Kul khand

i have a property in kandivali east my father purchased the kul khand rights from the previous owner.
the main owner of the land is one called jiji bhai behramji pvt ltd the person who sold the land to my father had the kul rights so he sold his rights to my father in 1971.
i want to know what are the rights of the kul khand and can i who is the legal hire of my father can do the development on that land and will i have to share anything with jijibhai behramji pvt ltd

Crpc 125

sir... can u suggest me any judgment of SC in favour of wife regarding maintenance U/s 125 CrPC

sir.. I have heard there is one judgment of SC in 2014, which says the wife get the same status, which was given at the time of marriage, no matter after marriage the man is working or not, husband has to maintain his wife with the same status as during the marriage.

i am unable to find that TITLE of that judgment... if u can provide me

What to do if wife is not ready to give divorce

I am reposting with more details:

Got married in Feb 2014 and filed annulment in march 2014 due to non consummation of marriage. On judge's advise that I will not able to proove annulement, I amended it to Divorce petition under 13(i)( ia). However, after 7 months of filing the petition, it was finally dismissed by the family court in Delhi citing reason that denial of consummation does not amount to mental cruelty and I was not able to proove it as exceptional hardship... Now, I have the following concerns:
1) As per my lawyer: We will file the divorce case in month of Feb 2015 which will initiate the case automatically since it will be after one year of marriage. I hope this is correct ?

2) Now, the matter of the case, evidences etc will remain same. How, will I be able to win the case.. ( IT IS A CONTESTED DIVORCE)..

3) I am 100 percent sure that the wife is either Physically or mentally impotent to consummate,, How can I insist in court to order for medical examination. Because the judge refused to issue any such order when my lawyer was raising this again and again in my lost petition.

4) My wife and her parents are not ready to settle it outside the court. I have offered them return of all expenses they incurred on marraige.. They just want a stamp of marriage on girl for as long as they can.

Cheque bounce

I am a business man, one of my client bought 25 lac material and issued me a cheque for it.It bounced, I have filed a court complaint after several attempts a nbw a released , which they reclled.
This company has 3 partners they withdrew money from their company and spent on buying them cars etc. Now they claim no money, ready to go to jail. One partner also has property in his name other partner also has property in family members name.
Please advice further action.

Purchase of property

Hello sirs,
I want purchase an apartment in bandlaguda, hyderabad, telangana state. the owner of the property resides in the U.S.A. i.e., an NRI. At the time of purchase of this property, he was not able to present in person for registration process to purchase the property but purchased the property through power of attorney in the name of his representative i.e., his father. And now also he is not able to come to India to sell this property but wants to sell this property through power of attorney in the name of his representative i.e.,again it is his father. Is it safe for me to purchase through power of attorney? Is it legally valid throughout the generations to come in future? otherwise what are the other ways to purchase?

Reg. evidence affidavit of marriage annulment case

Hi Experts,

I am representing myself in my case of marriage annulment and it is now in 'CROSS EXAMINATION' stage. In another 10 days i have to cross-examine my wife. I wanted to submit some of the documents and the SMS messages through which i am going to cross examine my wife. Could you please let me know what is the procedure to submit the documents that i have to court before 'Cross Examination' of my wife. I need the format of the AFFIDAVIT or MEMO for document evidence submission.

Criminal contempt of court

Have found this article , can experts comment upon it, are all remedy available as mentioned. In my case police authority have issued licenses without fulfilling mandatory conditions. Thankyou.

POLICE WILLFUL DISREGARD IN DISCHARGE OF HIS DUTIES CONSTITUTES CRIMINAL CONTEMPT OF THE COURT:

The process of administration of justice begins with the violation of a right of a person or the committing of an offence by a person, well before any FIR is filed OR case is registered in the court.

In the light of Contempt of Court Act- Section -2(c ), If Police refuses to register FIR or refuses to investigate the case or refuses to apprehend or arrest offenders or trying to protect the accused or the guilty in any way, than a Criminal contempt of Court u/s 2(c) (III) of the Contempt of Courts Act 1971 can be filed against them for causing obstruction in the administration of justice.

However, the element of police acting illegally deliberately and consciously without any justification is essential. "A refusal to see the obvious, a failure to investigate the doubtful if sufficiently gross, furnishes evidence acting deliberately and consciously.

The Contempt Petition is filed in the High Court and the best part is that proceedings have to begin immediately. However, before filing Criminal Contempt of Court Petition, Sanction from Advocate general must be obtained. If they do not give sanction or does not reply within a reasonable time of 30 days, than Contempt petition can be filed informing the Court about sanction not given or no reply received.
Not only the Police but whoever including political interferes in the process of investigation or interferes during the trial of offence in the Court can be charged with obstructing in the administration of justice and thus it constitutes an serious offence of Criminal Contempt of Court.

However, for offences which are enumerated in Indian Penal Code cannot become the subject matter of Criminal Contempt Of Court.

buying property based on affidavit

I intend to buy a residential plot in Bangalore. Pls advise regarding buying below property.

One of the seller inherited property from his father through affidavit signed by all of his brothers who relinquished thier right on property. Based on affidavit, mutation /khatha is already changed in the name of seller but as per EC, still his grandfather name is appearing.

The seller father is the only child of his grandfather as per affidavit who bought this property from another seller during 1955..

Pls advise regarding buying this property.
