Share in elder brother's name land plot

We r two brothers. We were joint family and my elder brother purchased land in his own name. Have i the right in that land ?

purchase of agricultural land by non agriculturists

Dear experts,

Recently Govt. Of Karnataka had come to a decision to allow non agriculturists with income limit upto Rs.25 lakhs to purchase agricultural land. Wish to know has this been passed in gazette & when will it be enforced. Also can a person after selling residential property use the sale proceeds to purchase any agricultural land.

Tenant

Hi,
This is regarding a tenant's woes.Rather is a tenant in a small shop. Since 2000 paying agreed rent of Rs.700/per month.He came to me telling that landlord assured of repairs in the shop's roof etc and got a deed written from his agreeing to pay Rs.1200 per month.He paid renewed rent @Rs.1200 for 3 moths but LL did not effect repairs and threatened of eviction if Rather made fuss.
On my advice he has stopped paying rent and filed a petition before Rent Controller for settling proper rent.Rather has produced receipts of rent received by LL @ Rs.500-700 from his other tenants in same locality.
Now LL has sent a legal notice demanding rent @ Rs.1200/- per month.
1. If I send him at previous rate i.e. Rs.700/ per month,he will refuse;
2.If Rather deposits with RC at previous rate,this amounts to non-payment of rent giving a ground of 'default' for a suit for ejectment.......
Experts Plz advise.This is not ACADEMIC but a real case.

Filing of suit

Bank gave loan Rs.18 lakhs to purchase diesel generator under Hypothecation agreement .Party has removed the generator set .Now it is not traceable.Can the bank initiate proceedings under RDDBFI Act or is it sufficient to file original suit i civil court for recovery of money Pls advise

Cheque bounce

I am a Delhi based payee of a cheque drawn by a person on his bank account in Mumbai. I present the cheque for clearing in Delhi and it bounces. Can I file a cheque bounce case u/s 138 of NI Act in Delhi. My own view is that I cannot in view of SC judgment in Dashrath Rupsingh Rathod v. state of Maharashtra, (2014)9 SCC 129.Am I correct or incorrect. Shall be grateful for experts' advice.

Rental agreement

Hi all. I am currently staying in chennai
I have a house in Visakhapatnam , A.P. I need to prepare a leave and licence agreement for giving the A.P. house on rent. Can some of the experts please advice me on the below:
1. Can I buy stamp papers in Chennai and get the agreement signed in A.P.
2. I was told that if the agreement is for 11/months then the agreement need not be registered with the registrar office. Is this true?
3. I was asked to prepare a leave and licence agreement for the rental. How is this different from landlord tenant agreement.
4. Are 100 rs stam papers sufficient for the rental agreement?

Is leave & licence arrangement valid in delhi ncr

Most of government premises are let out for a limited period on leave and licence basis and in Maharastra specially Mumbai L&L system is legal recognized and practiced.
It comes under different law.

IT is said to be more effective than 11 months lease used for renting out premises
MY legal questions are:
1. Is L&L valid in Delhi NCR and what is fee charged for registration of L&L agreement
2.Where I can find a suitable L&L agreement draft
3.Is 11 month lease valid and enforceable

Sec 195 (2) crpc vis a vis sec 2i7 ipc

1. I am a public servant approaching this forum for the expert advice. By virtue of being public servant, Iam contemplating of lodging a complaint under the provisions of section 195(1) (a) CRPC for an offence of section 187 IPC against somebody[Omission to assist public servant when bound by law to give assistance].
2. However provisions of section 195(2) CRPC mention, quote “Where a complaint has been made by a public servant underclause(a) of sub-section (1) any authority to which he is administratively subordinate may order the withdrawal of the complaint and send a copy of such order to the Court ; and upon its receipt by the Court, no further proceedings shall be taken on the complaint.”unquote.
3. The possibility that the person against whom the complaint is being contemplated may use some kind of influence whereby the authorities to whom I am administratively subordinate may order the withdrawal of the complaint. Such a possibility cannot be ruled out.
4. As such, the whole aim of bringing the guilty to book for contempt of lawful authority of the public servant gets defeated by such a parallel provision in the legislation by virtue of section 195(2) CRPC.
5. Don't you think that the authorities to whom I am administratively subordinate, if at all order withdrawal of complaint,would, by ordering the withdrawal of such complaint tantamount to committing of an offence under section 217 of IPC[Public servant disobeying direction of law with intent to save person from punishment or property from forfeiture].
6. May I request the experts to suggest some way out in such a situation so that the guilty is brought to the book.
