Sir,
This relates to my cosuin service matter case which is pending before the High court for last 3 years..In one of the appellate court, the service matter was posted for final disposal and there are many petitioners joined together as co petitioners and the court has posted for final disposal...but certain new facts has come and for this impleadmnet of Governing body who is the union minsiter of cabinet needs to be required..
Please inform whether impleadment at thsi stage is advisable before the appellate court??

I am writing this message on behalf of Advocate Mr. T. Kalaiselvan, a member of this prestigious club, who due to some technical reasons is not able to access his account for the past two days. His password is locked due to some mistake hence he opted for resetting password by using "Password forgot option", the message received says YOUR PASSWORD HAS BEEN RESET AND MAILED SUCCESSFUL” whereas he has not received the same till this moment, in fact all his efforts to restore his account failed to bear any fruit. He is stranded and unable to think about what can be done next. Since he could not succeed in his attempt, he is unable to operate his account with his password remaining locked or jammed. He is worried about not able to access and help the forum as well as the needy with his services, hope somebody will take up this issue immediately with Admin and help him set right his problem by messaging Team Admin because even my Private messages to LCI admin failed to invoke any response so far, neither the Admin team is bothered about to look into its inbox for the messages from its members. The experts are requested to support the fellow expert Adv. T. Kalaiselvan to restore and operate his account by pressurising the team LCI Admin.

Sir, My WP is unable to get listed/reach in spite of submitting MEMO of POSTING. The matter requires/needs to come on board to facilitate my old parents, of essential amenity.Adv also expressed helplessness.
Please guide.

Dear Expert,
The O.M. No.11012/11/2007-Estt. (A) dated 14.12.2007, according to Para-7 provides that:
"7. Vigilance clearance will not normally be granted for a period of three years after the currency of the punishment, if a minor penalty has been imposed on an officer."
In the meantime, letter No. 25165/S/98-1 dt 10.6.1998 clarified that:
“The punishment of censure has no currency. Whenever an officer is ....... etc”.
My query is :
If an officer has been imposed with a minor penalty of "Censure", but one year later needs Vigilance Clearance to be appointed as Member of Regulatory Commission.
(1) Can Vigilance Clearance be granted to him irrespective of Para 7 above, on the ground that 'Punishment of Censure has no currency'?
(2) Or Vigilance Clearance can not be granted to him in line with Para 7, for a period of three years, reckoning the period of three years (0+3)from the date minor penalty was imposed on the officer? (Understanding that punishment of censure is a codified and formal punishment).
Pl tell me what to follow. I hope I explain the problem clear for you this time to enable you to give reply?

my husband had filed a divorce petition in 2010.i have also filed for the same but with a permanent alimony/settltment.at present i am geting rs.10000 as im. i don't have any documents regarding his ancestrol property details to prove he is well off is there any documents equivalent to the property details.please help

Have to file a case for divorce through the husband since he has found his wife to b involved in xtra marital affair for which he has mobile records available.
Can some1 help in guidance and provide a format for drafting. Also the child is 3 yrs old can the husband claim her custody.
Also the wife alongwith daughter is in other city. Can I file case in my city if yes how.
Can u also giv referance on the order of SC by virtue of which the wife gets case transferred at her native place or how can I restrict her in filing other cases against husband like 498a or 125.
Pls help. Tnx in advance.

Query raised: I have submitted my return through online by filing ITR-4 for the assessment year 2014-15 on Oct'15 and clain refund Rs.22,784/- according to 26AS statement.But in the month of Jan'15 the I.T.dept give me only Rs,5,057/- without any reason.Later my complain the Dept respond that mismatching of TAN.I filed a rectification within 7days but it was rejected without any reason.Then within seven days of issuing Sec.143(1) order I filed a revise return by claiming rest of the amount..But till date I have not receive.Now I.T.Dept respond the below mentioned words:
Resolution: Dear Taxpayer, Rectification Return has been filed after the due date, Hence, Revised return is treated as invalid as per the Income tax Act.
Please advice what way I get rest amount as refund.

I lost one of my unsigned cheque and in fact the same was stolen by one of our acquaintance and the same was presented with forged signatures in the bank by him which eventually got dishonoured with the reason 'signature differs.' I got to know about the same when I got a legal notice from the said person. I however replied stating the fact that I had lost that cheque and the cheque did not bear my signaturee at all. The expert also verified that the signature nowhere resembled with that of mine. The expert report is also lying with the court as an evidence But the case is still pending.
Please suggest me the future course of action.

Hi,
We have a bunglow in the residential area of about 5000 Sq ft and our compound wall on all sides are so small and we need privacy in our bunglow to use the garden and swimming pool.
Is there any legal restriction for the height of the compound wall.
We need to take around 15 feet high for privacy. Is this height ok legally?
Please guide us legally to build.

Refund of stamp duty
I had taken a property through a court auction for x amount and paid a stamp duty of rs 100 (all dd including the stamp duty & auction amount in 2 separate dd in favour of the local judge/court )the stamp duty dd has been remitted to a treasury from the court . the court also gave the sale certificate .
now the case was challenge in the high court by the property owner and I decided compromise to set a side the sale from the lower court. now the court is not giving the stamp duty paid by me and agreed to pay only my amount x.
how can I ask for the refund of my stamp duty please let me know .....
