Huf and ancestral property

Dear Experts,

I would like to have some advice or face to face consultation for HUF related issues.

My scenario is as follows:
We have an property inherited from my grand father and which was inherited by my father and his brothers. My father died last year without any will so we have to register my and my mothers name on the 7/12 extract. Based on advice from CA to avail tax benefits I have formed an HUF with I as karta of HUF . Is it possible to put my HUF name on 7/12 document and my mother to gift her share to HUF willingly ? If so could you please provide procedure to that. Thank you very much in advance.

Donation to club legal

I am building a residential apartment in Kolkata. Some local club people came and stooped the work. The want an arrangement with them to pay them by cheque monthly till the projecct is completed. The are taking the plea that this amount will be issued for social work.To buy peace if I pay them after negotiating with a covering letter attaching a chq giving terms of monthly payment with not exceeding the committed limit is the said letter and arrangement legal ?

I have applied for education loan so bank asks for NOC from society.

Scenario of the society is that almost all the members of the society are against the secretory and to remove him all the members have signed the letter against him and treasurer & chairman have resigned and all this things have been reported to the registrar.Case is still going on and decision is going to be in members favour but it will take time since summer vacation process will start after 15 days and election can be happen on 30/06/15.

So now he is the only authorized to sign the NOC and he is not agree to sign the same.

Now what should i do because i need the NOC within week.before i have given him print out of NOC he was agree that he will sign but he has refused at last moment.

What is the solution for this.Kindly guide.

Is there any time limit in months after FIR to file revision petition & appeal for quash ?

When court gave order of 156(3) to police & asked police to investigate the matter under above sec. Anticipatory Bail application rejected.
Then is it that police will arrest all or police will see evidences against each indivisual then take the next step?

498a - attendance for framing of charges

Dear Experts:



My 498a trial is about to start shortly and I believe the first step is framing of charges.

My parents are very old and are unable to travel to court for the framing of charges part of it. Can my parents give a general power of attorney to my lawyer with a written statement stating "not guilty" etc instead of being present in the court?

Is there any way they can get an exemption from attending court? Is there any other alternative, such as framing of charges via a video conference?

Dear Experts

Here one of my friend want to purchase a flat in sagarpur area, Were builder jointly Build a building in 200 sq yards area(100 sq. yards is another person name and 100 sq. Yards is anotger person name). They have not made any collaboration agreement for that. Now the both owner signed Agreement to sale. My question is;
1. Can they legal sale the property with both owner sign.
2. In Delhi they need MAP from MCD for More than 100 aq. Yards property. How can they obtained that without any agreement and deed for 2 different area of property.( in deed Proerty address is same for both area)
3. What documents we need to obtained to confirm our titel.

Transfer of flat in a registered co op society

My father now deceased,was owner of a flat in a regd. Co.Op Soc. In his will he had willed his property to two (out of five) of his children and a grandson and has not given any share to two of his children. The executor of the will is also one of the children who has been willed a share of the property. The executor has approached the society for transfer of the flat to his name. The society's lawyer has asked the transferee to provide the approval/NOC of the legal heirs who have been willed/not willed any share in the will for effecting the transfer.Please clarify whether the society lawyer's demand is correct and is the NOC mandatory for effecting the transfer.
