Whether re-presentation of cheque is denied by rbi?

Respected Advocates !

I came to know that Cheques cannot be re-presented hereafter and cheques can be present only one time.

is there any RBI circular/guideline/any other order regarding this?

Dearness allowance and its calculation

For example, our Private Sector company was giving Basic (Rs. 3000) and DA (Rs. 3000) to the employee and there were only two components. We were paying the PF for the combined amount (BAsic + DA).

Now, in this financial year, I would like to revise this structure.


1. Is it possible to take away the DA completely and call it Special allowance? This means that my PF amount will be lowered. Is this accepted by law?


2. Is there a minimum hike year on year to the Basic as well as DA anywhere stipulated by Factories act or any other law?


3. For the new employees joining, can I get rid of DA? This means that the current and new employees will be on different structure. Is this fine?

Agreement to sell

Dear All,

greetings!

i am purchasing a house which is a leasehold property for which we have already entered into agreement to sell and given an amount(ie Bayana).
now for giving part payment of the actual final amount, i am thinking of entering into another agreement to sell with the same terms and conditions referring to the earlier agreement which interalia will cover the money we are giving as part payment. Full and final money will be given in the form of DD at teh time of registration of final documents

query is --if i enter into another agreement to sell, will that be valid and the earlier one will also remain valid, please advise

Recovery

Bank has filed a civil suit for Recovery for an agricultural loan now the defendent advocate has raised objection that under the Gujarat Public Money Recovery Act First step is to approach the collector who will call the defaulter and do the procedures
without approaching collector No Direct Suit can be filed in Civil Court
so is it mandatory to approach the collector first? whether bank has to withdrawn the present suit or any defense is there? pls.guide

Declaration of immovable asset

My mother has to declare immovable property for a surety bond , we own a house in karnataka which was registered under my father's name , he has expired 5 yrs ago , we have land record of house transferred (RTC) but have not transferred registration.
My doubt is how to declare the house registered under my dad's name?

Who can be guardian of child

Dear All,
Me and my wife are living separately before the birth of my child.
My wife has never allowed me to see my child. I have filed application of visit right but it is pending in court because of delay tactics of my wife.
Now from my sources I got the address of school of my child.
I also got information that in school records guardian name is name of grandmotherof child.
How to get the school records corrected.
I want to file a case against school and my wife. Please guide.

exemption for St

Sir,
I'm ST of Arunachal Pradesh, India and working as UDC under the Govt. Of Arunachal Pradesh. I had been posted at Dibrugarh, Assam for temporarily, till further order from govt. Since many years I have been paid income tax to the govt. But, I still need to confirm whether ST has to paid the tax even if he/she ia posted at Assam or any other region where income tax is mandatory?
