Sir, want to know if a registered owner is automatically a member of association under UP apartment ownership act . there is a condition to pay Rs 1000 to become member under the said act.
I want to know what happens if a particular resident does not pay Rs 1000. Is not paying an offence. Can he be prosecuted.
Pls guide

I stay just adjacent to a toddy shop. So, daily I experience a lot of nuisance from the toddy shop. The drunkards from the toddy shop come out of it after having toddy and relax near the premises of my home and sometimes they block the way into my home by sitting or lying down in front of my gate. When we ask them to vacate the place being in drunken and semiconscious state the drunkards enter into arguments with us which sometimes goes violent. There are instances of street fights also with drunkards. The nearby premises of the toddy shop has become a centre for prostitution because of which women from our home cannot go out for anything because even a good women is also treated like a prostitute by the drunkards. Also we face the problem of noise pollution, the unbearable smells as a result of frying the food stuffs to serve the drunkards by being the immediate neighbors of the toddy shop. Sometimes people visit the toddy shop after the closing hours (after 10 pm) and demand for the sale of toddy and when the workers of the toddy shop refuse to sell the toddy they create a lot of mess by which the sleep of my family and even the society is disturbed. When we address the problems arising out of the existence of the toddy shop to its owners they act at that instance only to clear the drunkards but, do not take a step to permanently stop the nuisance from happening and if we say more they neglect and ignore us and simply say to us "whatever we can do we did and we cannot do more than this and we are not responsible once the drunkards are out of our shop".
The toddy shop was established around 25 years ago.
To take the support of public it is really a difficult task to manage and convince the people as they are frightened of the court procedures that take years to settle the case and say we can’t spend our time by roaming to the courts for years. The people are also afraid of the toddy shop owner as he is a rich person and has a good political background.
So anyone please suggest me what can I do now to get the toddy shop relocated and the nuisance is removed.

Sir,
in a small village of gujarat we have a piece of land in the name of our father which obtained by the government for making channels of canal.
my father has claim the remuneration and the government has grant at certain rate.
During the procedures my father is expired and the advocate has asked us to file list of legal heirs called "Pedhi Namu".
We have prepared the same and submit before the authority and now our advocate said that we all three sisters and four brothers have to present before the officer to collect the cheque of our share.
We three sisters are married and very well settled at our matrimonial house at USA and UK and we do not want any share from the said amount.
my query is that without present before the officer can we make any notarized application / declaration / affidavit that we don't want any share from our father's property and our shares should go to our brothers?
Can the officer consider our affidavit cum declaration duly notarised?
Our advocate said that our presence is necessary and must but we are unable to come.
under the circumstance please guide me what to do?

If a female Hindu died intestate, how her immovable property will devolve on the heirs. Can the grand children of deceased Hindu female are entitled any share in her property? Is there any recent amendments regarding to this issue?

Can i get a stay for the interim DV order? This DV order was decided exparte.I have appealed against it in the sessions court.
Can the session court stay the interim DV order and ask to conduct the main trial.

mere dost ne ahmedabad me 1 vigha jamin li thi. par jab jamin li tab nakal me juni sarat likh kar aa raha tha. to fir uska dastavage ho gaya. par jab usne vo jamin bachne ke liye title clear ki procedure ki tab pata chala ke vo to asle me navi sarat ki jamin hai. to phir usne use juni sarat karne ki procedure ke liye ek admi ko kam sopa. par vo aadmi ne collector ka galat order la ke usme kachi entry padva di. par jab mere dost ko pata chala ke ye order galat hai to phir usne kuch bhi karke use namanjoor karva diya. yani ki uski paki entry to padi nahi. phir bhi land record me to va kachi entry dikhti hi hai. to use dar hai ki agar koi rti karke vo mahiti mage to uske upar kya action liya jaye. or vo use bachna chahta hai to kya kare . aur agar koi case me aisa hus hai to uska detail ho to vo bhi bhejna.

AS an NRI my brother is not supposed to buy agricultural land in India. will it be in order to buy on some third party's name and the third party giving my brother a GPA with selling rights, etc. Is this step legal. please advice any alternative.

Single parent for my 9 year old son. Due to bad marriage my name on passport is having husband surname (Muslim surname though I am Hindu). Same surname on Kid's UK Passport and Birth Certificate.
I put Hindu surname for Kid in school and that is differ than on his passport.
Currently I am staying in India with my parents and Kid.
I use my maiden surname as that is on all my documents except passport.
Now if I make my son nominee then variation in name could create problem. I am suffering so taking insurance and nominating my kid so that he could get some to continue his studies.
How to resolve it?
Note: Divorce case is pending. It will be dissmissed. On my passport ( After marriage my husband surname added but Husband name is not mentioned so can I officially get back my maiden surname. I don't want Muslim surname as it was ditch.)
Please help.
