Certified copy of consumer court order

I had filed a compensation claim against builder in Guwahati Consumer Court. It was later withdrawn and the judge recorded it as 'dismissed as withdrawn'. I went to the court to get a certified copy of the court order. I was told by the clerk that I have to give petition in a court petition paper. I want to know 1) whether I can give the petition in plain paper, 2) Can I write the petition myself in a petition paper without a lawyer?

Need views - sec 8 of hindu succession act 1956 wiping out the term ancestral property

Hello Sir,

I studied the Sec 8 of Hindu Succession Act 1956 related to one of my client's case. As per this section the property which Hindu person's legal heirs get after he dies interstate it becomes personal property of the legal heirs mentioned in Class I.

Hence it means whatever property is left by a person after his death to the next generation after 1956 will never get the character of "ANCESTRAL PROPERTY".

So does it mean the concept of ANCESTRAL PROPERTY as per Hindu Law is getting indirectly wiped out due to this section 8 of HSA?

I would specifically like to mention the following:

In Mulla's Hindu Law, Twentieth Edition, VolumeI, Chapter XII - Mitakshara Law the principles of the ancient settled uncodified Hindu Law are succinctly enunciated. The principles may be enumerated thus:(i) The property inherited by a Hindu from his father, father's father or father's father's father is ancestral property (unobstructed heritage as regards his own male issue). page 357

Views from experts in this forum will be highly appreciated.

Thanks
Jaya

Time barred appeal under mp land revenue code whether condonable under limitation

I applied to SDO for diversion of my agricultural land. One person objected stating that he has a right to purchase this land from me under a disputed and expired MOU. This was rejected by SDO and diversion approved on 27/8/14.
With a certified copy dtd 3-11-14, objector filed an appeal on 16-1-15 with application for condonation of delay u/s 5 of Limitation Act. Reason cited is that I was assuring me of not using the diversion order and hence, he did not file apeal.
I want to know whether Collector under Land Revenue Court is empowered to grant this application, and whether Collector would be considered as "Court" u/s 5 of Limitation Act. Time limit for appeal is 30 days from date of order only.

Property through monthly chit fund

Dear Legal Experts,

I paid around Rs. 90000 for purchasing a piece of land ict, in Udankudi , Tuticorine district , Tamil nadu throubg monthly chit fund scheme. from a real estate agent. I am from Tirunelveli district, Tamilnadu. I could not register the purchasing due to some problem. Now I have urgent requirements for money. I requested the agent to return the amount I paid so far. But the agent says he will not return the money and I will have to register the purchasing of land on my name. He says the terms and condition now. Earlier when I joined the scheme. I was not told about these terms.Neither I have signed agreeing for any such terms & conditions.
My question is that is it legal to refuse to return the amount to me if I dont want to purchase the land now. Can I approach consumer court to get the amount returned to me. or Can I approach local police Station to get the money back. Can I write an application to DIG of the both the district. Will it work

Thank you verymuch

With regards,
M Kailasam
