Regular bail in 406/420/34 ipc

Two anticipatory bail applications have been declined by the Session Court in the above case. Now, the applicant wants to surrender and seek regular bail. I am counsel for the applicant. IO attributed the recovery of stolen items at the applicant at the instance of the accused whereas no recovery, in fact, has taken place at the residence of the applicant.

Let me know how to proceed for surrender and regular bail. Should the applicant surrender before session and seek regular bail or what?

Evidence by affidavit

Civil procedure code was amended and provision for examination in chief by Affidavit was introduced. The idea was to save court's time.
However that purpose is not served if total evidence of all the witnesses of the party is not taken at one time. It is observed that parties improve the evidence in successive Affidavits filed on different dates.
It was further provided that cross Exam. be taken by Commissioner appointed by court,But that is not done(at least in labour /Industrial courts) Thus the whole purpose of amendment is lost and the matters drag on as before.
Instead of gainfully using the amended provisions, every one harps on paucity of judges.

Rules in high court

Hi,

I had approached High Court against residence order passed by the Sessions Court. High Court gave status quo order.

Now I want to apply modification of this order.
So I have filed a modification petition and an SR number was given to the petition but the petition was returned with some objections. These was rectified and the petition was resubmitted but still no MP number is given to the petition.

My questions are:
(1) While the petition is not numbered and still in the SR stage, can I take the petition back and resubmit it?
(2) Can I not-press the petition and file a fresh petition on the same grounds as before?
(3) Can I complain to the Chief Justice regarding the petition being not numbered?
(4) Any other suggestions?

Thanks
