We have one 800 Feet shop (shop no.6) in the name of our firm in one co-op. soc. in mumbai which was managed by myself and my brother. Now due to a family reason, we have decided for a division of shop. We have applied to society and the shop has physically divided in to two parts by building a wall i.e. shop no.6 and shop no.6A but the owner remains the firm. Two different share certificate has been issued (both in the name of firm).
Two different maintenance bill has been issued by the society, both in the name of firm. Firm is not dissolved. Is this division of property (without change of name of owner) is lawful?

I have one query regarding the filing of civil matter before which authority.
Facts are as below -
An individual has purchased plot vide registered sale deed some where in 2005. But has not mutated his name in revenue records till 2013. Now when he approached to get his name mutated revenue officials informed him mutation is not possible in his name as this property is already mutated. On procuring the details he came to know that another individual has mutated his name over the same plot by virtue of ex-parte Judgement and Decree passed by Civil Court in matter of suit for specific performance in the year 2013 and court has directed Superintendent of Court to execute the sale deed for the said plot. Whereas the individual at first instance was unaware about this suit and has purchased the plot prior to another individual.
My query is regarding whether i should file appeal before Sub-Divisional Officer for mutation? or
File a civil suit for declaration of ownership of the said plot or
Should file Writ Petition in High Court.
Whether execution of sale deed by court order in ex-parte judgement and decree would be an obstacle in appeal before SDO.
Please guide.

Sirs,
We are importing material through 180 days usance letter of credit in which importer has to pay stamp duty @0.25% on value of Bill of Exchange and stamp duty to be affixed or franking on Bill of Exchange, now the problem is that as per the provision of Gujarat stamp act, stamp duty franking or affixing only on unsigned paper but bill of exchange is usually signed by exporter in that case stamp vendor refuse to franking on signed paper. Now what is the way to pay stamp duty? or what is the proceedure to pay stamp duty on signed bill of exchange?.as we have to pay more than Rs.50000/- stamp duty on single bill of exchange so if we go for affixing stamp of 100/- denomination than its require many stamps.
please give your advice.

We had filed a partition suit in trial court, which my grandmother was 2nd plaintiff, the suit was dismissed 2 months back, as my grandmother was very ill (bedridden), she died on 1/12/2014,
now we are preferring a Regular appeal in district court after her death,
Question: Under which section we have to implead her legal heirs in appelllate court while filing the appeal, Is it under Order 1 rule 10 (2) or Order 22 rule 3 of CPC.

Dear Experts,
I am staying in Karnataka. I have some questions on second cousin marriage in Karnataka
1. I want to marry My Father's Mother's Sister's Son's Daughter. According to HMA this is valid but acc to Special marriage act this relationship comes under Sapinda. SO if we marry as per HMA and if someone files a case under special marriage act how this case will be handled? Will this marriage becomes nullified? Because in one law it is valid and in other it is invalid?
Also let me know if this marriage can be done.
2 It is allowed to marry Father's sister's son/daughter and Mother's Brother's son/daughter...do we have this mentioned anywhere in the Karnataka marriage act? please help me getting clearly written law as per Karnataka gov reg Cousin marriage.
3.Court says if custom allows then Cousin marriage is allowed...how do we prove that cousin marriage is allowed in custom? Is some where it is written?

Dear Sir,
I am really happy to get back to you. I have a big doubt. We are an ITES company based out of Tamilnadu.
I would like to know about the exemption act that an ITES companies have in Tamilnadu. Especially with regards to Govt. holiday do we have any recent amendment related to this. If so kindly share this at the earliest. We are US based company so we would like to list out the holidays list to our employees.

Sir, Is it necessary for every co-operative housing society in Mumbai to have Conveyance Deed.Builder is denying to do so by saying that he is in the process of extension of additional building in the same compound.In what condition conveyance deed can be exampted although society is already registred and in working condition.
How share certificate is related with conveyance deed or extension of additional building in same society.Can share certificate be issued.What are pre-requisite to issue share certificate.Thanks in advance to expert.
