Father is missing fir date cosideration

Respected Sir's
This is Jhansi from A village of Andhra Pradesh , i request you sir to please give the details for --(consideration date of FIR if a person is missing) .Sir As i mentioned i am from village ,my father gone missing from 2005 but we filed FIE in the year of 2010 [ resign - we from village first don't know the process, second fear of going to police station ]so sir i request you to please say , what is date of consideration for missing is it date of missing or date of FIR, please give me the details of any old cases like my case .thanking you sir.

What should be the next step

an agreement to sale took place in 1992 in saharanpur but sale deed couldn,t take place buyer died in 2010.buyer,s 4 sons created forged documents on their wife,s name and solded the house in september 2014 to two other people.this is my mother's mother house.my grand mother died in 1988. i lodged the FIR on 9th april 2015 u/s 120B,420,467,468,471.chargesheet has been filed.on 30th september 2015 NON bailable warrants were issued.earlier i had filed a caveat in high court allahabad.my bad luck i got a dishonest lawyer who didn,t defended the case properly and court has given following order on 8th october 2015.kindly suggest what to do next.though i have planned to change the lawyer.

Query regarding gratuity period

After reading most of the replies I got to know that if you have completed 4 years and 8 months (240 days in last year) in continuous service then you become eligible for gratuity but if someone has completed 2 days less means 238 days in last year before leaving the service can he be eligible for the gratuity....please suggest me.

Service rules

sir.

i have joined a public sector company, at the time of joining company has taken an undertaking that i have not pursuing higher qualifications and i have not highly qualified. i have been appointed on graduation now.

there was a two advertisement one declared in the year of 2009 and another in the year of 2012, i have been appointed as per the 2009 advertisement and i have joined in the year of 2013. but in the year of 2010 company issued the circular that, all employee having higher qualificaitons without comapany permission, had given an one opportunity to incorporate the higher qualifications. SInce i have been appointed as per the advertisement 2009, that circular is applicable to me and company could incorporate my higher qualifications.

in the year of 2013 company amended the recruitment rules and barred to incorporate higher qualification who suppressed at the time of joining. since i have appointed 2009 notification, comany can incorporate my highr qualifications.

means time before my absorption, one manager given compalint against me that i have joined the company suppressing the higher qualification.


and i am working in human resource dept,. and i have completed LLB which is relevant to my work
now my question is can comapny could incorporate my post graduation qualification. can i get relevant judgements which help me to incorporate. please reply me.

right of way

Dear sirs. We are 5 property owners who had purchased 5 properties one behind the other and had left a 20 feet road access to our respective properties and we have records to prove that the road is only a private road .. recently the families from our neighbouring lane have requested the city corporation to demolish a wall from our lane which connects to their lane and allow them access through our lane. They have used some money power as well. As such the corporation guys in my absence have carried out an inspection without giving me any notice written or verbal and haven't even asked for our documents . They have directly sent us a notice stating that we have blocked the road and we need to demolish the wall . Even the town map and our property sketch and documents states that it is a private road. The corporation has put tar and drainage facility in our road a couple of years ago but we have never given in writing nor gifted them the land. (Daana patra) does this imply that our private road has automatically become public.what are our chances in this battle ? Can they just come and demolish the wall with one notice ? What are our options now .

498a & 406

Sir,
I have given my Statement in 498A & 406 U/S 342 two months back.After 3 hearings of my Statement U/S 342, my ex wife has filled an application through her counsel for my restatement U/S 342.
My submission is can they make such applications, in court. Is it maintainable in court of law.
Please advise.

Bigamy

Dear sir,
My friend got Devorce from first wife and got married with another lady after Devorce.but he have a kid from second wife before Devorce from first wife so my query is this comes under bigamy or he is safe as per law,

Liquidation

Our company was taken for liquidation by unsecured creditor in the year 1999 By order passed Gujarat High court,Ahmadabad.(Ex-Party)

Now we have put a application in the same court for Revival of the company so that liquidation order can be set aside.(under section 391-394)

We have negotiated and settled with all creditors, secured and unsecured and also made part payments and taken settlement letters.
Also we have met the official Liquidator and shown our willingness to pay full payment of their dues towards expenses.

Official liquidator is holding a land belonging to the company which is valued much less than the amounts payable to the creditors.

We are interested in settling the dues so that if the liquidator sells the land the proceeds will not be enough to clear all dues and as we have given personal guarantees which can be evoked after the short receipts from sale of land.

While our application is pending in High court for order which is taking time.

We need to make balance of due full payment to creditors as per settlement time frame commitments otherwise as per settlements the settlement done can be cancelled by the creditors.

Now basically what we need to know.
1) Can we make all payments and take no due letters from all creditors while our application is due in High court.

2)Suppose all payments are made and there are absolutely no due and no claimants then what is the status of the company.

Kindly inform status and inform if any good Advocate available in Ahmedabad on the subject matter.

my previous employer not attesting my pf documents

respected seniors,
i am writing this on behalf of my husband. he is unable to get his provident fund amount despite of trying all the methods. he is undergoing a medical treatment for his ear which was highly infected that time and still not in a better condition from past two years and he is unemployed because of the same reason. And he was on leaves for his treatment while his company raised termination against him without any intimation. and when he went back to join the company refused to take him back and now we are trying hard to take his provident fund amount as we need money for his treatment . but the company has refused to release his relieving letter and not attesting his provident fund papers. we have spoken to HR and written a lot of emails , however the response is always negative. and after losing hope we did sent the EPF forms to the regional provident fund office but they have rejected the forms because the employer has not attested those. we really need your help and advice please let us know what we can do in this case. and if we can send a legal notice how do we do it. we are financially not that strong however we can and will fight for our money and rights till the end. my husband is very depressed i want to help him but i feel helpless. plz suggest ways and if u want to contact for an advice please send it to my email . prachee161985@gmail.com

Fnf & releiving letter not released

Dear Team,

I was working with a Broking Firm. my last day of working was 31.07.2015. its almost more than 2.5 months. The company is not releasing my FNF & experience letter & also Holding my PF due to that. My records are clean & also have served the Notice period. They have a clause like you should take signatures of clients on ledgers with whom you have traded. Now, the case is when I was working they did not provide me any ledgers for the same, I could have done my deedfull there and then. After 2 Months they are telling me to do all such things. Now, after leaving an orgainsation How can I ask My clients to deal with signatures on ledger as I dont have any contacts with them plus they are also not taking follow ups on my behalf. What should I do in this case ? Tell me where can I complain for this ?
