right of married daughters in father's property and assets ,if father has passed inestate(without nominee or will) in the state of karnataka
i need some clarification with regard to the my fathers self earned property or asssettes
facts as fallows
a) i married in 1998, living with my husband & one daughter
b) my father died two year before my marriage ( in 1997) & he had self earned few property & one business firm now looking after my brother
c) my mother alive & with one brother ( married ) living with him
d) now i need to know what are the rights on my fathers property till today ( what is the my share on the fathers self earned property & on his business firm)
please assist me for my better knowledge & feature plan of action

opposite party is not giving reply of 340 from last seven months i asked number of times can i move an application for seeking reply it will come on record under which section it will be moved

Dear Ld. Experts,
Can anybody of you please let me know that whether telephonic conversation is a legal way of service to respondents as although I did not get any notice related to DV,in the order sheets of lower courts it is written that respondent mother seems to have telephonically had word with respondent son on this.
Any ruling from SC/HC to support that this is a bad/acceptable way of servicing summon/notice, that will be really helpful.
Kindly see.

I have filed an eviction petition on my tenant on bonafide need for my son. i have given a notice in the year 2000 but filed an eviction petition in year 2003 because tenant is my close relative, so i tried through relatives that without going to court, he vacates the premises but the negotiation failed. so it compel me to file an eviction suit in year 2003. Now he has produced the PAN No. print out taken from the internet and tried to show the that my son is not employed. My lawyer said holding a PAN card in 2014 will not affect you but have to prove that your son doesn't have the income when bonafide need is arise. Please tell me which date is to be considered for my bonafide need i.e. date of notice or date of filing an eviction suit. Please reply me urgently.
My husband bought a plot in chikbellarpur (Bangalore)3 years back for the purpose of investment. We have not got Khata no. till now. As we wanted to sell off the plot we contacted the seller for the same. The seller is demanding Rs35,000/- for giving us Khata No. We decided to pay the money but before that we asked a local person to go to municipality (BBMP) of that area to check the same.
Now, that person has informed us that the plot has not been yet converted to residential plot. It is still in the agricultural land.
What can we do now?? Experts Pls suggest..
i have been posting my queries on this same matter for many years now but i always get differentiating replies.
myself and the girl i want to marry fall in family relations. i have studied online a lot about the hindu marriage act 1955 and the details of SAPINDA relations and prohibited degrees.
we ( me and she) have a common lineal ascendent- 4th generation in my case ( my paternal great grandfather) and 5th generation in her case ( her maternal great grandfather's father).
in simple language- my father's father's father and her mother's father's father's father are the same person.
i think on my paternal side it falls within 5 generations but on her side it is out of 3 generations.
does this relation come under sapinda relation or prohibitive degrees ?
need an expert advise.
Kindly intimate that I have purchased a new car from Maruti suzuki, Panchkula recently and the car insured by National Insurance Company with Bumper Insurance amounting to Rs. 10,998/- and within one week of insured car modest hit by a colony gate. I have contacted Maruti suzuki workshop for repair/maintenance of modest damage. The workshop official called insurance agent and the insurance agent demanding 1000/- as processing fee. I have requested time and again that the car is insured with Bumper Insurance (above from first party insurance. But the agent intimate that you have to pay 1000/- as processing fee and intimate me that IRDA has issued notification about the processing fee of Rs. 500/- to Rs. 1000/- recently.
Q. If the car is insured with Bumper Insurance from National Insurance company then why the insurance agent demanding Rs. 1000/- as processing fee. because I have already paid Rs. 10,998/- of Bumper Insurance.
Q.2 Kindly intimate by way of instruction issued by IRDA about processing fee of insurance agent of Rs. 1000/-.
Q.3 In any such condition what steps can be taken to avoid to these charges.

I am selling a house capital gain is 60L I am buying another house of Rs 50 L. 10 L Tax saving bond buying I have planned. Is it possible to invest both in House + Tax saving bond from single house's long term capital gain.

Sirs,
My mother has bought one property out of her funds adding my name as second. I have not paid anything. There is ongoing dispute with my wife for last 8 years.
Will my estranged wife be entitled for the share in the property of the mother which in our joint name (mother and me as said above)in case I die.
Plz help as how to avoid going property to my harasser (estranged wife) in case i die.

Dear legal experts,
Please help me with this property issue by giving your valuable legal opinions.
I stay in Bangalore.
My father had purchased 3000sq.ft house about 40 year’s age.
Since the house was narrow, house was made 2 partitions of 1500 sq ft each. In one portion my father lived and my father let his younger brother and his family to live in other portion.
My father expired 3 years back and we 3 children (me and my 2 sisters) are legal heirs of this property. Hence we will be getting equal share in that property.
Now the problem is, my father’s younger brother still lives in that portion, which was given to him 40 years back. Now we asked him to vacate that place . But they are refusing to do so saying that now that property belongs to him as he is living there from 40 years. Now even he tells that , he has also has invested in that property.
When we asked him documents(agreement b/w him and my father) he said no agreement was made and there are no documents for what he said .
But all legal documents ,titles , etc are my my fathers’ name.
Actually due to his poor economic conditions my father let him to live there.
It’s been 3 years we are asking them to vacate that place. But he is refusing by giving false statements and reasons. Even my mother passed away a year ago.
Now I and my sisters have decided to sell that property and share amount among ourselves. But they are not giving us that property .
Please help me in this regard.
