?
5. What is safe exit without paying money/paying the least money as possible?
Please advice.

I filed a criminal complaint against my husband as he hide his first marriage to someone before marrying me.
In response we entered into an agreement that he will pay Rs. 30k PM to me till he completes Rs. 30 lakhs. That agreement was recorded in courts of MM in Saket, Delhi.
I withdrew all my criminal complaints against him after this agreement.
He just gave 2 months maintenance and after that for the last 8 months he has stopped that.
Now i have came to Bihar to my parents.
Can i again complain against him in Bihar OR i have to go back to Delhi or what can i do now.

I'm contesting the divorce petition filed by wife on ground of impotency, non-consummation and mental cruelty,HMA Sec. 13(1), for last six years. I had filed RCR and both cases were running together. After one year, on her divorce petition, I filed application for my potency test by medical board which was allowed by the court after three years and the test report came in my favor. I did withdraw my RCR when the court allowed my application for my potency test but before completing the checkup and getting the medical report. I did so because I was ready to forgive and to take her back at the beginning, but going for potency test was beyond the limits.
Now, during my cross her advocate asked me whether I am ready to take her back for which my answer was simple NO. So, her advocate reminded the Judge that I had filed RCR for which I also informed the Judge that I had withdrawn RCR the moment I decided not to take her back based on the changed situation and her persistence on impotency allegation even after four years, which forced me to go for potency test.
Her advocate also told the Judge that she is ready for mutual divorce without any demands, but I refused it and told the Judge that since the allegation is impotency and she has also filed objection on medical report saying the medical examination is incomplete and chances of relative impotency, the court judgement is necessary for my future life and to avoid social stigma.
So, please help me to clear the following points.
1) Can judge allow her divorce petition just because I'm not ready to take her back and also not ready for mutual divorce, so counting both as mental cruelty towards her?
2)Should it be considered that I was ready to take her back and also had filed RCR which was in force four years during which she did not take any positive steps to come back?
3)she raised false impotency allegation against me and dragged the case without even filing application for my potency test from her side, and at last, I had to file application for my potency and obtain medical report in my favor. Is it enough mental cruelty toward me to withdraw RCR?
4) Is there any provision in law that, in a divorce case, if respondent is not ready to take the petitioner back, which gives the court the power to allow divorce petition without considering the other situations/grounds? I mean anything like irretrievable breakdown of marriage applicable in Family court / High Court.
