Sir, I am(23years) a juvenile(16 years) accused for 376(f) in the month of may 2008.In the year 2011 the trial court sentenced 1yr imprisonment and sent me to a special home when i was 19 years.Since trail court ruled out the conviction with out the arguments.We appealed to Additional sessions Court.I am out on bail, completed graduation and currently working with Dell computers. The case is still in trial at ADJ court. There are three questions i have kindly help. 1)If i gets convicted now, do they send me to special home or adult prison. 2)Is there any chance for me to get acquitted considering the merits(work experience at MNC, graduation certificate etc).3)Do you think i will get passport because under passport act a person is not eligible to get passport only if he get jail term of 2 yrs and more?

I had a love mariage 5 yrs back at Ambala (haryana), we both were working at Gurgaon and last year my wife moved to bangalore(from her company side) as our relation was not going good , we had fights on multiple homely issues , now few months back she filed a divorce case , i went there and mediation was setup in which she demanded the things , i agreed on it , but there was one flat(at Bhiwadi Rajasthan) issue stuck which is in name of both ,initial amount was given by me and loan payment is going from her account to bank , she was/is in favaor of taking the flat , i said just hav a agreement (u will just give my cash amount and initiate the transfer process, and i will be available for transfer process, In the last she didnt agreed on it.
Now there was last madiation date on 12th Jan , i didnt went there adn my lawyer has informed me that file went back to the court.
* Kindly suggest me please to release from this. to get divorce asap.
* Also what court will do now.
* I went thrice there only after her confirmations and she changed her statements in front of madiator in terms of demands.

As per above link shdould i request to transfer the case to my state/City. What expenses will be charged , should i go for it or not.
*She can do anything else like fake cases lik dowry and all as she has already given the fake statements that her mother took mloan for 14-15 lakhs for mariage expenses.

Dear Sir,
i owned one civil case which is related to
one common passage.
Court order mentioned that other party can go
for appeal in higher court with in 90 days.
now other party has filed an appeal in higher court.
So can the judgement be reversed in thus appeal by higher court.please advice.
please guide me.

There is a sort of chaos in our surrounding colonies. About 91Acres was land entrusted to a society 4 decades ago. They managed sale deeds for total extent of land equaling 130 acres. Multiple registrations for some lands is the phenomenon here. Aggrieved parties are fighting in the courts. Political involvement created worsened the situation. Out of court settlements and coercions take care of interest of the powerful (money and muscle). Many have given up the battle out of fear and come to terms with such atrocities.
In the 1980s Gram Panchayat was functional. Urban Developmend Authority had drafted a layout earmarking residential plots and public amenities like parks and play grounds. Metropolitan authority took over Urban Development. Municipal council took over Gram Panchayats.
Now, parks are being encroached. High rising buildings are coming up at a rampant pace.
I filed an RTI to seek the layout available with MDA. They gave one which is last approved in 1997, but, it is only a grid map with roads. No parks and play grounds.
I filed an RTI with the state information commission, state legislature, regional municipal council, town planning department to obtain a layout that shows the public amenities.
The municipality writes to me that they do not have such records. I wonder on what basis they are sanctioning construction of apartments. Every builder has a way to produce link documents and get LRS done according to his needs. The other recipients of the RTI applications have written to the municipality with a Copy to me seeking immediate action on the application.
This is a case of gross negligence by municipality.
Now, my question is which is that authority that can pitch in and set right things and do justice?
It is ridiculous to note that an entire residential area sans a master plan from municipality.

I was not sure under which legal section this query may be asked.
There is a guy in our neighborhood who runs a Counseling center.
Services advertised are Psychiatry, Indian Psychology, Yoga, Personality Development and a host of services that would attract a gullible common man who is keen to get rid of his/her sufferings.
His organization is not registered, neither he is certified in any of the above faculties. He is only a post graduate in commerce and recently flunked in a post grad course in Psychology.
He gains lot of popularity through usage of stray terminologies in Vedic scriptures. He is incapable of elaborating on these terms. A brief synopsis of Bhagavat Gita is all that he mastered.
For a person suffering from any psychological disorder some of the verbose he uses may actually give comfort. Unfortunately, a better researched option that could have been administered by a true professional will be a lack to the seeker.
However, I noted that in order to gain more power and popularity he manipulates situations such that the innocent client believes that a treatment is imminent with him and end up shelling huge amounts as fee. these days he reduced his charges to increase client count. Earlier, he charged between 30k to 50k for a 5 day counseling package.
There are occasions when he tries to convince an otherwise normal person to undergo treatment with him.
My pity on him is that he recovered from a disease called polymyositis that destroyed his health totally. After a decade and a half of steroid treatment he is now in remission. He uses his ailment to gain sympathy from his clients.
End of the day, I feel that his lack of professionalism and greed for name, fame and money may cause irreversible consequences to his clients. He is also registered as doctor in some of the websites that fix appointments for him. He never gives a bill to his clients nor pays up taxes.
He associates with spiritual teachers and gets himself photographed along with them show cases these photographs and testimonials, which is another way of wooing clients. I saw him paying money to an organization that does Sanman functions. He received shawls from people in the higher echelons many times. Even Governor of a state felicitated him. This Sanman company charges a fee to get this done. Perfect marketing and advertising.
He has a certificate pasted on the wall which is duly signed by Obama. This he acquired for 50$ through an agent in the US.
His ways of attracting clients is by deceit. His treatments are not proven. His income is unknown. He has no statutory registrations and bindings. He is a classic case of a quack, a self imposed Baba.
Whenever, there is dissent from an aggrieved client he manages to push the conflict under the carpet and sometime settle with the warring person through monetary compensation.
I was shocked when he suggested a full term pregnant woman to do Bastrika yoga (the process of pulling your stomach inside with force and exhale). The lady did not cooperate though.
When science is so advanced there are many innocent people who fall prey to such quacks. Very rarely a complaint is lodged in these circumstances.
Reasons why legal recourse is not taken.
1. a complainant would feel embarrassed to expose that he/she sought help from a quack.
2. Building evidence is impossible.
3. When conflicts are settled within the four walls people bury hatchets.
Everyday we see at least one baba coming to limelight and these days even on account of notoriety. There is absolutely nothing in the society to check the trend of dangerous healers.
Is there any legal strategy that can be employed to nip the bud in this particular case.
What is role of MCI in ascertaining researched, standardized and professionally enriched therapies are made available to the citizens and not those that are unscientific, irrational and idiotic? There are many alternative medicines which are based on a certain schools of thought, purported by research works et al.,
In this milieu faith healers and pseudo philosophers are making merry. They think they pose a challenge to scientific spirit. Never do they discern that scientific spirit is actually spiritualism of the highest order. I was terribly irked when a Guru exclaimed that Scientist may find the God particle, but, will fail to understand the gap between these particles. It is only "Atma Darshan" that will enable one to see this gap.(What nonsense?) Immediately, the thousands of devotees clap in unison. An Asylum is a better place compared to this Guru Sishya Parampara. There are really good philosophers and the above illustration is not to be attribute to such noble souls.
I wanted to file an RTI application seeking veracity of services by this organization. But, I do not know which department of the Government is responsible in controlling such malpractices. These treatments are more dangerous than female feoticide. They dislodge and disintegrate ones psychological framework, transfer lot of money from the seeker to the healer.

A hindu father acquired property by his own independent sources. He alinated that property. He made 3 parts of that property under which 2 equally valued shares he distributed among his two sons and one large portion of property he kept on his name. He recorded all transactions in ROR. At the time of distribution of property no son of his was bachelor or issue less. One of his son sold his part of share which he received from his father. After 15years the sale is challenged on the grounds property is hindu joint family property and ancestral property. What is legality of this situation. Will this suit is maintainable? Will they get success? If yes how if no how please provide suitable rulings with it. Please guid me in this sir.

My Grandfather(My dad's father) own a house and one empty land in our native. My father has one elder sister and younger sister. Both got married and my father's younger sister is staying with her husband and children.His Elder sister died before 15 years. Recently my Grandpa passed away and then comes the problem. My grandmother and grandfather is fully taken care by my father alone. Now my grandma used to stay with us and in her home alternatively.The house which was built by grandfather got old and its condition is too worse. so my grandma and father has decided to rejuvenate the house. Now my younger aunty is asking for equal share in the house and the empty land. my father is ready to give her share in property.My grandma's wants to live in the house which is build by her husband (my grandpa) till her life ends. Because of that we were forced to recondition the damaged house. We have clearly told about all these things to my younger aunt. she is not letting us to start the house work and she is torturing my grandma to vacate the house and divide the property.my dad spoke to her and asked to her share the amount which will take to recondition the house so they can equally share the house. But she is not ready to spend even a single rupee. One more thing My grandpa while he was alive he has undergone so many surgeries and treatment,all expenses have been take care by my father and my grandma's expenses too. while they were alive not even a single time my younger aunt has come and saw my grandparents when the got medical issues and didn't spend a single rupee. But after my grandpa's death she started torturing my grandma and my father for the property. she is also threatening my grandma to give her jewels.My grandma is not all interested to give the share to my younger aunt instead she is ready to give the property to orphange. in what way we have to proceed . Pls do give some suggestions.

Banking service related case
I Krishna Mahato was Assistant Manager at Uco bank Gorwa Road branch Vadodara Gujarat. I joined Gorwa Road branch Vadodara on dated 20-09-2011. Some restaurant owner and some holder of savings account together the ATM fraud by visa debit card and swipe machine. The bank filled a FIR on the relevant person. Fake account to a savings account when the police inquiry was recorded telling me the case. Fake account saying the police had registered a case on me that in fact the account is real.The account hasbeen opened according to the guidelines of the Reserve Bank Of India. I sent in judicial custody by the police registered a FIR case. i judicial custody case being filled and the bank suspended me. I had filed a quashing application in the high court ahmedabad against the FIR, high court Ahmedabad stayed order in my case. By the high court Ahmedabad stayed order my case i have a copy however bank to bank but not revoke my suspension. Date of the final hearing in the High court Ahmedabad of yet i have not found. What should i do to please guide and suggest me the right path. Please guide me the right way so i can get my job back.
