Dear Sir,
I am looking forward to purchase a flat in goregaon suburb at mumbai.It has however come to our notice that the flat on which the building is located is a leased land. There are 3 such buildings in the society. It is learnt that the leased land is for a tenure of 99 yrs and that the society has completed apprrx 50 years of lease. In such situation, can u please guide whether i should buy flat in the building as i am concernerd with the ownership rights once the lease period expires. Also kindly guide whether the sellers agreement for sale will mention that the property is leased ?

HELLO SIR! I am persuing my final year of mechanical engineering,i want to do diploma in civil engineerint.My final year of degree is my 1 st yr of diploma. am i elegible to do both the corses at the same time.
Please clearify my doubt as soon as possible last date of diploma councelling is of 27May 2016

My wife is expecting 2nd baby (pregnancy of less than one month) after 12 years of marriage but I do not want baby any more. She became pregnant by lying me about her date and forced me to discharge inside which causes her pregnancy. She gets this pregnancy without my consent and also I am not in a position to maintain another child as I am now 44 years old and not having secured job. Kindly guide me the legalities if I force her to abort her pregnancy as she is not wiling to abort or can I give her some medicine without intimating her. Can I approach family court to seek order to abort if not agreed by her?

A Public Charitable Trust which is NOT REGISTERED under section 12AA of Income Tax Act, is assessed as AOP. So can it claim expenses and put to tax, the surplus as an AOP ?? (Income are in form of Government Grants for projects , and Voluntary Donations ). For example, if Receipts is Rs. 500000 and exp are Rs. 300000, so what is the tax to be paid and at what rate ??

Hello Ma'am/Sir,
I am a Manager in a renowned development sector organisation. I applied for BPSC Assistant Professor examination [advertised in Sept. 2014] after my M.Phil from University of Delhi and working as an Assistant Professor in a private college. I was expecting for the exam to happen by end of 2014 and results to be declared by mid 2015. Which did not happen that way. The exams were delayed for more than 1 year for variety of reasons and interviews were conducted only in December 2015. While waiting for this government exam to happen, I also applied for PhD program in the UK in January. Being a meritorious student, I got admission in the UK PhD program in January end 2016 as well as full international scholarship with maintenance grant on 8th of March 2016. BPSC, after much delay, published the results of the interview on 12th May 2016.. Now, my worries are following:
1) My PhD PROGRAM STARTS FROM 1st of October, when I will be still in probation [The post is a permanent post with 2 year probation]. And as per my knowledge, I won't be eligible for any ways to avail a long leave of three years.
2) Still, since I have a very genuine cause (I am the only one to receive this full scholarship from India for a PhD this year and the University is a top-most university), is there any way I can request and hope for extraordinary leave of any kind? Who will be such authorities to grant such exceptional cases leave?
3) Who are the people I should keep informed and submit an application to, in case after working for 3 months , I decide to proceed for PhD to be legally not considered having done a mistake/crime?
4) In how many days, I can expect a reply from the authority on whether my leave has been granted or rejected?
5) In case the request for leave is rejected, how much time normally will I be given before they terminate or dismiss my services?
6) I am worried because I am very passionate about doing a PhD, but I also want to contribute to Bihar in some ways - a small state where education is in a bad shape. And since this vacancy has come after 13 years, don't know how long will it take for the next vacancy to come.
I will be very happy if someone having a sound knowledge of labour laws responds. I will be very oblized.

I was working with Era Infra Engg company and HO in Noida sector 62.employer did not paid me salary of 8 months and i left the company however they did not paid me single amount.my salary was around 94000/-INR.kindly help in this regards.

Dear Sir,
I had taken a flat on leave and license agreement for 2 years with a lock-in period of 12 months. Registration and police verification were done. Now the society apparently had a bylaw that no bachelors would be allowed which the landlord was ignorant of.
The landlord initially said that he would fight against them but later backed out as he didn't want to jeopardize relationships and said that he has got a notice from society to ask me to vacate upto 21st June. He hasn't given me a notice yet but just asked informally. I am okay with moving provided he compensate me with an amount of Rs 30000 (equaling my brokerage, stamp duty, moving costs etc) plus returning my Rs 1 lakh security deposit.
If the landlord refuses can I refuse to vacate? As it is the landlord who has broken the lock-in period. I have been regular with my rents and have not broken any of the clauses of the agreement.
If I refuse to vacate will the society be able to take any action against me or just the landlord? Also if the landlord seeks to evict me legally what will be the procedure and how should I appeal? Also if it ever goes to court how long will it take? If it takes over 12 months I am fine as I will leave anyway after 12 months.
I am attaching the leave and license agreement.

Purpose of caveat
Based on the lower court order in my favour, I filed a caveat in the sub-court against the defendant. The defendant filed an appeal in the sub-court and the court has served the summon to me. My question is what purpose do the caveat serve ? Can you the learned lawyers please elucidate ? I am given to understand that before admitting the appeal, I would be intimated first.
