Temporary worker is employed in our Company-service industry for 2 months-
1) Will he be entitled to benefits such as ESI & PF? If yes, can he challenge his termination of service after expiry of his period of appointment viz. 2 months?
2) How many leaves shall he be entitled for these 2 months?

A few days ago I had already sought the advise on this topic. But, as I had not explained the facts and circumstances of my case, I could not get effective guidance by the experts.
My case is that I was absent from duty as on the date of enforcement of revised pay rules and retired from duty during my unauthorised absence period. Departmental authorities had accorded me the sanction for fixing my pay in revised scale and the payment of retiral benefits computed based thereupon.
The Pay and Accounts Officer, suo moto and unilaterally, has authorised my pensionary benefits taking into account the actual pay drawn by me, immediately before the date of commencement of my absence, in the old scale.
In a similar case the HC had quashed the action of the PAO and upheld the sanction of Department. The Division Bench of the HC too had confirmed the judgement of the Single Bench. The entire benefits, as per the departmental sanction, were paid the petitioner in that case upon his filing Contempt Petition. As such, I had requested the PAO for revising my Pensionary Benefits by extending the benefit of the judgement of the HC which covers my case from all four corners. But, PAO had informed me that as it is decided to file SLP before the SC against the judgement and order of the HC I cannot be extended the benefit thereof.
Now, the operation of the judgement and order impugned by the PAO in the SLP filed by him came to be stayed by the SC I am adversely affected by the Interim Order of the SC.
Therefore, experts may kindly advise me as to whether I may become intervener in the said SLP.

Sr I am law graduate registered in your portal,serving in Army,undergoing trial since 03 years,want divirce from wife being cruel beaviour of her n her parents.but no evidence has been produced by them yet n I hv not filed any counter case,there motto is to make case lengthy so that I am unable to remarry n keep on drawing maint money.plz guide how to quicker get rid of problem

My father has a register will ..who is alive n is owner of the property ie ...of a flat for my sister ....1.what's the legal validity of it in case the current occupants ie my elder brother ..does not vacate it ...2. Do we need to get it registered in case there is problem in future or its good enough legal ground.thanks in anticipation.

My wife had applied for the passport.She completed tenth std in 2002. But the documents was missed while applying the passport. she had birth certificate, but in that name was not mentioned. She went to passport office with her birth certificate along with declaration form from her parents regarding name as per passport document instructions.
But the passport officers put on hold and not accepting the birth certificate. my wife date of birth was before 26/01/1989 and he told no need of this documents and advice to furnish tenth certificate for date of proof.
Now the issue is we found tenth certificate, but the date in tenth certificate is different from birth certificate (what mentioned in application submitted).
Date of birth in application :01/09/1987
Tenth certificate : 17/10/1986
Kindly guide us to get the passport

Father inherited some property from his parents.
Mother inherited some property from her parents
Question :
1. Can Mother write will / gift her inherited property to any one?
2. Can son(s) claim a share Mother's property when she is alive?
3. How to stop one of Sons selling properties as GPA holder without consent of others?

I have a ancestral property of 40 Bigha in Uttar pradesh. We are 4 shareholders and my father has expired. This property is divided into 8 pieces which are in different areas and hence valued at different prices
We have applied for partition of property through court and even have a compromise letter signed by all shareholders. We have agreed to give 2 shareholders 11 bigha each and rest 9 bigha each to other 2 shareholders.
Now the SDM is not accepting this and is saying the land will be equally divided in 1/4 parts i.e 10 Bigha for each.
Also he says that every piece of land will be divided in 4 parts which means every shareholder will have share in 8 pieces.
Is there any way out that property can be divided according to our compromise. SDM has said if we can bring any past ruling he will allow the division. Any help would be highly appreciated..

Dear Sir/ Madam,
I have filed a case u/s 138 of N.I.A in the court on behalf of my client, summons towards the address of the accused was issued by court and send back to the court as the accused was flied from there now i have the another address of the accused where the accused is running his activity presently, with the application of mine the court issued another summons to the accused on the new address which was given by us but the said summon neither does not recd.to the accused nor send back to the court. Now what to do in this matter, i have already filed an application to the court for By-Hand Summons.
