Share in property...

A lady friend of mine has the following query:

She has 3 brothers (total four siblings). Her father has huge area of agricultural land available in their village. She suspects that her father may gift the total land property to his 3 sons by registered gift deed, after her marriage.

What can she do now in advance to safeguard her interests and get her rightful share in the property, legally ?

Kindly advice…

Importance of citation

Respected Experts,

In 498 A Case, U/s 239 crpc When FIR Complaint Copy and Charge Sheet are proved completly wrong with all evidences on hand.. Does Citations are required to be present in front of honourable judge? Please advice me.

Builders failed to on agreement

Dear All,
In a Gated community venture. Builder committed for iron stair case, After final payment builder brought Iron ladder. When I went his office and showed plan as he committed earlier. Now he is refused to accept & saying as per him iron stair case means ladder.
Dear all please do needful I shocked on his changing reactions. I kept all my saving money and taken additional borrow from brother.

Cancellation of gpa and spa

I had sold my 50% share in a property to co-owner for 33 lacs in 2005. A joint Home loan of 25 lacs was taken in which my share was 14 lacs. The co-owner paid me 19 lacs and said that he will repay the outstanding loan to bank in EMIs. No sale deed was signed or registered but only a receipt of 19 lacs was signed by me and gave him GPA and SPA. He also committed that after two years he will takeover complete loan and remove my name from loan. Now after ten years he has not done so and the loan of 25 lacs is shown in my liabilities in CIBIL. He has also not sold or transferred the property till date and it is shown in my name in records. Now after repeated unsuccessful requests, i want to cancel the GPA and SPA and stake claim on my 50% share. Is it possible in law?

Name mismatch in sale deed and property will

Dear Sir, Mr. X had a house and his name in sale deed is written as (Mr. X Maindiratta). He died leaving a registered will in the name of his son. Now in the registered will which he left, his name is written as Mr. X Mahediratta.
So there is surname mismatch of Mr. X in sale deed and his last will.
Could this create a problem Mr. X's son wishes to transfer the property in his name since his father Mr. X had already died leaving a will in his name.

Tax exemption

If I am providing consultancy services to The World Bank (International Bank of Reconstruction and Development (IBRD)) and receive professional fees, (for services to be rendered in India and Income Accruing in India)

1) are such fees exempt from Income tax in the hands of service provider?

2) are such fees exempt from Service Tax in the hands of Service Provider?

Law in respect of house pledge in kerala

Dear Sir,

In kerala, a person took a house for residential purpose on pledge basis (not rental basis) for a consideration of Rs.200000 and the agreement period is 11 months. There is a valid written agreement between them and completed all the legal formalities. Now the tenant wants to suit against the house owner, who is default to pay back the consideration after the agreement period is over. Let me know about the acts applicable in kerala regarding the same??? Is Indian contract act 1872 alone applicable??

Powers to village sarpanch

Could you please guide me whether the village sarpanch in andhra pradesh have any clear-cut judicial powers.

I think in Bihar, the sarpanch order will enjoy full legality, and an appeal against such orders could be made at district courts.

Do they have any powers to recommend to issue right of record of a land to the occupancy, which is in his possession for more than 50 years???

Physical possession relief petition and objection against final decree

Sir,
Six months earlier my opposite party received HC first appeal judgment (1/5 share) against me in the civil land case. Now advocate commission has sent me notice to measure the land by the lower court order. Please guide me the following query.

1. Can advocate commission measure the land without my same opinion?
2 May I give physical possession relief petition and objection against advocate commission now?
2. May I get stay order from HC/SC against FD in this stage?

Motor accident

On 5th May 2015 while driving car to my home A man suddenly came in front of my car while crossing the road and got hit by it..I took him to a nearby hospital as he had head injury but no fracture..someone informed the police I told the hospital I will pay for his treatment The police could not find any document or mobile which could tell where he lives or something about his relatives The second day I shifted him to govt hospital Gzb and took care of him night and day so he could get well soon.The car was taken to the police station and is still there.The man told me that he doesnt want to file any complaint as he is a stranger in delhi and knows no one .He wants to have a small amount of money and ticket so he could go home.I asked the SI to record his statement he says yes yes we will go but doesnt go I offered him money then still he is thinking if he should go or not? NO FIR has been filed and i was not even arrested ..first i want to know how to take my car out of the police station..if i go to court the lawyers says police may then file an FIR to save their skin ..I dont know what to do

Plss guide me so the matter is closed forever
