Transfer of property...

Dear Sirs,

My mother has obtained a property through WILL from my father. The property was given for development with a registered agreement by my father with a Builder and is still in progress. Now the question is:

1.can my mother(who obtained the property under a unregistered WILL) and the builder transfer a part of the property by way of sale , still under construction??( though mutation in my mother's name will take place only at the time of handover by the builder which may be 3-6 months from now)

2. If a property under a WILL goes to 'B" from "A"the deceased with absolute rights to "B" and under the same WILL subsequently on the demise of "B" the property goes to "c" with absolute rights-
2a.)Can "C" exercise any legal right over his future share during the life time of "B" for the property ",by mutual consent with"B"??

2b). Can "B" in the above case execute a WILL and give the property to "D"on the demise of "B" instead of "C" though the intention of "A" was to give "C" after "B"demise??

Pagadi system

We are tenants in old building before independence on Pagadi System from more than 50 years. We knew who the owner was till 2004 and were promptly paying the rent to him against rent receipt. Thereafter could not pay the rent as we did not know who the owner was. Now the owner comes forward saying that he is the owner from 2008 but does not show the documents to prove that he is he owner wants to demolish the building through BMC mentioning that it is duplicated building. We tenants filed a court case where it was conveyed that BMC should do the structural audits and give notice individually to the tenants and pull down the building with 7 days and the owner or the builder from the either side to give flats to the tenants with shifting. But now the owner wants his builder and says that would give flat but no shifting and no agreement as the case is with the court. Also yelling at us that why you guys went to the court, now face the consequences. We have also send rent cheques to the owner through a lawyer for 2008 – 2014 but would not accept the same. We are confused as the tenants what is to be done. There are many questions which are unanswered. Where should we go if the building is demolished and no shifting given?

Kindly give us your advice.

In Pagadi system are be liable to get flats if the BMC pulls owns the building.

Are we liable to get shifting and agreement before demolishing the building?

What is the right procedure if the building would be demolished by BMC . Would we get flat from owner?

Thanks & Best Regards

Distribution of property as per sharia (islamic law) as well as indian law.

Dear Sir/Madam,Good day..!!
My Grand Father (Nana) had three issues one Son and two daughters at present their ages are son 69years old daughters 64 and 62 years old.
Son is settled in U.S.A. from last 47 years with his family. He is green card holder of U.S.A.,Grandfather has provided money to him for his studies in U.S.A. but he has returned the same after some years after he got good job in U.S.A.
Our grandfather expired in the May 2001, and grandmother (Nani) expired in November 2013.
My mother and her sister had taken care of their parents till their death. In this period my uncle (Mama) used to send Rs. 2000/- to Rs. 5000/- per month to his parents.
My Grandfather had one house in Village and two farms on hills near the village and some cash.
In year 2000 our Grandfather had officially transferred the Village house to the name of two daughters (my mother and Aunt) equally and also transferred one small farm with house to my mother and another big farm to the name of my Aunt.
After the death of my Grandmother in November 2013 my uncle (Mama) and his wife came from U.S.A for two weeks. His wife claimed that all property (House/farms/cash) should be distribute to all three issues as per Sharia (Islamic law) mean 50 % to Uncle and 25% each to my mom and Aunt.
We are confused by her behavior because the house and farms are officially transferred/distributed by my grandfather to my mother and Aunt.
Please help us to solve our problem as per Sharia (Islamic law) as well as Indian law.
Thanks and best regards.
