Power of attorney

Dear Sir,

my uncle had given me General Power of Attorney, which was duly notarised by the Notary advocate. but there was no witnesses signature in the POA. my query is if there is no witnesses signature in a POA is that valid under law? could you please advise under which section or law? thanks a lot.

My query before the learned experts are :-

Can a nationalised bank initiate action under 13(2) of Sarfaesi Act after dismissal of their money suit?

There is a clear bar from entertaining a fresh suit on same cause of action under CPC but can 13(2) be initiated?

Auction of attached proeprty of proclaimed person

Accused under sec 138 is declared PO and the Property of P.O declared under section 138 of N.I.act is attached under sec 82 and 83 cr.pc in separate application moved by the complainant. Now My query is
1. Whether it can be sold if yes how much time to wait for auction?
2. If property is sold and after some time accused comes to the court and contest the case and ultimately acquitted , what will happen to the auctioned property?

138 n.i. act...!

Hello Experts,

I have filed a cheque bounce case U/s. 138 of N.I. Act in March 2013, and till now it is in summons stage, the problem is the Accused is changing his address frequently and the summons are not getting served, and in the result the court orders for fresh summons to be served.
Now my question is how to take steps against the Accused:
1. Shall i request the judge to issue warrant against the accused?
2. Shall i ask for a paper publication?
3. Can i ask for proclamation U/s. 82 of Cr.P.C?
Plz suggest me.

Can a wife have a legal share in her husbands self-earned property?

My mummy's age is 63 and my fathers age is 65.. They married before 42 years.. My father started his business out of my mummys jewels in 1975. he purchased 4 properties(3 houses in his name and one in my mummies name..) Due to some misunderstanding my father and my mummy were living separately in a same house, my father was always threathening my mother that all the properties were earned by him, so that he can transfer al the properties to any one and make my mummy to beg..
a). Does my mummy has legal right to get a share in my fathers self earned properties, as she was a housewife lived with him for more than 40 years.
B). Suppose if my father transfers the property to any one by the way of selling or by will, does my mother has the right to stop it legally by getting a stay order in a court?
C).if my mummy has the legal right in my fathers property, how can she claim it.?

Clarification on payment of income tax on penalties paid by the employees in public sector companies

It is bring to kind notice that the Telangana State Northern Power Distribution Co Ltd (TSNPDCL) which is having address of,

Are collecting heavy illegal penalties from the employee's salaries & retirement benefits as part of punishment against disciplinary cases in corer rupees and understood that they are not paying the Income Tax for such amounts since long time as responsible organization. The Company is showing such type of penalties in employee’s cost to escape from the TAX.

If the same payments are made to employees by the Company, employees are paying the Income Tax regularly. In return when the company is earning such amounts by way of penalties from the employees, they are supposed to pay the Income Tax. Nonpayment of tax by the Company is injustice and loss to the IT Department.

Hence it is requested to clarify the rule position along with authority to take necessary action for collecting tax along with arrears from the Company immediately.

Regarding rti act

I Kannan want to state that the Hon’ble Madurai bench of madras high court order dated 25/03/2014 was pleased to dispose my writ petition with the direction directing the State Information Commissioner to dispose of my second appeal dated 10/02/2014 by passing appropriate orders with in a period of eight weeks from the date of receipt of the copy of the order. On the basis of the above order the State Information Commission have wanted me to attend enquiry date 30/05/2014. I also attended the enquiry. During the enquiry the State Information Commissioner have passed on the order addressed to the Commissioner of Land Administration, Chennai, stating that give current status of UDR patta to the applicant and also stating that under the RTI act 2005, section 18 (3) (b) to take disciplinary action against the error done officials and also inform the details of action taken against the error done officials within 30 days from the date of receipt of copy of this order. But I received UDR patta current status only. Based on the above facts I filed fresh RTI application on 21/07/2014 addressed to the PIO, State Information Commission, Chennai asking the information about the disciplinary action taken details of the above mentioned the State Information Commission enquiry. For that I have not received any information. There after I filed first appeal application on 21/08/2014 addressed to the State Information Commissioner, Chennai instead of sending directly to the appellate authority. Because under section 6 (3) (ii) of RTI Act 2005 my first appeal application can be forwarded the same to the concerned appellate authority. For that also I have not received any reply. There after I filed first appeal reminder application on 22/09/2014 under section 6 (3) (ii) addressed to the state information commissioner, Chennai. For that also I have not received any reply. There after I filed second appeal on 15/10/2014 under section 6 (3) (ii) addressed to the State Information Commissioner, Chennai. For that also I have not received any reply. There after directly I filed fresh first appeal on 11/11/2014 addressed to the Appellate Authority, State Information Commission, Chennai. For that also I have not received any reply. As I am aggrieved by no reply of the appellate authority, State Information Commission, Chennai. Please tell me how can I get disciplinary action taken details and also tell me Shall I file new Writ or Contempt.
