Human rights

hello sir,
my query is on a moot problem. Please help me to solve this problem.
Mr. Ram Kishore an advocate by profession. He fought for the protection of human rights in rural areas of Nalgonda District. He raised his voice against illegal sand lifting in the lakes and rivers and he also filed a Public Interest litigation seeking direction for the prevention of illegal sand transportation. The local area people appreciated his efforts in focusing the issue of illegal sand transportation. While this remained so, Mr. RamKishore was appointed as Commissioner for State Information Commission. Mr. Ananth , an engineering graduate heard about the social work of Ram Kishore and started agitation in public and further unearthed the men involved in the illegal sand mining activity and demanded the police to arrest them.
On 25-1-2014, Ananth, Vamshi and Mohan along with others blocked the roads leading to hospital and school zones . Police informed them about the difficulty to public by their activity and asked them to go away and clear the way for traffic flow. Ananth and Vamshi refused to listen to them and then police lathi charged and took Ananth and Mohan to Police Station and later released them. Some of the parents Association of the Schools posted mails on Social media about the inconvenience caused to the school children on the day of the road block.
The following week, they sat in front of the Revenue Office and obstructed the work of officials. Then the police arrested both Ananth and Vamshi , and later released them on bail. A few days later, Ananth approached State Human Rights Commissio [SHRC] and complained that he was subjected to torture and humiliation in the Police Station and he sought action against the police. As the matter is pending before SHRC , he filed a writ petition before the High Court of Judicature at Hyderabad for compensation for Rs. 5,00,000/-.
i want to know the pleas which can be taken against the respondent. Please its urgent sir i want it as soon as possible.

Associated membership

Sir,

My understanding is that an Associated Member as per Maharashtra CHS Rules has to be a joint member and his/her name has to appear 2nd on the share certificate. He/she can participate, vote and/or join the Managing Committee subject to 1st Member surrendering the rights.

Latest News Paper article says even the non-member can be a Associated Member provided the required form on Rs.100 stamp is filled and duly signed by the Member of the Society. If this is true can such a non-member whose name does not appear on the Share Certificate join the Managing Committee and whether he/she can have the voting rights.

Please clarify - Thanks Roland Noronha

Builder is using his power and trying to construct flats in the place which is for stilt parking

Hi All,
We have purchased flats in the Kalyan, KDMC area and at that time the builder had committed many thing verbally as well as some in written but could not deliver the same.

After lots follow ups with him for the CC and finally he gave us the same after 2 years. In the CC its clearly mentioned that the ground floor is for stilt parking and each floor has four flats. He is also staying with us. What he had done he had merged the two flats and make it one which is against the rule of KDMC.He is not paying maintainace for 2 flats, he is paying for one flat only.

Now he is planning to construct few flats in the 50% area of the ground floor which is for stilt parking. We have complained in KDMC but no action from them.

Its five floor building.

Even he had not give us enough water supply(only one line), even the water connection is in his name.

He is not ready to form the society for which we all the flat owners have applied for a non-co-operative society.

He is not a registered builder and now after 3 years he is asking for the VAT and service tax. He himself is not paying any tax.

Please update what is the option we have so that we can fight with the builder and get our rights.

Transfer of property to legal heirs

Hello. I have a query.
I stay in South Mumbai as a tenant under pagdi system law.
We have four rent receipts out of which three are in the name of my mother and one in my name of father who had deceased 13 years back.
Now, we want to transfer the three rent receipts in name of three sons who reside in the same house (one receipt which is in the name of late father and other two which are currently in the name of mother).
However, the builder is asking for a huge sum of money for doing so.
So, i want to know whether we can transfer the rent receipt legally or no and what would be the expense for doing so and do we need to pay any charges to builder for the same as we are not selling the property but only transferring it in the name of sons from their parents who are also the legal heirs of the property.
We are transferring the same as the building is soon going to be redeveloped and as per law we do not get any extra benefit if all the rent reciepts are in name of mother and father.
However, if the rent receipt is in name of sons then we get 400 sq ft for each rent room having different receipts.
So, also advice if transfer is compulsorily needed to get extra benefit during redevelopment .
Also let me know the relevant acts, clauses and sections pertaining to the above query.
Kindly note that our ration card is currently having a different address and not the address of the said premises mentioned above.

Thumb impression instead of signature due to illness

My father is 72 years old who could put his signature earlier on legal documents, But now since he is paralyzed he can't sign and instead prefers to put his thumb impression instead of signature. He would like to use the thumb impression on all legal documents in the future to prepare his will.
What is the procedure to get this thumb impression legal as at present we are facing some issue to open a demat account to trade shares where he used his signature earlier about 12 years ago.
Please advise on this which would of great help.
