Appeal in divorce cases

Dear Sir,
What is the proceure of filling appeal in high court against family court decision in divorce case by aggrieved party.
suppose if family court has given decision in 2 years of filling the divorce case and party has appealed in high court then is there any time limit within which it will be disposed off or will the case will run again for 2 years as per family court procedure means again full fledge trial process will be followed.does every appeal is accepted by high court or there are any parameters for acceptance of appeal.

Whether insurance company is liable or not?

Respected Experts,

"A" is the registered owner of a car. He took insurance policy during his life time. On demise of "A", vehicle was transferred in the name of son "B" and the same was duly intimated to the insurer.

Recently, car met with an accident and damaged. "B" sought for insurance claim. But insurance company repudiated the claim that the registered owner differs and policy stands in the name of previous owner.

Whether Insurance Company can absolve its liability in the given facts of the case?

Whether B has any remedy?

Pls answer my queries.

Company is not giving acceptance on my resignation

-I worked in organization for 5 yrs.I resigned from this organization because i got new opportunity.

-I have to serve 2 months notice period so after 1 month i went to HR for acceptance of my resignation.

-HR refused to send and told me that you have to give 3lakh to company as i was on official work in abroad 2 months back for 3 weeks only.

-They are taking this recovery amount on the basis of my appointment letter where it is written that "If you are going abroad then you have to singed a bond in which it is written that you indemnify company against all claims if bond is not signed for whatsoever reason then it will be deemed signed."

-But there is no timeline defined and now they started signing bond if a person is going abroad.

-On my last day they signed clearance form and disabled my access and IDs.When i went to HR for acceptance mail he refused and told me to give cheque of 3 lakh then only he will give me acceptance and reliving letter.and still they refused to give me in writing that why i have to pay this amount.

-So now i am out of job and dont have any proof other than emails that i am no longer employee of this company.

-My new employer wants reliving letter or at lease acceptance letter.

Please guide me what to do as this is destroying my career.

Leave & license agreement - registration

Dear Learned Experts,

The query is that whether registering a leave & license agreement compulsory in India in the following case:

I have a commercial premise in Mumbai which I want to give on leave & license basis for 3 years at a monthly license fee of Rs.50000/-, Deposit amt to be Rs.NIL. Thus according to new stamp duty rates, the amt will be Rs.4,500 (@ 0.25%) & registration fees will be Rs.1000. (this fig. calculated by me on igrmaharashtra website)

Now is it that registration & payment of duty both are compulsory for me? Kindly give your reply as per the Registration Act & Stamp duty Act.

Also if I make a Leave & License agreement on Rs.100 non judicial stamp paper & register the agreement with the authorities by paying only the registration fees of Rs.1000. Will it be fine?

Stamp duty waived off on transfer of property to blood relatives

Dear Learned Experts,

Background of the query:
On March 25, 2015, revenue minister have waived off stamp duty on transfer of immovable property to blood relatives which was earlier 5% or 2% depending on whether it is ancestral property or not. The query is as follows:
1) From when will this amendment come into existence?
2) Is it enough to do so just by making a gift deed & registering it on a Rs.500 non judicial stamp paper?
3) Is it applicable for Commercial Property also? Or only to land & residential property?
4) Is the registration as per Registration Act still required? (I think it is)

Appeal after convicted

Sir,

My brother met an accident on 28.07.2009 now Driver of bus convicted under IPC -279/337 by fine only and under IPC-338 - Not convicted. So Can we appeal against judgement , if Yes then where means in session court or High Court.

Unmarried women employee has been confined by parents

A unmarried women employee aged around 24years has been confined by their parents since 15 days and planning to perform marriage against her will.when her colleague approached police they are not entertaining the issue.please suggest proper remedy.

Theft

Hello Sir/Madam,

I have recently faced a theft in my hostel room.
The items that have taken away are my mobile phone,laptop and a bag with some stationary item in it.
I have a CCTV footage recording of the theft.
I have lodged a complaint against it ion police station ,they make there inquiry and after all the things they denied me to lodge an FIR against it;even though I have provided them with the video footage.

I have all the bills for mobile phone and laptop.

Can you please suggest me what I can actions I can take to get my complaint lodged as an FIR.

Father died when all properties are in bank

My father is managing director of pvt ltd company.My mother also one of the director. The company has only 2 directors (My father,My mother).The firm took 23 crore term loan to establish a spinning mill in 2012 from SBI and previously they have taken 4 crore working capital for Trading in SBI.The loan sanctioned manager have released 3.57 crores and company invested 2.6 crores. The new manager came and stopped releasing of Term loan by showing that the firm not followed T&C.So the total OD in Bank 4 crore + 3.57 Crores (+interest).My father paid interest until 31-03-2014 for both loans due to pressure from Bank manager. After that we are sick to pay further interest and Accounts becomes NPA in 01-07-2014.We have all properties in bank as collateral securities around 15 crores.
My father died in Feb2015. We are in very critical situation Please suggest the best way get rid of this.
