Marriage

Sirs/Madam,
I’m a male from Coimbatore-tamilnadu, born on 15.05.1990, I am working in chennai... I know a girl from December 2012 at Coimbatore near my native village, she born on 12.08.1995….. Her mother occupied me and my thoughts and involved me in her daughter’s life so we started to love(her father opposes it from initial itself)…. On 01.06.2013 she wanted to write medical entrance so I helped they both to come to Chennai and stay for a day and to write and go back….during that one day her mother has compelled me to take a photo with her daughter just standing nearby….(no Hindu rituals, or anything)…. She presented 2 rings one for me and another for her daughter….(compulsion)…. All these happened on and before 02.06.2013…..
Note : She completes 18 years old on 12.08.2013
But on 02.09.2013 due to problems arisen, big fight has come between families and her father called police… police came and separated us, and orally advised not to meet or talk 3 witness are there…… After a day also that lady (mother) tried to talk to me and texted…. I sent a massage simply “don’t talk, SI and CID has advised already, I didn’t cheat any one.” I lost the ring somewhere, may be during the fight at their home itself…. She was asking for the money and the ring she gave to me… so my father sent my uncle to their home returned back her photo and everything….
I have given lot of books but she didn’t give back anything…. She told like I don’t have any photos like that……she is having following things :
The messages which I sent to her daughter (between December 2012 to 02.09.2013)…..My single photos... and a photo in which both are standing near by..
After 2013 Im not visiting my native also, now I have a plan to go there and settle….
Now I’m worried, In future she may claim to marry her… Please advise me on this….have to get unmarried certificate??..

Capital gain calculation

Dear Expert,
My client sold own residential land Rs 46.00 Lacs in Nov 2014 which was purchased in Dec 2002 by Rs 3.47 Lacs. Now how can calculate Capital Gain and I want to know that in this case how is investment money in capital gain account to save tax.

Forged degree certificates & marriage dissolution

This question for a colleague of mine.

It was an arranged matrimony and seems she went through a lot of physical abuse. The couple have been living separately for 3 years now. Her husband after sending few legal notices has filed for the custody of the child even before filing the divorce petition. She is responding to it.

It has now come to know that the original graduation certificates of her husband is forged. With 'n' papers in arrears he has obtained a forged completion certificate.

His job was one of the important factors for the marriage. Now that the job has been obtained with falsified documents. It is clear that the job and marriage were built on these forgery.

Can this criminality be valid to call the marriage itself as null and void?

After 2yrs we have found that our marriage certificate is fake.

We have done a court marriage. My husband is jain and I m Punjabi …we appointed a lawyer…we have given all the necessary document to the lawyer ie
1)Passport size photos
2)Residential proof (Xerox of Ration card, Licence , Pancard)
3)Date of birth prrof ( School leaving Certificate)
4)Witness (Xerox of identity proof , Photos , Ration card)
We have clicked the photos in front of camera in register office…me and my husand and all witness have signed where the registerar told us to sign…our lawyer give us marriage certificate…we paid 30,000/- to that lawyer . Now after 3years of marriage we decided to get divorce and we went to the registerar office with our marriage certificate. Registrar told us your marriage is not legal bcoz your marriage certificate doesnot have a legal stamp. We are shocked . We have told them to give us that register (book) on which me and my husband and all witness have given the signature .we searched but naot found the signature.We have search for that lawyer . But we can’t find that lawyer. what to do now can you give us some suggestion what to do in this case?

Writ of certiorari

Can a Person of Indian Origin being a Citizen of foreign country having property in India file a Writ Petition to issue Writ of Certiorari under Article 226 r/w 227 of the constitution of India against a wrong judgement passed in revision where there is no appeal. there is a supreme court citation BASHESHAR NATH Vs.
RESPONDENT:THE COMMISSIONER OF INCOME-TAX,DELHI & RAJASTHAN & ANOTHER.DATE OF JUDGEMENT: 19/11/1958 Article 14 of the constitution is interpreted at page 16 of 60 "That the underlying object of this Article is undoubtedly to secure to all persons, citizen or non-citizens the equality of status and of opportunity referred to in the glorious preamble of our Constitution. Could this interpretation give relief to a non citizen?

Contradictory written statement

Dear experts Greetings!!!

My wife filled DV and given false affidavits on later evidence stage she contradict her evidence in WS.
Now she filled divorce and mention the same thing which she written in DV. Now I wanted to know it's possible that I show those written statement to court and demand for rejection of divorce case until RCR will under process on the basis of false allegation.

Recovery of salary

can i give complaint under wages act or any other act for recovery of my salary which is due for 6 month . my salary is 80,000/ p/m hospital managements is habitual to use the doctor and avoid salary there are many doctor awaiting for salary and management is in good condition

Hello Experts,

I have the following query:

My aunt ie. my Mama's wife(My Mama is no more)wishes to buy me a flat. If she gives it to me as a gift , will I have to pay a gift tax and if yes at what rate.

My mom,ie., mama's sister, is also no more.

Pre-litigation dispute

Dear Experts
I went to LokAdalat, the Bank said one time settlement amount and I agreed and I had ask only 6 months time, finally they agree and the agreement prepared by the Hon.Retd.Judges Desk and I have signed and I ask the the copy of that they advice this is not necessary for you, the Bank will sent you a detailed letter.
Now I am feeling very much I can negotiate the amount but I didnt. later I noticed other customers are negotiated the amount and they settled.
Now I have any chance to negotiate.
Please advice.

Agricultural land purchase in other state of india

Suppose the man Naming Rama is from Kerala and he purchased the agricultural land in Karnataka.
Now he thinking to sell the land but some land grabbers are pressurizing him to sell that land them only in half rates otherwise they will file a petition in court against Rama that he cant purchase the agricultural land in other state bcoz he is not a farmer or agricultural worker.

kindly Advice if thr is a place in law that a non agriculturist cant purchase a agricultural land/in other state than residing state.
also if amendment is thr in law kindly refer
