Division of portion

Hello Sir,
My dad owns a property and now wants to give it as a gift to both of us, me and my elder brother. Is there a law or rule saying that front portion will be given to so and so or is it Dad's wish?

As per ruling of Dashrath Rupsingh Rathod Versus State of Maharashtra & Anr of honourable Apex Court , complaint should be filed where cheque is bounced.

My query is that, accused issued cheque of Patial bank but same was dishonoured in Jalandhar branch where head office of Patila Bank is situated . Complainant deposited cheque in Himachal . Where complaint can be filed , in Patila because account of accused is in Patiala Branch , or in Jalandhar where cheque was sent to for collection and dishonoured .

Bpsc judicial service

sir i attempt 28'th bihar judicial service. 1. in the i'st advertisement of 28'th bihar j.service there is clear that ,the marks obtained at the inteview shall be added to the marks obtained at the written examination.the name of the candidates will then be arranged by the commission in order of mrit. 2.. but after written examination and before viva voce test a letter issued by bpsc that by the direction of hon'b high court the minimum cut off marks in the viva voce test will be 35%. sir i got only 30% marks in the viva voce test.but my total marks in written and viva voce test is more than final qualifyinf marks.so according to 1'st advertisement(para 1) i am pass. sir my que. is (1) if i writ against para 2 which is published in midst f game ,m i bound by estoppel... if yes then please suggest me what can i do to get the result. (2)secondly sir according to sec15(c) of bihar civil services(judicial branch)recruitment 1955, "there shall be no qualifying marks in the viva test... final cut off matrks.. 559 and i got in written 544 and in viva voce test 30. total 574..more than 15 marks from final qualifying marks

About the parcel which was sent bu courier service.

sir. One client came to me, his problem is that he sent a courier from gujarat to someone who is residing at calcutta. After a few days when he asked a person to whom courier was sent so he denied that i have not received parcel which u sent me. so my client went to the branch and he said above thing to him. so they inquired and then after he give the contact detail of the calcutta branch, where my client inquired so the replied that yes we received your parcel but it is misplace by us. That is been told on the phone to my client, docket no also given to my client. Now they are saying we can not do anything about this. my client also given a written complain to them yet. no reply so what remedy i have, value of the parcel is about 10-15,000/-. Weather i can make a complain before the police station? or is there any other remedy?

Non complaince to bring paid up cap in moa aoa

what is the formality require to complete when company can not bring paid up capital within time . eg company is formed on 11-11-2013 what is the last date of bringing the paid up capital. what are the procedure of consequences as of this . what is the last remedies on it . who is required to intimate to Company law board?

Explaination about sec u of chapter 1 of disabilites act 1996

As per disability act 1996 chapter 1 sec (U) A person with low vision means a person with impairment off visual functioning even after treatment or standard refractive correction but who uses or is potentially capable of using vision for the planning or execution of a task with appropriate assistive device.

My question is to whom this section applies and what are the criteria for a person to fall under this section.

Benefits for accidents while on official duty

An Officer of a company was nominated to attend a seminar organised in the city. The company rules the officer is getting monthly conveyance allowance for commuting from residence to works and back, It is also a condition that the osfficer is required to use his personal vehicle for official work, within 8 KM radius.In case the officer is required to use his own vehicle for official work, then he is eligible to get reimbursement of conveyance expenditure @ Rs.12/- per KM. Here the place of conference is more than 8 kms and the officer used his personal vehicle. Unfortunately, while going he met with an accident with a cycle rider on road.Subsequently the cycle rider has filed a FIR with local police station. The vehicle of the officer also got damaged . He got it repaired in an authorised service station and claimed insurance for such repair. He had also to spend Rs 10000/- from his pocket for repair which was not allowed by the Insurance Comapny.
Now the officer submitted an application for (i) Reimbursement of Rs 10000/- (ii) Requested the Management to provide him legal aid since the accident occured while he was on official assignment, and Criminal proceeding will be initiated.(iii) Treating his absence for attending Court as duty. It is pertinent that the Comapany do not have any rule for such incidents.
The querry is whether the Management shpuld acceeded to the request of the Officer? I am more interested in this matter because, in our profession also the same incident happens since we the Legal Officers are required to move outside factory for attending various Courts, Advocate Chamber etc and normally use our own vehicle.

Gift deed partition

Respected Sir,

We are in a following case in lower court:

Mother gifted property to her 4 sons. Eldest son is not agreeing that the 3 brothers get their property share. All 4 brothers where in same business some time back but now they are separated in business

The eldest brother has by some way impleaded the property of 3 brother's wives on pretext that the 3 brothers have taken property in their wives name by taking undue funds from company when they were together, this plea is accepted by lower court.

Even though the wife of three brothers are not benificiaries of gifted property can their property be impleaded? as it seems very vague.

2. Can the wives file some case against elder brother for harrasment and mental stress??

Can some one else's property be impleaded in a simple partition case which is very clear cut.

Citizenship of india by naturalization for a foreigner

I am a 69 years old French citizen who has lived in India for the past 30 years with a 'five year entry visa' which has to be renewed every five years at the Indian ambassy in Paris, France or anywhere outside India. I would like to get in contact with a lawyer who could advise me on the matter of Indian citizenship on the basis of the following article of Indian law regarding the acquisition of citizenship by a foreign citizen:

"Citizenship of India by naturalization can be acquired by a foreigner (not being an illegal migrant) who is ordinarily resident in India for twelve years (throughout the period of twelve months immediately preceding the date of application and for eleven years in the aggregate in the fourteen years preceding the twelve months) and fulfils other qualifications as specified in third schedule to the act, 1955. "

I came to India for spiritual reasons and am not employed.
