Defamation

Hello Experts,

I have a query regarding the maintainability of a defamation suit.

I am a practicing advocate in Hyderabad and last week one of my client had faced an embarrassing situation in the hands of RTA(Road Transport Authority).

The facts of the case is:
My client is a reputed industrialist in Hyderabad and owns properties in Hyderabad.
Last week my client was traveling in Hyderabad City with his family in his personal car which is of Karnataka Registration and meanwhile in the road the RTA inspector stopped him and ask to show the car documents, obliging to his order my client showed all the documents and was up to the mark, the only fault was he did not pay the road tax, but on demand he even paid the tax on the same day.
Now the point is as the tax was not paid the inspector seized the car in the middle of the road and also used abusive language and asked my client to collect it in the RTA office after paying the tax and when my client went to the RTA office to pay the tax, the inspector again used abusive language and also hurt his reputation in front of other people present in the RTA office.
Now the point is can we file a defamation suit against the inspector as my clients reputation was hurt when the inspector seized the car in the middle of the road in front of the public as he was traveling with his family and even his family was made to get out of the car and also for using abusive language.

पाकिस्तानी पति से तलाक

सर मेरी बहन की शादी पाकिस्तानी लड़के के साथ 11 साल पहले पकिस्तान में ही निकाह और रिसेप्शन हुई थी . दो बच्चे हैं .लड़का बहन को बहुत मरता पीटता है अब साथ रहना मुश्किल है . बहन की नागरिकता अभी भी भारतीय ही है लेकिन दोनों बच्चे पाकिस्तान में पैदा होने के कारन पाकिस्तान के ही नागरिक हैं .बहन अब अपने दोनों बच्चों के साथ पिट छितकर भारत वापिस आ गयी है और वापिस पाकिस्तान नहीं जाएगी .भारत में रहकर ही तलाक़ का मुकदमा अदालत में डालना चाहती है .

please advice

* किस एक्ट की किस धारा में वाद फाइल होगा ?

* दोनों बच्चों को बहन अपने साथ ही रखेना चाहती है . क्या करना चाहिए ?

* बच्चे अभी लॉन्ग टर्म वीसा पर हैं और उनका दाखिला स्कूल में करना है . LIU वाले सलाह दे रहे हैं कि अदालत में तलाक का केस कर दो और उस केस की कॉपी हमारे विभाग में जमा करा दो बच्चों का लॉन्ग टर्म वीसा बढ़ जायेगा .
कृपया सलाह दें .

Is there a time limit(eg, 90 days) within which cross exam need to happen after evidence filing??

I am defendant and Plaintiff has given evidence in court in month of March 20. During last hearing of court i.e April 28, I took a next hearing date as i am yet to finalize my new lawyer. Now the next hearing date i got is July 20.
Is it fine that almost after 90 days, my lawyer will take a cross examine?
Is there any time bound within which cross exam needs to happen after filing of evidence or it will be fine to wait till next hearing?

Stamp duty- is a member trat as an relative for huf

An HUF consists of a Karta , his wife , his married son and 2 daughters - 1 unmarried and 1 married . The HUF property consists of mainly 1 main Immovable Property and other movable properties like bank accounts, bonds,etc. The main Immovable House Property is shown as HUF Property but is registered in the name of the Karta and his wife (as property can be in the name of coparceners. The Karta and his wife now wish to Gift or Transfer the House Property to their only Son who looks after them and the family. But there are some legal issues attached to it wherein help is needed:

a) As per amendement to Section 56 in 2012 a member of an HUF is treated as a "relative" and thus a Gift from a member to an HUF should not attract Tax. But does the other way around also hold true i.e. An HUF is also termed as a "relative" and can gift to its member and not attract Gift Tax?

b) for stamp duty perpose.....please guide me that an HUF is also termed as a "relative" and can gift to its member and not attract stamp duty as per consesional rate?

Pan in the name of executer

Clarification needed in respect of allotment of PAN in the name of executer of a registered WILL. Fact of the case:-
Mr. A executed a registered WILL giving all his assets to his four childrens.
In the registered WILL. He made Executer of the WILL to his brother till the date childrens attend majority as at the time of death as well as till date all the four childrens are minor.
And also the income arising out of the deceased estate and the tax is to be paid by the executer till the date younger son attains majority. In the system we are unable to file any provision for allotment of PAN in the name of executer or (Representative Assessee) Please clarify us.

I Purchased Land and Building in August 2014. Now i came to know that the property from whom i purchased was a Excise Tax defaulter.After 6 months of my purchase, Excise department created Boja on my property in Revenue Department.
Please suggest me what should i do.

Direct paymentment of property tax to bmc

As per BMC there is an outstanding arrears of Rs.5.5 Lacs up to year 2000 towards Property Tax (PT). Society claims to have paid the same in time but does not have proof of payment as bank do not have records for period beyond 10 yrs. A member is agitated and wants make payment of PT directly but the white color goons controling the society are not agreeing to this. Can the matter be taken up in consumer court in Mumbai.
