Legal notice

Dear Sirs/Madams,

I had a HDFC Credit Card which expired since last two years. i had purchased Rs.18,000/- rupees vide that card. But unfortunately i failed to pay that amount due to my financial problem. After 4-5 months i got a call from HDFC Card executive regarding the settlement & i agreed their settlement amount for Rs.28,600/-.

In August 2014, i have cleared all the settlement dues.

But 01 month ago i came to know that my settlement was cancelled due to payment was not made in time.i shocked & called to HDFC People, who told me that to resettle the card.

I was refused to pay because during the settlement time HDFC Recovery Team were attached with me each n every time & never aware about this to me.

Recently i have recived a letter from HDFC lawyer saying that they will put a case against me.

Please advice me Sirs/Madams what to do as i have already paid all the settlement amounts.

Kindly reply.

Regards,
Soumyakant.

Civil/summary suit

"A" a Co. has failed to repay the amount of goods, which was sold by Co. "B" in the year 2011. Co. "B" has send the notice in the year 2013 for repayment of goods but Co. "A" has replied through its advocate and did not paid any money. Period of 3 years for filing the suit is counted from expiry of credit period given to Co. "A" which was expired in the month of November, 2014.

1. Co. "B" shall count 3 years from the date of receipt of reply notice from Co. "A's" or expiry of credit period given to Co. "A"?

2. Can Co. B file the suit now by filing the condonation of delay application?

Can a daughter purchase her fathers tenanted property directly from her father

Sir,
I am a landlord of a property in Mumbai. One of my tenants is staying in my property since last 45 years. He has two married daughters who are not living in Mumbai. Now due to age the tenant wants to shift to younger daughters place and purchase a house there and live. He approached me to surrender the tenancy rights to me. A sum was agreed and the premises were to be vacated. Now I have come to know that the elder daughter wants to pay the sum to her father directly and then get the name changed from me without paying me anything.
I want to know that whether the daughter can purchase the fathers property directly from her father. secondly can this be termed as sub-letting.What should be my action if this kind of transaction takes place. Will I be compelled to change the name from tenant to his daughter.
Please advice.
Thanking you in advance.

Need help in understanding property share to my aunt

Hi Experts in here, need you help in understanding property share to my aunt.

We have a property which is ancestral, my grandfathers father property.
my grandfather had 4 sons and 2 daughters.
my father is 2nd son.

one of my aunt has put a case. The inputs are

1. Propery is ancestral
2. My aunt is born before 1956
3. My aunt married before 1990

4. Case is in Karnataka court filled in 2011.

5. The property was made partitioned among sons by grandfather when he was alive in favour of sons in 2001 because their was no opposition by both my aunts during that time.

6. My both aunts has not put a signature in the participation documents.

7. one site each was given to my aunts but was not registered by my grandfather to them. One aunt sold the site to my dad brother on mutual understanding and another aunt who put case sold the site to someone else through my grandfather making signatures to seller directly and also her brothers. the site which inturn again purchased by same my dads brother . This happened before the case was filed.

All was well, until, there was some family disputes recently which triggered my aunt to put case on us.

All experts. need you opinions in out come of the case.
