Addition of party as co defendant in a pending bare injunction suit

Respect Experts,

A suit was filed by a tenant against wife of the owner of leased property seeking permanent injunction to restrain her from dispossession during subsistence of lease. Plaintiff filed the suit under a misconception that wife is the original owner. Now after knowing that husband is the owner of property, plaintiff filed an application under order 1 rule 10 CPC seeking to imp lead the husband/real owner as 2nd defendant alleging that he has been often visiting the leased premises and threatening the plaintiff to dispossess him forcibly.

My queries are :-

1. Whether plaintiff is entitled to implead a party as new defendant on the basis of subsequent cause of action pending the suit? OR

2. Should the plaintiff file a separate suit against the husband?

Pls answer my queries.

Review petition of summons

I have filed a criminal complaint U/s 403, 404, 405, 409, 415, 416, 420 & 120B. Magistrate has issued summons to accused who after attending few hearings has filed a Review Petition of Summons in court. Please confirm if matter will be heard by same magistrate or in sessions court. Further my lawyer informs me that it is very difficult to get a summons cancelled after issue. Is this correct?

oral hiba

Property was purchased in 1976 with my grandfather's money in the name of his wife (my grandmother) and two children. Grandfather died in 1986 leaving behind 8 children.
All members living in the building with their families as per oral partition paying their own electricity bill etc.
Grandmother died two months back.
Now the remaining two registered owners are claiming ownership as per registry, whereas all of us have mutually partitioned the property in 1992 as oral hiba.
How to defend ourselves?h
