The defendant had inadvertently not exhibited original registered Will in suit for partition. Now case pending for defendant’s evidence. Who should exhibit the Will, the defendant-beneficiary or an attesting witness or executor of will?

initially 'B' purchase property from 'A' after 7 years 'C' purchase property from 'B', now there is some issue arising regarding partition in A-s family, 'A' already died, they send notice to C, who is responsible?

Stilt parking in a under construction property - mumbai

I have booked a 2 BHK flat with a reputed Mumbai developer. The booking and registration was done in 2009 and the agreement stated a possession date of mid 2013. We were told the stilt parking can be purchased @ 3L but only later. However the project got stuck in various approvals (forest land , DCR changes , no CC available), thus out of 36 floors only 13 floors are done till now (2014 end). The project recently resumed work and the builder is now demanding 8L for a stilt parking, but without a proper receipt. This may go upto 12L at possession time.
As per the new DCR rules, this is illegal is we know. What are our options? The possession and society formation is nowhere near and it might take arrival of 2017. Should we purchase the parking with negotiation and can the society overrule it at a later stage? Its a loss loss proposition now for us!

Will alleged to be forged

A executed the Will in favour of B (son) and deprived C (son). Now after mutation has been sanctioned in favour of B, C filed a suit for declaration to be owner of property and to declare the mutation null and void. And alleged that Will is result of forged and fabricated one.
In this case who will lead the evidence first. please suggest with citations.

Cheque bouncing case under ni act

Dear Sir,
I have filed a Cheque bouncing case under NI Act. The proof of Affidavit was filed on __ at Egmore court. After a few hearings, the case was transferred to Fast Track Court. I havebeen present for about 90% of the hearings. The opponent has also been present for about 90% of the hearings.Every time I am going to the court but the opponent submits some affidavit and the judge gives the next date for hearing.I had to be cross examined. for name sake cross examination started after a lot of struggle. It is not completed. Now it is nearly 2.5 years over. My advocate is not offensive. I have changed the advocate also. But no use.

Kingly suggest me how can I speed up the case?
Is there any time frame specified for completion of such cases?

I was in Chennai when I filed the case. but now I have been transferred to Salem. am working in a central public sector company.
Is there any way to get the case transferred to Salem from Chennai?
Kindly help me.

Can I ask the reasons for the delay through RTI Act?

Sharing of property if a parent dies intestate

Hello!

My grand paa expired without a a registered will of his 400 SFT L&B property. His children are 1 son and 3 daughters. Now all his children want to sell that property. Please tell how do they get title in valid way so that they can sell the property and share the consideration without any disputes in future. There is no registered will in this case. If they say my mother can't enjoy property how can i mother contest to have a share in that property?

Can husband get exparte divorce without my knowledge

hi,

My husband deserted me when I found that he has a relationship with another girl and since then we have been living separately for 1 year. He made me suffer a lot and when I managed to get his call details with that girl, he left me and took all his belongings with him.

We both want divorce now but my husband and in laws are not willing to return my Jwellery and cash and making false statements that he has left his precious belongings with me before he deserted me.
He took all precious items with him before leaving and my inlaws have taken all my jwellery.

So I said I can agree for MCD only if he returns my Jwellery and cash.

Few days back I got a mail from one of his relative which has an incomplete application attached mentioning that husband has filed a MCD at a small city court in his native place on 30th October-2014 and they can return my jwellery and 6 lakh after MCD and they attached a false list of their items costing nearly the same amount so it is a trap. Also, I have not received any formal court notice.

I want to know that is there a way I can get the actual copy of his MCD application from that court.
Can he easily get exparte without my knowledge as I am in Bangalore and he filed MCD in a small court at his native place.

Kindly advise.

Compliant against service provider

Sir,
I am a CA Final student and have purchased online classes from a Company for my exams which are scheduled in May 2015.

1. Since from the beginning, they are behaving irresponsibly in providing services for which I am entitled to.

2. For instance, unacceptable delay in delivery of the course and also delivering the content which is not applicable for my examinations.

3. I have sent them many emails but didnot get any reply from them. If I call the customer care number, they will end up saying that they will get back to me in 15 mins but they never called back.

4. Due to their irresponsible attitude, My studies are getting affected.

I am fed up now and want to teach them a lesson.

So, what legal options do I have now? Please advice me.

Hello there,

I am running a website and publishing interviews on the website...I want to know whether I can publish interview that have been taken on some other website?? I have taken permission from the interviewer...Does Interviewer has the rights or interviewee should also agree to it??
