Can grandmother claim maintenance?

I am Mr. X. I am a muslim. I was married to Y who is also a muslim girl. We had a child out of our wedlock named A. Now Y divorced me according to muslim rituals before the kaji and got married to another man keeping her child with her mother K. Now K who is the grandmother of A had filed a petition under Sec 125 Crpc before the court claiming maintenance for her grand child A. I want to know whether K had the locus standi to file the petition and claim maintenance for A. K is not appointed by any court as guardian of A. A is 7 years old. And X had also filed a case in another court for the custody of his child A which is pending. Please refer judgements.

DRT/cgtmse case

I had written previously about a loan our partnership firm had taken under CGTMSE scheme which means no Collateral was given. The suffered huge losses and my partner left the country. I also had to change my address since I could not afford rented accommodation. The bank filed a case with DRT and I did not get any summons, as address had changed. Now I have come to know the DRT has passed recovery order.

There are no assets in my name just a 6 year old car. The amount involved is huge about Rs. 70,00,000/- there is now way I can manage to pay the bank.

I want to understand whether I should file an appeal or not? What will be the outcome of appeal, and If I don't have any assets, what will happen, what action will the bank/DRT take.

It was a genuine case of business failure in which some huge shipments got rejected and ended in huge losses.

Please advise what should be my course of action.

Legal heir certificate

My father passed away recently. He got divorced from his first wife thro court. She got divorced without any issues. My mother is second wife. While applying for heir certificate, should v produce death certificate if she is dead? Pls advice

Documents with evidence allow o 8 r 1(a)(3)

i am defendant and not file any documents with WS now i am filing petition with evidence affidavit under order 8 rule 1 (a)(3) read with 151 of cpc

can its correct and what ground i have mention, pls suggest few grounds...

Gratuity

Hi Experts,

I am working in a MNC from 22 june 2011. Now i am planning to quit the job. I read like to get gratuity i need 4 yrs 240 days continuous service. But in between i took LOA for 3 months , specifically from dec 15 to march 16. Does this LOA will affect the eligibility for gratuity?

My sister's husband death before one month.

I am not comfortable with English so I am writing in Hindi. ek month pehle meri sister ke husband ki death ho gayi thi. meri sister ki shadi ko 4years ko gaye hain. unke 2 bachche hain. sister ki sasural wale bol rahe hain ki wo apne ghar Jaye. Hum ne Jo saman diya tha shadi ke waqt like jewelry, bike etc. uska kya hoga. or unke husband ke naam kch property bhi h kya wo meri sister or unke bachcho ki hai ya wo property unke sasural wale lenge. please tell me right decision according to Indian law. please help me as soon as possible.

Divorce to husband

Good evening. I am a Muslim.I married to an NRI about 1 year ago.my husband stays in gulf .I stay with my parents.Before marriage I was told that I will be staying with him,but he did not send me visa yet.He doesn't provide any financial help too.I am fed up with my husband's behaviour.I want to divorce him even if he do not wish to.please tell me how to proceed for that.

Filing of contempt of court petition

Dear Sirs,

I live in Delhi.

I have filed a Civil Suit for the demolition of the illegal construction. The Civil suit was awarded as Lok Adalat Decree. In the Decree it has been mentioned that any non compliance will result in Contempt of Court.

But the MCD has done only a partial demolition. I am planning to file the execution petition and also the Contempt of Court petition.

I have been advised that the Contempt of Court can be filed only in the High Court or Supreme Court. And not in the local court where the judgement is delivered.

Kindly advise which court and when to file the Contempt of Court proceedings?

Can I ask costs in the Contempt of court petition or in the execution petition?
