My client executed a usufructuary mortgage for one acre for a period of 3 years for INR 10000 and delivered the possession to mortgagee
After 2 years, my client executed one more mortgage deed for 2 acre including the first one mentioned above for INR 20000 with a condition that he should redeem the first mortgage and take the delivery.
will second mortgage will be still considered as usufructuary mortgage since there was no delivery of possession to the extent of one acre at the time of creation of second mortgage deed.

3. H S Revanasiddappa Died in 2004 at the age of 62 years – 3 Childrens (1 Expired ) –Married in 1966
4. H S Nagarajappa Died in 1996 at the age of 51 years – 5 Childrens Married in 1966
5.H S Jayamma Died in 2012 at the age of 66 years -5 Childrens (1 expired ) Married in 1959
6 H S Heggappa Died in 2006 at the age of 59 years -5 Childrens Married in 1968
7. H S Sharadamma Died in 2009 at the age of 60 years -4 Childrens Married in 1966
8. H S Bharamakka Alive age 64 years -3 Childrens Married in 1966
9. H S Rathnamma Alive age 63 years -2 Childrens Married in 1970
10 H S Gangamalamma Alive age 61 years -4 Childrens Married in 1975
Late H Sanna Somappa had property as follows
1.56 Acres of Irrigated land in Hale Kunduvada Davanagere City Carporation . Which is worth of 56 Crores as of 2015 property value
2. Khana Koppalu in Hale Kunduvada Davanagere City Carporation . Which is worth of one Crores as of 2015 property value
3. Houses in Hale Kunduvada Davanagere City Carporation . Which is worth of 50 lakhs as of 2015 property value
The above three properties are distributed only among 4 male childrens 1,3,4 and 6 in 1980 ignoring the female childrens
The legal heirs of 1,3,4 and 6 sold few properties
The quiery is
Is there any chance of getting shares for 2,5,7,8,9 and 10 Daughters of Late sanna Somappa (The alive and the legal heirs of deceased)
If so could you please advise how to approach

I worked in CISF as sub inspector for 1 year where at the time of joining...i intimated for 2 exams (Cgl and Delhi police).
First Delhi police joining came and they gave me technical resignation but due to delay in giving resignation I missed last date to join Delhi police so they (dp) told me to join in next batch....but now my another intimated exam (CGL) GET cleared and I am expecting its joining before Delhi police ...so my query is do I have to again ask technical resignation from CISF for CGL (INCOME TAX). OR WHAT SHOULD I DO?PLS HELP

my husband and brothers in law running a general store in said Property.
1.Is said property is a HUF property
2.what is the right of minor child in said property.
3.what is wife right in said property before and after divorce.

I have filed a consumer case against "Country club" in the year 2012. Below are few case details.
1. I took country club tour membership in the year 2011 in Pune. When initially they explained me about the vacation membership for 5 years they gave lot of false commitments (like the payment from my ICICI credit card will be converted to easy EMI without interest as they have tie-up with ICICI bank which was false). There were many instances like this which I ignored.
2. After adjusting with the above conflict I booked a vacation on 2012 (to Kerala) with my wife. Which was our first outing after marriage. Country club booked the rooms in their resort which was free as per our membership. But when we went there the whole resort was under construction, rooms were unclean and no food was available.
3. As a result of which we immediately checked out and booked a room at different hotel.
4. After returning I lodged a consumer case against them in Hyderabad.
4. After fighting for 3 years, now the case has been dismissed by District forum.
I would need to check with my lawyer the reason for this dismissal.
And would also need to seek you advise what should I do now? I produced all the photos to consumer forum as a proof of the under construction resort. The membership cost me over 1lakh rupees. And have lost all my hopes.
Could you please advise me on how to proceed further and suggest me if there is any suitable lawyer who can help me.

Respected Sir,
Mine is a proposed society in Kandivali in Mumbai since its inception. Society has issued several bills charging compounding interest on the overdue amount which is against the Law and Rules framed under The Cooperative Society's Act. We have paid entire Capital amount till date but not willing to pay interest which is compounding in nature. As far as my knowledge is concerned, Society can only charge simple interest on the overdue amount and not compounding interest. Society members are not ready to give up and threatening us that they will go legal. I have few queries.
1) Can they charge compounding interest if the society is not registered under the Coop. Soc. Act?
2) What can be the maximum rate of interest?
3) What legal remedy I have in this circumstances?
4) Can I go to the Registrar and file complaint of the secretary although my society is not a registered one and only a proposed society?
5) Can I file police complaint and will they entertain me?
I may please be advised as my father and uncle is holding the fort due unity created by all the shop owners who are in majority in our Society upto 90 percent. Please advise. Thank you. Parthiv

My wife's father who is a criminal lawyer filed a fake 498a and DV case against my family members, relatives and myself in 2012. We have suffered a lot of losses in terms of respect in society, money, death of grandma due to my wife's kick on her stomach, etc in the last 3+ years but legally the case only got worse due to my father in law's influence.
Recently my wife started phone calling my mother and started talking to her to understand what we are going to do since we are all going to be sent to jail because of this false case. However thankfully we have been recording the conversations with her and at several intervals she has stated that it was a fake case to scare us, etc. On the call, mom has narrated the incidents that actually took place and my wife confirmed that - yes that is all true and what they have filed is a fake case/instances to the court and she cant do anything now but witness us all go to jail.
Someone please help us get justice against this false 498a and several other criminal cases by them. Does this phone call recording hold value in fighting the case further? How should we proceed as our lawyer also does not seem to help us whole-heartedly since they are colleagues. Please help!

Rent or paying guest
Sir,
In my house, groud floor I want to rent but I would like to give it to bachelors or ladies. Would this be rental of paying guest. If anyone from other state do I have to inform the near by police station. If I inform, wont they come and check frequently or harass?
To avoid this, should i have a rental agreement with one of their parents or paying guest would be better.?
