Query is related with Charge... I am confused between the term second charge and further charge... Does both means the same... Pls explain me with illustration for easy understanding... Second query is if modification is done with the amount of charge by increasing loan amt on the same property would ultimately becomes second or further or it remains first charge........

Legal working hours in a commercial establishment

What are the legal working hours in a commercial establishment? How many overtime hours can be done in a day? What are the hours for a woman including overtime? Can you get permission to work long hours in certain conditions at times. An ongoing permission for long hours? Can we be prevented from working long hours when we do so for some urgent orders?

Registration of flat in ahmedabad by poa & co-applicant

Sir
We have jointly booked a flat in one of the Prime Developers in Ahmedabad. My wife is the primary owner and I am the secondary owner (co-applicant). I have availed a Homeloan in my name from a financial institution for this flat.

The Promoter/developer has informed me that the flat is now ready for registration and we have remitted the stamp duty etc. and the date of registration has also been fixed for the first week of Oct15. Accordingly, we have readied all the documents required for the registration of the flat. As my wife is unable to travel with me, for the registration, I have requested for the format of a Power of Attorney to be notorised in Kerala in favour of me and taken to Ahmedabad. Now the Developer informs me today that we cannot goahead with the registration with the Power of Attorney and we both need to be present for the registration. I am totally surprised at this and we have to cancel my flight ticket to ahemdabad which will involve huge loss.

Please let me know, is there any other options available to me.

Share of wife in husband's property after divorce

Hi,

I have a query regarding the share which a wife can get in husband's property after or during the course of divorce. Suppose the husband is having a house in his name and he has filed for divorce. Then can the wife claim some share of that house during the divorce case or after divorce?
Is this what has been amended in Marriage Laws (Amendment) Bill - 2010 as per below links.

I am in private Institution and regular employee. The Disciplinary Authority have issued me charge sheet and I have submitted my reply. The DA have appointed enquiry officer and Presiding Officer on behalf of management. The list of documents have been produced by PO and me. The PO have also produced his witnesses/evidences by way of affidavit. On the next date I have to produce my evidence and witnesses by way of affidavit. My query to all experts is that please advice me that do I have to reply to list of documents submitted by PO and his witnesses who have produced their affidavits in my affidavit by way of evidence and witnesses.

Exparte decree

Sir,
A will was written by the property owner Mr.A in the year 1966 and it is registered. In will the matter is like this "After his death his property should enjoy 50 percent by his wife and 50 percent by his nephews". Mr.A was expired in the year 1970. In 1993 a clash arised between Mr.A wife and Mr.A nephews on the written Will. Mr. A wife approached court against Mr.A nephews filing that the entire property should belongs to her only(She dont have Children). The deponants attended only once in the court and didnt submitted the registered will and they were not attended the court for remaining times. In the year 1994 The court has given judgement (Exparte decree) to Mr.A wife as she is the owner of the entire property, with out noticing the registered will. Based on the judgement I was purchased the same property from her in 2011. After 21 years of judgement, Now Mr.A nephews approaching court with registered will for their share against Mr.A wife.

Is it favourable for them in court if they produced the will now? Is there any problem for me and the same property purchased by me?

Query regarding tor

I am working for an NGO providing counselling services to remand home children
Now the funder(foreign) wants us to give a Terms of Reference (TOR) to some of its consultants that would be monitoring and evaluating the project.
We have no objection for the same but
My query is
Is TOR a legal document?
The service receiver is a govt body and do I have the capacity to commit on they getting reviewed?
How do I communicate to the funder or do I directly change the terms and send for approval
