How to get compensation for damaging vehicle at fiat authorized service center?

Hi,

I booked Fiat Linea T Jet (Petrol) Car on 26/12/2010.The car costed 10.25 Lakhs on the road. I got delivery on 06/01/2011. On 22/12/2014 I felt some vibration while driving the car. Immediately I took car to Fiat service center. After repair when the Service supervisor switched on the vehicle heavy sound came from engine and car was went off. Then car was not switching on. When they opened engine, found piston broken inside the engine. The car was only ran for 17,000 Kms only. Now they are trying to get the engine replaced from Fiat without any cost. But They are telling that the warranty is finished. So I want to get proper compensation. I had done all the maintenance schedule as per fiat. What to do?

Rights of tenant in pagdi system

Hi All,

My Father have a shop on pagdi since 1985 and now shop owner want us to leave this shop. We have all rent receipts only from 1985,not any other document and from last year he is not taking rent we tried many times.

So please advise me somthing as I dont want to leave that shop bcoz we don't have other options.

Accidental injury at work-place

An individual in a small organization for more that one year. She gets her salary monthly by voucher. She wasn't given any contract to sign at the time of appointment. If she doesn't go to work for even one day, some amount of her salary is reduced.In November, she fell down the stairs while at work and suffered a fracture of the femur bone. The treatment required immediate surgery and three months of complete bed rest. Now, its been about a month and a half that she has been at home. My question is, is she entitled to any kind of funds for medical treatment from the organization she works for or at least her monthly salary or both.

Resignation and relieving

Dear Sir,

Greetings From Shivarama M

I submitted my resignation on 12-Aug-14 by sending formal email to HR and worked till 25-Oct-14 in a reputed company.

The appointment letter term says, “If I should leave the Company’s service without notice, I will be liable to pay to the Company a sum equivalent to your one month’s Consolidated Salary or I will be liable to be sued for damages.”

My Designation is just an Executive.

Reason for resignation was: I have got some personal inevitable reasons which need to be attended with due care and concern,

HR knew I was constructing a house, travelling from a long distance and had some unrest in family.

I was ready to pay 1 month salary instead of 3 month notice period but they did not agree with it. They wanted me to be retained.

I tried my level best to wait till the new joinee comes and I postponed my relieving till 25-Oct-14, 4times.

I spoke to HR several times and spoke to the MD 4 times to relieve me. I Mailed even to MD as well explaining my condition.

By end of Sep-14 MD told if I want to leave I can do so but my consciousness was not willing to do it because there was no reliever. They were intentionally delaying the replacement.

Meanwhile, I referred 7 candidates as per HR instruction and 1 one of them was reported to work on 17-Nov-14 who actually interviewed on 3-Sep-14.

I had to stop going on 25-Oct-14 (after 2 months 13 days of my resignation) as there was NO candidate appointed till date and did not have any confidence of relieving in 3 months and I had to concentrate on my person life more.

Now they are saying they give me relieving letter saying “absconding” and F&F is subject to clearance of due notice period which did not happen in my case.

They did not pay me October 2014 Salary, after deductions it comes about 20,000/- .

Prior to this incident I resigned once on 1st Mar 2014 as I got some good offer. They retained me saying they full fill all my demands (no mail confirmation) but noting was done unfortunately.

HR never replies or responds any emails of resignation utill it is escalated to Md.

So now, kindly suggest me how to deal with this.

Divorce

Hi

My wife and I have lived separately for over 5 years. I returned to India 5 years ago, while she continues to live in USA. We have 2 adult daughters who also live in the United States.

I filed for divorce by mutual consent, in the USA in October 2013. It is still pending. She is giving me a hard time, refusing to sign the divorce papers served by the court, unless I agree to give her the entire property. (When we agreed to the terms of our divorce, the house was to be 50-50)

My question is: we were married in India in 1984. We migrated in 1995. We hold Canadian citizenship and are permanent residents in USA. Can I (and will it serve me better) file a divorce in India? Will she be obliged to come here for court hearings?

I would like to understand if there is significant benefit (to me) in doing this in India, as not will it save me the higher legal costs in America, but also help to speed up the divorce?

FSL vs private expert

My question pertains to two conflicting reports regarding an alleged forged Will. I am the complainant in the case. The trial Court Judge ordered the Forensic Science Laboratory to send a report on wether the said Will was a forgery. I gave original documents including passports etc of my Late father which were duly excepted as genuine by FSL. The report was received in the trial Court and Will was deemed not bear my Father's signature by FSL. Afterwards the accused party hired a private handwriting expert who using different signatures (which are fake) from the electricity board made another report claiming the Will to be genuine. My question is which report should the trial Court except if any? Thank you for your time.

Property issue

Hi Experts,

This query is about my Mom's property. My Maternal grandfather had 2 wife's & 4 Daughters(1 st wife children). My mom is 3rd daughter out of four.

second wife had no children & she adopted my mom as her daughter. entire property belonged to her (land & house). half of the property was shared to my mom through WILL.
Remaining half was shared to her husband(My maternal grandpa)

Grandpa transferred that property to his 1st wife(maternal grandma).
Grandpa:Expired
1 wife: Alive (who has half property now)
2 wife: Expired

My query is, after the death of grandma is that property belongs to other 3 sisters of my mother or my mom is eligible for claiming that property. As the property belonged to grandpa's 2nd wife who adopted my mom & declared as her daughter.

Kindly guide me & clarify my doubts.

Jurisdiction of filing recovery suit

My Boss is a businessman in kolkata he supplied goods worth Rs 16 Lacs to a client in Satara a district near Pune. The client issuied post Dated Cheque worth Rs 8 Lacs. Cheques got bounced. We have filed Sec 138 case in Satara. The client sent a notice to us that we have used blank cheque and material was not delivered to him. Since we have sent the goods by Door delivery system we have all the necesary documents.I need to file a recovery suit against the client for whole amount i just want to enquire the jurisdiction where i should file the case and please also advice me for any alternative legal advice.
