To carryout onion business

Sir, I proposed to do whole-sale Onion business in Chennai.For that I will setup a whole sale depot in Chennai. To do that business we will import Onion from Maharashtra once in 3 days, lorry load of 15 tons or 21 tons. In this regard to carryout this Onion business, and to bring it from Maharashtra,does any license mandatory or must for me. Please guide me and clear my doubt. On of my friend said to bring lorry load of Onion, no license is required. Please clear my doubt. D.J

Stay on construction by disowned sons wife

DDA Property was joint on the name of my mother and father. After fathers death share of property was equally divided in the name of mother andtwo sons. Elder married son
Relinquished his share in the name of brother. Two years after that mother disowned his elder son and was given posession of property by court. My question is whether elders sons wife can put a stay on any construction or renting or selling of this property claiming that i was fraudently evicted from home as i wz nt the party in the suit of posession.?

dissolution of cooperative society

Can a cooperative housing society, registered under Gujarat cooperative (societies act )can dissolve cooperative soc. & sell a flat of share holder member without his consent to a builder, who is developing & reconstructing the society? TIA.

A person has taken a personal loan from bank and after paying few instalments, person was not able to pay the remaining instalments due to heavy loss in her other transaction. Person is currently jobless due to sickness. Bank filed a suit for recovery of debt and obtained a decree of movable attachment. The person is not doing any job and residing in parents house and depending on parents. The house where person is residing is on her parents name. All the belongings in the house belongs to her parents. Can court attach movable property of her parents as she is residing in parents house. This is the same address which is mentioned in bank records. What are the alternatives in case if person wants to repay the loan in instalments. Can a person ask for time from the court that loan can be repayed in instalments after getting a job.

execution petition

Dear experts
A filed a suit for recovery of money and got degree in favor of him.later he died .now his wife wants to file an execution petition along with her sons as his legal heir aganist the JDR.can we file an execution petition aganist the JDR along with an affidavit stating the facts along with legal heir certificate issued by the TAHASILDAR or we have to brought on record the LRs before filing an execution petition in the court.kindly give suitable advice on this.thanq experts in advance.

Self acquired property after sale challenged by daughter in law claiming the same ancestral .

Can you guide me in the matter delineated below:
My grand mother acquired a dwelling house owned by her husband (my grand father) through “Will” after death of her husband. My grand mother in her life time in consequence of family settlement gave 1/2 share of the property already in possession of her elder Son (my father) and 1/2 share of the property already in possession of her younger Son (my Uncle) through consented decree by the Court. My father in his life time sold his dwelling house( so acquired from his mother). We are three brothers, all living separately. I am elder one. Brother next to me had married to a already divorced women (not arranged by family) and he was living separately.They are in dispute with each other. divorced petition filed by my brother stands dismissed. Dispute for maintenance raised by his wife (daughter in law of my father) is going on. She had requested the court to attach the property of her father-in-law (my father) in domestic violence case, but the court had ordered that if her husband (my brother) own any property in his name, she has right to reside or in alternative he will give Rs. 1500/- per month for accommodation on rent. Mean while my father sold hos property acquired as above. But she (my brother’s wife – daughter-in-law of my father) filed civil suit in the court challenging the sale of the house by my father claiming her share and stating that maintenance amount is due to her husband (my brother) during life time of my father. He made party to my father, purchaser of the house and her husband (my brother). The suit is going on. Earlier it was being defended by my father and the purchaser. However, my brother is not defending the case. He some time give her maintenance and some time note. Due to this he was put in jail also. But so far the litigation against the sale of house by my father is concerned, he is in connivance with her. Meanwhile, in April 2014 my father has expired. Now the suit is at the argument stage and we two brothers (now) and one her husband already made party (exparte) and my mother and my two sister have been made party to the suit, which she had filed in the life time of my father. She is claiming it as ancestral property, which has been acquired as above my father from mother during her life time in family settlement and through consented decree in the court. I understand that property being divided in family settlement and consented decree during life time of my grandmother is self acquired property of my father and he sold it during his life time. He was competent to sale the same. He spent the proceeds in liquidating the debts and for his treatment, etc. We two brothers living separately have no objection.
In view of the above please guide us regarding the arguments to be advanced by our Advocate on our behalf.

Society not making member

Hi,

I purchased a flat in Nerul, Navi Mumbai from a builder. In 1990's the plot was allotted by Cidco to the society formed by the builder himself. I have received possession of the flat years ago and have been paying monthly maintenance and other expenses regularly but Society has not made me a member yet. No share certificate is issued to me.

Society wants me to get my name added/transferred in the list of members by CIDCO through the builder before it can make me a member.

While builder says he has nothing to do with it and my name can't be transferred as all original members have been replaced by new buyers already.

Some suggest I should get a transfer certificate from CIDCO.

While some others say I can only become Additional Member not full member (!!?)

What is the difference?
What are my choices now?
How can I become a full member?

Dear Sir,
मैं एक डिफेंडंट हुँ, अगर WS फाइल कर दिया गया हो, U / O 39 RULE 1 & 2 PLAINT का DISMISSED हो गया है, ग्राउंड ऑफ़ plaintiff has failed to prove that there is a prima facie case in favour of the plaintiff. क्या मैं U / O 7 RULE 11 CPC के तहत APPLICATION लगा सकता हुँ the ground of
1 . non-joinder of the necessary parties as the plaintiff has not made the other legal heirs
2 the Application U/o XXXIX Rule 1 & 2 CPC. and failed to prove that there is a prima facie case in His favour
3 the plaintiff has not correctly described the status towards the possession over the suit property.
